Also. If your rating sheet states that your service connected disabilities are static. It's safe to assume that it's not going to be reevaluated. And also if you are over the age of 55. Educate yourself. Know the answers before they ask them.

I have permanent and total 80% paid I U at 100% these jerks give a CP exam about every 5 years on average yet I did receive no future exams .Im 53 hope I get no more of these exams I’ve been permanent and total since 2002

Once you turn 55 years old, you get another layer of protection on your disability rating.

P&T has Zero future exams! If you have future exams you are NOT P&T but TDIU which is NOT permanent. I’m P&T without future exams. You are not P&T. You are Only Total not permanent.

how do u request your ptsd to be permanent? also for DIC benefit in the VA website only says “Total” but not permanent....can you clarify on this?

#1, it's vital you secure an attorney- you get what you at for. Secondly, they will schedule a C&P, (Compensation & Pension eval for you, with a doctor).

You don't request, this has to be done by your evaluator when you do your C&P. If they see your condition not improving they can go ahead and give it to you right away. Otherwise, you may have to wait for your follow up while on 100%, which usually takes 5 years, to give you your T&P.

Not sure I agree with your analogy at the start of the video and thankfully neither did the VA. I’m a 35 year old vet who’s 100% P&T for back problems and sleep apnea. 35 years old isn’t very young. Yes to a 60 year old maybe they think it is, but in reality 35 is middle age when you think about it and it’s definitely not young enough to recover from having back/spine problems. 25 years old YES absolutely!

I’m super confused I had a tdiu claim get approved. I only received one questionnaire in the past 3 years. My benefit letter has a sentence that says “you are considered to be totally and permanently disabled solely due to your service-connected disabilities.” Does this mean it’s permanent and total?

It get a little confusing with tdiu they can reduce it or take away tdiu u really want to wait to ur 55 to request total and permanent cause if u ask they will open up ur va rating to reviewing everything then might reduce it its one of them thing dam if u do and dam if u dont i was gonna ask my self for it but i will wait thats the 55 is the age va and social security say theres no job in the workplace call grid rule and va says at person at 55 will not get better from injuries hope that help vet

I have a permanent and Total decision at age 37 it said no future exams needed I’m 54 today I have had 3 exams since than so I never trust the VA Rating stayed the same 80% PT IU paid at 100% but being I just turned 54 I’m sure the VA has 1 more exam for me since I’ll be 55 in 350 days

I'm T&P unemployable receiving 100% last 10 years. If I was to pass, would my children receive anything? Whether they are over or under 18? Can I work from home if I wanted to? If I do, can the VA revoke my disability and stop paying? I have multiple claims that add up but my main is loss of an extremity.

If your children are under the age of 18, they may be eligible for DIC compensation when you pass. If you have a spouse, he or she would most likely be eligible for monthly DIC benefits. There are many limitations on work when you are receiving individual unemployability benefits. There are limits to the amount you may earn and the types of environments you may work in. You may, for instance, be marginally employed or employed in a protected or sheltered work environment, such as a family business. There are certain types of passive income that vets with IU are allowed as well. If you are no longer unable to work, the VA may discontinue your IU benefits. They would still have to pay you for whatever your current schedular rating is, though. Loss of extremities also qualify for special monthly compensation, so that would be a factor in your overall compensation, too.

@@woodslawyers You stated there are certain types of passive income that vets with IU are allowed as well. I disagree, all passive incomes are not work income, hence the word 'passive income'. Unless, you are referring to any passive income on the basis of employment, which is contradictory? Perhaps, you can elaborate on which passive income is not allowed??? Since, dividends, rents, capital gains are all conceived as passive types of income that vet did not have to work to obtain. it should not effect the veteran under IU? Can you be more specific???

I've been trying to get service connected since 2013. I was assulted by the front gate mps.I have triggers that resulted in inpatient treatment several times.ive tried to get the base Police report statement.however after speaking with the base,they say since it was back in 04 that all paper statements have been destroyed,I even had a witness there who recently wrote a statement for evidence.plus the entire base Heard it happing over the radio but since they can't find statements, I have been at the stage passed the video conference with judge for over a year or more .My question to anyone, what should I consider as my next plann of Action.Also it was racially driven

She did not see any combat or nothing but she suffers from PTSD. Hey Boss! I am now 100% P&T, however, I have an appeal waiting to be reviewed by a judge im like 125,000 in line! When the judge sees my appeal can they revoke my 100% ? if so can I cancel my appeal so it never has to actually see the judge? Thanks!

@@woodslawyers I submitted this appeal prior to being 100 C&P. Now I because I submitted a claim for my back and the increase got me from 90 to 100... I just wasn't sure if it was worth it to keep the appeal in :D What is being appealed is old stuff, the only one on my entire appeal for this is my paralysis, which I could potentially get back pay. I just didn't know the likely hood of them reviewing my entire claim again and potentially losing my 100.

If your 100% rating is permanent, you shouldn't lose that rating over an appeal, if the VA is following their own rules. If the back pay is important to you, it shouldn't hurt to continue your appeal. I would suggest discussing it with whoever is representing you through the appeals process before you make a decision.
