The Monterey police department did forward the report to prosecutors, but sometimes there is just insufficient evidence, or evidence admissible in court, or a sense that they were not confident they could secure a conviction. Which doesn't mean the incident didn't take place, only that prosecutors don't like to charge cases that are not very strong.

Trump was found guilty and then elected President, which means that at this point no kind of controversy with law or conviction in court should block someone from becoming a member of the cabinet. You also got the police wrong. The created the report and sent it on to the district attorney for them to decide. It's also clear you don't know the meaning of abuse.
