Agree, Prior's questioning seemed to have intention of portraying him as careless. Suggesting about lack of credit check (while it's reasonable to not do it from start if the current owner comes with potential buyer), same with the acres. Prior took a gamble on that Arnold would not remember the size of it. He wanted the witness look fuzzy even if it was about details of less relevance for the case. So it was more of a snarky reply for the witness realise what Prior's purpose with it. The attorney on the show appear tone deaf if he really believe it was done as a comic skit.

This is the second time I heard a lawyer commentary criticizing this witness for “clapping back” or in this case, “trying to be a comedian.” I find it interesting that lawyers have a totally different perspective than laypeople on this situation. It seems lawyers want to blame the witness for messing up the case potentially forcing a mistrial like the witness almost has an agenda to deliberately do so or is showboating for that publicity or something. To me, Prior pissed the guy off by trying to make him look incompetent in his job as a realtor. And I honestly don’t even know why he did that. With the coroner, at least I understood the strategy. With this guy, his competence as a realtor was irrelevant to his testimony. But Prior kept trying to trip him up for some unclear reason … implying he had a duty to credit check every potential buyer and THEN that he should know the exact acreage of every property (even those he doesn’t have officially listed) off the top of his head. As I see it, from this witness’ POV, Prior is firing off a series of “gotcha” questions to make him look bad and potentially threaten his own livelihood in his community so when the guy quizzes him on property he owns himself … it was a natural reaction to “clap back” at that point. As I see it, the situation was all Prior’s fault not the witness’ fault.

John Prior OPENED the door for the State’s redirect question regarding what the realtor thought the purpose might have been for Chad’s desire to place a manufactured home on his land. Prior ASKED the realtor to speculate about that, SUGGESTING a possible reason. That opened the door for the State’s question. WIDE open. The judge’s comment before the redirect essentially overruled objections to the state asking that question. The State’s redirect was WAY less leading than Prior’s and parlayed MUCH less speculation.

I think Prior took over the land in leu of payment. Chad couldn’t afford to pay him anymore, Prior then tried to get off representing him but the judge denied that, so guess the only way he was going to get payment was getting the property
