The defense will likely request a retrial anyway, since the jury is tinted by Dr. Tobin’s false claims. Dr. Tobin’s testimony is the cornerstone of the state’s case. Other prosecutor’s witnesses promoted the pulmonologist’s flawed theoretical opinion, including medical examiner Dr. Andrew Baker and the forensic pathologist Dr. Lindsey Thomas. The prosecutor team, being under the media pressure (in its thirst for a race war), did not scrutinize Dr. Tobin’s flawed “theoretical” analysis. Essentially, the prosecution failed to understand that certain evidences can't be extracted from a video. Watch the two videos on my channel (Video 1) Simple Experiment to show the flaws in Dr. Tobin’s assumptions (any one can reproduce at home). You can place your left knee on a weight scale and verify it for yourself. Slide your knee left and right while on the scale, do you get a consistent reading from the scale? Place dumbbell on the scale do you get consistent readings? A human is different from a dumbbell. Dr. Tobin’s dumbbell model doe not apply to human. (2) kzbin.info/www/bejne/pJesap-vbNmBia8. Then he used his invalid estimates of the magnitude and the direction of the force to prove positional asphyxia. He totally ignored the direction of force (which you can not estimate from a video either). Then he assumed that the location of the force to be precisely on the bullseye (the tiny hypopharynx which is at the front of the neck and unreachable from the back of the neck as acknowledged by Dr. Tobin). Dr. Tobin claims are theoretical and do NOT match actual data. His theoretical analysis is based solely on data that can’t be measured from a video. He did not present any physical measurements or physical evidences of damage to the tissues. Neither the prosecutor team nor the media experts scrutinized Dr. Tobin's analysis or assumptions. May be they should.

In a situation like this the jury is meant to be ghosted, and the trial not recorded. Example A: OJ Simpson's case.

That is not what he meant ! If you watched the whole video you will see he said because of the Rep Maxine’s rhetoric if it turned out to be a guilty verdict, it could be over turned during appeals based Maxine’s inflammatory statements! What the judge said at this point before verdict, he has not reason to believe it had influenced the jury which is true.

The key word is “at this point”, yes there is cause of concern for Maxine’s statement to influence the jury, but the result hasn’t out yet, so you can’t draw the link yet. But once the guilty result is out , then the link can be made during the appeal.

He didn’t handle the witness too well but when a trial is being scrutinized by the entire world you have to lay down the law and make sure everyone is following the rules of the court and that witness wasn’t. The same tactics that the defense used against that witness were used by the prosecutors to get the expert witnesses to contradict their initial claims. All in all, this judge handled things very well for how difficult and important this case was.

When the bank *robbers get caught* the driver of the *getaway* car *goes down too* for Bank *ROBBERY.* Even when the driver *did not* get outside the car, *go inside* the bank, *and steal* anything. But the driver *only drove the other robbers* to the bank; where those others got out the car, went inside the bank, stole whatever, then left the bank and got back into the car, and the driver *drove them and the stolen goods away.* And the *driver did not even receive a share* from whatever was stolen at the bank. Maybe the getaway *driver's part* in the bank robbery *was trivial;* but the driver goes down for Bank *robbery anyway.* The *same* goes for the *Police who helped* Chauvin hold down Floyd during their *murder of him.* Because people do not want the *same Police* who helped Chauvin *rob Floyd of his life;* to go on and help other *Police do LIFE ROBBERY too.* What you should be wishing for is that *they* sent in *(PLANTED)* the right jurors to *drive the GETAWAY COURT* and say Chauvin is *not guilty.* With the *right jurors,* there will be no: *'Police who helped* Chauvin murder Floyd, *go to trial next.'* WHEN the *cause of lack of oxygen* to Floyd by Chauvin is found to have played *any part in the death of Floyd.* Then the Police Officer is guilty. The Police Officer's actions *did not have to be 100% of the cause* of Floyd's death.

It’s a brilliant motion by the defense, but really not a big deal and blown out of proportion. The jurors all know that their decision could cause protests either way. Jury selection spent a lot of time explaining that to them and asking them about it. This is nice ploy by the defense. But the verdict will not be overturned for these comments.

You are correct but since he did not get a fair trial thanks to the media, Maxine and Joe he will win the appeal process and walk free. The jury found him guilty to settle the mob down. He will be free in less than a year as he should be.

If a juror violates that rule and watches the news he/she would have tainted the jury pool AND it would validate the defenses request to sequester the jury. Both are grounds for mistrial.

They were not sequestered, which doesn't guarantee that the jurors may not have seen news snip-its since this trial is literally the main story on almost every single news station. Not only that, but I heard a good point from someone the other day when I was discussing this; some tv shows that have nothing to do with the news could even be discussing the trial itself. Not to mention that discussions of the trial occur on social media and even just socializing with other people in general. This is why the comments of Waters' could be a grounds for mistrial: the jury was not sequestered, therefore the defense could say that there was the possibility that one or more of the jurors were intentionally or unintentionally exposed to news from the trial. The judge should have sequestered the jury from the beginning because of how well-known and controversial this trial is/was going to be to prevent issues like this from impacting the verdict.

I suppose I had faith in the jurors to follow the judge's orders of not watching the news, & maybe even putting their phones away, but I can see how they might unexpectedly see a quick flash of something regarding the case. I mean, that can happen with any case, though. We'll see what happens.

@@MrTenorman92 there were protests happening in communities the jurors live in, they didn't have to watch the news all they had to do was go outside. A simple conversation with family members could have done it. They were instructed not to discuss THIS case but that doesn't mean other issues didn't influence them. Especially fear of retaliation. If a juror slips up even years from now and mentions anything at all, it could grant a new trial.

Its no longer in the hands of the judge. If the court is doing their job the jurors dont hear this crap. The judge is out of line for his comments. Its clear that the judge expects a guilty decision and want to help the defense overturn it. Violence is likely to happen regardless of the congresswomen's comments. its not grounds for retrial.

The fact of the whole matter was it was over a fake 20 dollar bill. My question is why did it escalate so far? I will say that it was not neccessary for the police to respond with a drawn weapon for the suspect with this type of response. A drawn weapon was not necessary at the beginning at all! This was wrong. The police. No let me initerate the people who held a gun to him oved a counterfeit bill was not in any way necessary. He was not wielding a gun or posed any threat to the police. He was murdered over a 20 dollar counterfeit bill. His only threat was being a black man and nothing more. He was murdered.
