Exactly. Each side trying to get evidence entered and get evidence suppressed. Deal offers going back and forth. I know a lawyer delayed a murder case with continuances for so long, the witnesses died from murders themselves in unrelated situations.

They are within the rules of the 6th amendment and the speedy trial act of 1974, prosecutors aren't dumb enough to step outside the bounds of the law and automatically lose their case against him. Rest assured this is all by the book and above board

Tell me you ain't ever been facing a charge without telling me you ain't never faced a charge LOL 2 to 5 years is absolutely normal on a murder charge unless you're straight up guilty and just want it done with.. then you can get a speedy trial and be found guilty... If you actually fighting it.. it's going to take two three four five years... To get your trial with diligence... You face in a murder charge and you go for a speedy trial you are getting found guilty 100% of the time because they only booked you because they have some evidence... They waiting 3 years because the defense is trying to come up with something to help the client

The defense usually waives right to a speedy trial as a strategy for more evidence to come to light when the initial discovery clearly shows the defense as guilty. Right now he’s in pc and getting special treatment for which he’ll get credit for. Best to leave him in that scenario as long as possible before sentencing and he gets transferred to gen pop

If you don't understand the 6th amendment it's better to not speak at all on it tbh. Indictment must be within 30 days of arrest and a trial must begin within 70 days. There is no requirement to have a fast trial past that point whatsoever! Reference the speedy trial act of 1974. A trial must not begin before 30 days have elapsed unless the defendant waives this.. Delays from pretrial motions do not count against the time, you gotta read up

Because the state pays the county jail ie the sheriff per prisoner like 20 dollars a day for their food. The catch is the feed you about 2 dollars worth of food and the sheriff gets to keep the rest. So they want you in the county jail and those sheriffs be making 250k to 500k a year while the jail is failing apart and very inhumane for anyone to be in

Depends on the state... where I live it's a 2 year max in the county jail on trial so they have to get it going quick but other states have 5 years and some have no limit... you have to request a quick and speedy trial which is 6 months but nobody fighting a serious case would want to do that... the longer it goes the better chance of lost evidence or witnesses not cooperating or simply forgetting details and giving testimony that doesn't line up with the original report

In the Feds it’s even worse because you won’t have bail and you sit for at least 2-3 years waiting to plea and you’re only charged with a gun or drugs

The defense is why they take so long and they don’t want a speedy trial as guaranteed by their clients civil rights. Because, a quick trial is a conviction most of the time.

You rush to go to trial and you could very easily wish you hadn't. When you're sitting in a cell thinking about the next 50 years you are willing to take the time to make the best case you can.

My homie caught a trafficking across state lines with intent to distribute on a wide scale, that was in 2010, dude didn’t actually start trial till line 2016 and they sentenced him in 2018. He got 20 years for 3 seperate charges concurrently with time served prior. I ain’t in touch with him no more but run into his people every now and than and that’s how I got updated. Shits crazy how you can ruin your life

Or they have the option to file for a speedy trial that could be a 50/50 and many are not willing to risk getting a guilty verdict so they’re most likely to stay in county jail for a very long time, I’ve seen guys sitting in jail county up to 10 years the problem is that murder charges don’t have status of limitation.

If you get a mistrial after 5+ years of sitting in jail then you should be owed the means to bond out if the DA wants to press it and retry the whole thing again.

The jail system has to make their money off you before your trial, then they convict you and send you to prison so the prison can make their money off you. The jail and prison are businesses.

Facts my uncle was in jail for 3 years. Before his case even went to trial. Beat the case but still gave them people. 3 years for free.You should be credited for those years. If you ever get trouble again

His retrial reportedly has been set for September 2025, by then he would have been in jail a few months shy of 6 years. This is crazy I was in grade 8 when he got arrested and I just graduated high school in 2023

Facts. My cousin got locked up on drug and gun charges and was in the county over 5 years fighting it. He got 7 years and only had to do 2 up state since he got credit for the 5 in the county.

I graduated in 99, My homie was 17 when They kept him his whole H.S. Sr. Year. He didnt even take 1 step on campus. It was so crazy I graduated, went to college last saw him on fall break in 99.. then they gave him 20yrs for sexual assault & AM.. I was shocked ... he spent 1.5yrs in the county jail. His mom put up her house and lost it.. we dont talk anymore.. dont throw your life away folks

It took 2 years for me to get a direct order of acquittal for a murder where the DA put on 3 witnesses when one said he never saw the murder, the second said he knows the shooter and me and it wasn't me. The third said I was the shooter yet said he saw me and tried to point me out to the cops when I had been incarcerated at the time.

The defendant and the people are entitled to a speedy trial and to a speedy resolution of all matters before the court. Whenever the defendant's constitutional right to a speedy trial is violated, the defendant is entitled to dismissal of the charge with prejudice.
