Great video. Thank you. My 27 year old is living in Ohio. Their exemption is $4000 and they have a wild exemption worth $1325 (I think). So my question is she wants to keep her cat but is worried there is some equity they can get. It’s a 2018. Can you start the process and if they want to sell her car can she stop the process?? She has no other valued assets. None. She a college student going to school on grants. She needs her car.

We own both of our vehicles and they are worth more than the California exemption amount. Would it be better for us to trade them in and get a new vehicle that we’ll be paying on monthly, before we file? Therefore keeping the vehicle we now have a loan on?

You can trade them in and get new vehicles, but you would need to make sure that with that trade-in you don’t have too much equity- more equity than what the exemptions allow in your state.

Great work you are doing attorney! If you can evade repossession long enough will an auto lender like Toyota finance file a Replvin to get the vehicle back or will they just keep trying to repossess it until they get it? your comment is appreciated

I have seen it done both ways. If they aren't able to repossess they will take you to court to get the vehicle back.

In a bankruptcy a lease is called an “executory contract”. As long as you keep making the lease payment you can keep it.

In most situations they will use Kelly Blue Book. Some use NADA, but here in Arizona it is mostly KBB.

I filed in Illinois two years ago, the creditor didn't reaffirm or seize the vehicle. It was discharged and they wrote it off as paid in full on my report. And when I called to make payments they wouldn't take my call. I wanted to get my title, so I'm trying to pay them off. What are my options?

I would keep calling them. Once the vehicle is paid they have to give you the title. Get an attorney if they don't respond to your requests.

I generally tell clients that once the decision to file bankruptcy is made that you should stop paying on the credit cards. Once your bankruptcy case is filed with the courts the credit card companies won't be able to accept payments so you will not need to pay them.
