Thank you CCK for the information and guidance provided to all of that have served. Just last week my compensation was changed from 90% to TDIU. I was overwhelmed when I was notified by my VFW Claims Officer. The St. Louis, MO. VFW office has been awesome starting with Mr. D. Flynn, he started the ball rolling for me and through his efforts I was initially rated at 90%. This was last November, my TDIU is backdated to April of 2021, the same as my rating.

I was denied TDIU but the letter stated that I can do Sedentary work and if I have new and relevant medical Evidence/opinion to submit and the VA will consider my TDIU. original date 9/20/2018. My Arthritis Specialist wrote his medical opinion and exam and clearly state "due to my service-connected disabilities and medication I can NOT do sedentary work or any work.." now I'm waiting....I had better luck with the old system than this new and improved process.. Well the new process is still a joke. I was denied again....But the VA considered a non-service-connected disability to deny the claim....VA RO did not read the last page of the medical report that clearly states that the service-connected disabilities is the reason. I believe the court stated that only service-connected disabilities must be considered and if they overlap VA can not parse out impairments and limitation and must attribute them to service-connected disabilities......I have appealed to BVA.......We'll see what the law judge does......the VA game continues.....deny, deny, they wants you die....

Fantastic KZbin video! I appreciate your constant diligent efforts as you share VBA disability claims information. Keep up the good work. Please consider moving the National Ensign to the viewers left (presenters right).

Questions, if anyone could answer; If a veteran worked for 2 months then quit due to service connected disability. Would that help or hurt the veteran if he decided to file for TDIU?

what do you do if you are rated at 100% service connected disability for ptsd depression and anxiety but not considered tdiu I have been unable work dues to these conditions for well over 5 years?

If you are at 100% you are done....TDIU takes you to 100% if you are less then 100% rating...if I was you I will do nothing. Because you can't can more then 100%......if you work or not, doesn't matter, you are fine

Well ?! Does one have to meat all of those criteria or a percentage one ?! I can make 12 - 14 a year working for myself as a handyman/contractor on days that I can actually get up and move but my reliability is shaky at best the only reason I can make what I can is because of my skill level I have to work for myself because of my unreliability this only created more questions for me according to this I only meat the reliability factor is that enough ?!!!! In fairness your videos are usually quite helpful but this one well !

Can I be qualified if I have been on ssdi since 2013 with 90% combined rating from the VA. My disability is from visual field issues, mental health, back issues, migraines, pituitary tumor, and Ssdi from cancer, mental health and migraines with seizures component

Im on 90% I think I can go to 100 with some other clames I have not yet clame, but not sure if 100 percent will be better with the amount of living . Everything is expensive it will be great if you can still work and get the percentage that why I think I'm ok on 90% .

Never settle friend, that 100% rating could open the door for any future compensation and issues you might experience later in life.

Hi Jose! Under certain circumstances you can both work and receive TDIU (100%). Our blog post here explains what the rules are about working and eligibility for unemployability: cck-law.com/news/protected-work-environment/

You don't want VA to ask you, 'Why did you wait so long to file your claim?' 100% means your current and future family members can be covered by CHAMPVA or go to school etc...

@LTD Davis I would prefer T&P and not work. How could 90 be better than 100?
@candaceismyname51314 жыл бұрын
Did you make the jump from 90 to 100?Everyone will tell you that it is the hardest jump to make, and we are seeing just how true it is. My partner is at 90 appealed her decision for the 90 because her back is soo bad... we just got the decision NO GO... they ended up increasing her back and decreasing knees and Hips... HOW this is even allowed make me question more than the VA... How these Physician Assistants can get away with these bogus C and p exams... same request, 2 different c and p exams for the same 3 body parts... 1st scammer took less than 15 mins... (we have photographs proving when we left the exam) Second C and P exam.. again for the same 3 body parts, this one in the appeals phase... Exam took over 2 hrs... in so much pain she asked them to stop multiple times because she need a rest from having her back and knees tortured.. She was rated at 50 upon existing the Army and is now staying at 90 until we get legal representation to appeal again.. Hasn't worked in over a year.. was a Police Officer and she has both decided and been forced (due to disability discrimination upon her physical and a medication that is not even on a list or policy that it can not be taken) IT IS A MESS!!! Why the Veterans have to fight sooo hard to be created equal and to be given rights that are no where close to what they deserve, hurts my heart... Sorry for writing soooo much, guess I had to get it out... I would love to know how you and any one else reading this, are doing with their claims... both Scheduler and TDIU!!! God Bless you all and THANK YOU for your service!!

OK I am Rated at 10% disabled by the VA for hearing loss. I had been injured while on active duty at FT BRAGG in 2005 and was discharged for; "PERSONALITY DISORDER..." NOT for the injuries I sustained to my back and legs after being pushed down the stairs of one of the old barracks. It always seems that when I have requested my Medical Records from FT BRAGG, the VA responds as totally Clueless. After a dozen years I have had to resubmit my 214 to the VA because they have continuously lost them. NOW the VA has labeled me Totally DISABLED and UNEMPLOYABLE. BUT they are stating that I am not entitled to any form of payment because they can not find anything showing service-connected- due to my missing medical records. SO what does this mean for a Disabled Veteran????!!! I am be screwed over by constant insane negligence by this government agency. WHAT are my alternative options aside from becoming one of those 22 A DAY VETS ???!!!
@mr.cleanone39004 жыл бұрын
Amtb70x7 Anunkwn personality disordered is not granted by v.a. But you might have issues that can be connected to service. Hire a lawyer if you have a case they will take you on as a client . I’m not a layer just a veteran that got tired fighting them on my own .

Need to prove, do to military service. That the veteran is effected, to be able for the VA. Am an 100% disable , per the VA. But only get SSA

I've been waiting approx 3 months for my TDIU retroactive pay from their decision granting me 100% on Dec.27th 2018.. does it really take that long for the VA to calculate it ?
@CCK_Law5 жыл бұрын
@kenndeaux317, there was approximately 62% increase in Board decisions in 2018 versus 2017, which has led to more Board grants. Unfortunately, this has contributed to a backlog of Board grants in which it is taking longer for the regional offices to implement and finalize the grants. Currently, it can be taking anywhere from 3-6 months, if not, in some cases longer.

No....but with this new AMA...VA is trying to figure out how to make it work to the VA's benefit not the veterans....if you were granted 100% they will pay you...Call the VA 800 number and ask them
