This is a known psychological phenomenon. NASA and the aviation community have spent millions trying to find a solution, as have the medical community. When we try to react under stress our brains sometimes perform a similar but different action than what you intended. Hitting the gas instead of the brake for example. The likelihood of this is higher if one of the actions has been practiced or performed more than another. Tasers are far more expensive to practice with than firearms, which means few departments have the budget to train with them regularly. This does not excuse the officer, and he should be charged with negligent wounding. However unless there is additional evidence, attempted murder doesn’t fit what is shown in the video. Negligence and incompetence due to poor department training is simply more likely than malice from an individual who knows his every action and word is being recorded by multiple cameras.

I do think he really didn't mean to shoot the kid, but he should definitely have a felony on his record and never be allowed to own a gun or be a cop again. How about not breaking the law and fighting with them did you ever think that might be the way to stay our having trouble with law-enforcement? Or is that just way way too hard for you to even comprehend? It’s really simple for regular people don’t fight with cops is the easiest and simplest way to avoid problems, or don’t commit crimes those are two pretty easy things for non-criminal lowlife scum bags to do. But if you’re going to break laws and fight with police I’m not sure where trust comes in to play but play stupid games win stupid prizes you’re fighting with someone that has a gun you can trust that you are increasing your chances of getting shot by 1000%. Just like trying to rob a person that has a gun you’re increasing your chances of getting shot 1000%. But if you don’t rob a person that has a gun then I guess you can trust them not to shoot you, and if you don’t fight with the cops I guess you can trust them not to shoot you. There’s your lesson for today I hope it helps build your trust.

@@jackrack1441 You pointed out the reality that a lot of people don't understand. Police are always hostile, and they have an "obey me or else" mindset. That's why so many of them commit domestic violence. It becomes their personality so it explains why they beat their wife around the kitchen when she says she's too tired to make dinner. This is also why a lot of officers take it personal when someone they are interacting with refuses to ID themselves if the officer has no legal reason to ask for ID. A LOT of people are assaulted/cuffed and arrested on bogus charges of "obstruction" and "resisting arrest" because they don't hand over their ID like good little subjects. When you don't say "yes master here is my ID even though I committed no crime and you have no reason to suspect me of one" they get angry and retaliate with violence because they knew they will face zero consequences because departments will investigate themselves and determine they did nothing wrong, and the general public will support the officer who did it because they are completely oblivious to the Fourth Amendment and the fact that we DO NOT need to identify ourselves to police just because they ask.

The entire situation is insane. You don’t “mistake” your firearm for your taser. From what the news report stated, the Sgt had at least 10 years of service. Law enforcement train repetition to obtain muscle memory for basic functions, drawing your weapon is one of those. Officers need to know how to defeat any safety features a holster may have to draw the firearm. They then need to be able to holster their firearm, possibly without looking, depending on the situation. The difference is night and day between taser and firearm weight. An empty firearm is still heavier than a taser. Either this departments training is dog water or the Sgt is incompetent. There’s no such thing as an “accidental discharge”, it’s called negligence. Complacency kills.

This isn’t the first time where officers have mistakenly used a firearm instead of a Tazer. Most department require the Tazer to be on the opposite side of the firearm. And use one’s other hand. All this because of muscle memory in high stress reactions. And you have to practice it regularly. Even if it’s just touching. Weak hand Tazor. Dominant hand Pistol. Mentally and physically state it. Over and over. Review before you start your shift. Also against same color Tazers as the firearm. Those damn this should talk. Tazer Tazer Tazer. Maybe have an attachment to the firearm alerting lethal force.

This is a departmental issue for the lack of proper policies and training with now follow-up.
