In the video in section 210(2) you have mentioned that case will proceed on police complaint. What is police complaint? Either it should be complaint or on police report. Please clarify

Sure, first of all, lets see what sub-section 2 of section 210 says : "If a report is made by the investigating police officer under section 173 and on such report cognizance of any offense is taken by the Magistrate against any person who is an accused in the complaint case, the Magistrate shall inquire into or try together the complaint case and the case arising out of the police report as if both the cases were instituted on a police report"

Section 210 (2) Cr.P.C says that if a report (Charge sheet) is filed by police officer and the same is taken cognizance of by a Magistrate against a person who is also an accused person in the complaint case, the Magistrate shall inquire into or try together the complaint case and the case arising out of the police report as if both the cases were instituted on a police report. In the decision reported in Kadiresan v. Kasim (1987 L.W Crl. 64), it has been observed that when using a loose language that two cases are clubbed, it means that they are being tried together, but that cannot make any one of those cases to lose its identity. It is added that there should be no confusion between joint trial and complete amalgamation of cases. Reference is also made hereto the earlier Supreme Court Judgment reported in Harjinder Singh v. State of Punjab (1985 S.C.C (Crl.) 93) and it is stated that in a case of joint trial, the cases should not be consolidated and that the evidence should be recorded separately in each case one after the other, except to the extent that the witness for the prosecution who was common to both the cases be examined in one case and his evidence be availed of in the other . This principle has been reiterated by the Supreme Court in another judgment reported in Manikandan v. Pandian (1990 S.C.C (Crl.) 203).
