I think for Judge Judy this is more of a moral thing than legal. The fact that the child was severely hurt but not killed, the plaintiff should just cut your loses and be glad nothing worse happened.

Eh… the mirror is on the side of the car, not the front… I think the kid was at fault and her parent is at fault bc she should have taught her kid to stop and look both ways before crossing. Lol. I think the kid was not paying attention and just ready to run around and play and go home.

I agree. I think JJ is looking at this case from a moral perspective rather than legal. Legally the defendant should be held liable for the damage. But morally the plaintiff should never have filed such a case.

Thats like me crossing the street in some random location with my bike, hitting the side of a slow passing car, and then telling them - "hey, my bike was destroyed and I broke my arm...so...were even, right?" With the crossing guards testimony, im having a hard time finding the driver really at fault here. Im not exactly sure what JJ thinks she should have done except just not drive her car at all. Based on the testimony, this all happened in like 2seconds.

​@@iykeharrison9161 You know as well as I do had there not been witnesses saying the child was at fault, the driver would have been blamed and held liable for EVERYTHING to do with her injury. It wouldn't even be a question. Why is that morally expected and acceptable, but not asking for compensation for her own damages caused by the child?

​@@iykeharrison9161 Legally a person driving require due diligence to their surroundings including if people are crossing the street. The kids did not intend to hit the vehicle, thus the plaintiff is liable for all the damages that happened next.

I have no doubt the little girl running out into the street causing the accident, those kinds of things happen in a flash, sometimes with a much worse outcome. But lady, how can you want her to pay for your mirror? Come on, be thankful she was only injured and not killed.

And the injury was caused by the plaintiff when she was in a hurry to leave the school into the street. She was not going slow, for how would the child break the mirror and child got injured going 2 miles an hour. Plaintiff is lying.

Sorry, I’m with the plaintiff here. I wouldn’t sue for something cheap enough to fix, but we don’t no the plaintiffs situation. She may not be able to fix it herself. It isn’t her fault if the girl actually hit the side of her car, so she shouldn’t be obligated to pay. Accidents happen and when children are involved, the parents are responsible for damages.🤷🏼‍♀️

My neighbor hit a kid in our neighborhood and followed him as he limped home screaming that he owed her the deductible for the car. And was sobbing about the dent in her car.

You are SO right. I broke my clavicle when I was six (jumping on the bed. MY BAD!! Maybe my parents should've sued the bed manufacturer! LOL! 😂). Anyway, a clavicle fracture is excruciatingly painful... ESPECIALLY for a child!

I am impressed with Emmy's mother for staying calm through this. I was getting frustrated and cannot imagine how upset she must have felt. Good on her for keeping her composure for her daughter and not escalating the situation even more.

I can see how this scenario unfolded. I can see how the child was running fast enough to break the mirror. However, I would be so thankful that the child was okay (whether she made a bad decision to cross where she shouldn't have or not) that I would repair my own mirror and certainly wouldn't bring this to court. It's a miserable decision to sue the parent.

50 50, i would guess. A girl that young and small canNOT physically run fast and hard enough into a car's mirror to break her collarbone. Her nose, maybe but that's all. The plaintiff had to be moving faster than she said and the mirror clobbered the girl. ps Parents are financially responsible only for their kids' malicious acts...if it's an accident or negigence, they're not. If the plaintiff wishes, she can wait til the statute of limitations is almost run then sue the CHILD....a judgement is good for 10 yrs....but she'd still probably lose. cheers!

The girl ran direct into the side of the mirror hard enough to snap it off and break her clavicle? No. The girl ran out and the forward-moving car mirror hit her, which is what caused the damage. That seems pretty clear to me.

It is very possible. A similar situation happened regarding my nephew who was walking through the addition that was being built on to the garage and he was looking at what was happening several feet away and walked right into scaffolding. The impact cracked his clavicle.

I have that same opinion. I believe the plaintiff, but just can't believe how heartless she is. Like she doesn't care about anything other than a stupid mirror you could replace at a junkyard!! Meanwhile, that little girl is irreplaceable!!

@@moonscar119 Except she didn't, the guard said he was in front of the car 30 ft. away, and he saw the child. The lady said she was 15 ft. away and the child aimed directly for her side mirror which would be directly at her. The driver was not paying attention.

I had a child ride his bike right in front of me and I hit him. NEVER did I EVER think about my car. I just prayed he was going to be ok. I never went after the parents for the damages of my car . How ridiculous!!

Whereas its costs $20-$350 to replace/fix a side mirror. Lady looks like she owns a house and does fine. Shouldve made sure the girl was okay, and ignore the mirror first. Not that expensive lol

Plus she probably made sure the kid was all right, after all she bothered to learn the kid's name. She just got pissed when the kid's parents refused to pay. I'd understand that. It's not about teaching the kid a lesson but the parents a lesson: be better parents!

Her kid broke the mirror, she's liable. Any other case with similar litigants and details and it wouldn't have been a browbeating party, the mother would have been shamed for using her child like a prop.

If i'd injured a child, even if it wasn't my fault, I'd have an absolute come-apart. I couldn't imagine suing after learning that the child was ultimately going to be okay; I'd just be too glad that we could all move on.

yeah, she HAD to be moving faster than 2 MPH....otherwise the CHILD would have seen the car and stopped. I don't think newer cars today can go that slowly....if you put the car in drive and take your feet off all the pedals, you're moving faster than 2 MPH (our car was at least 5 mph, and that was uphill. ) The woman would hane had to have been riding the brake pedal...in which case, why didn't SHE stop? You don't run over a child just because you have the right of way! And the crossing guard was 30 ft away and could see what was about to happen. All the best to you and yours!

​@@christinaf713irrelevant. It doesn't take much. I also never broke a bone as an energetic kid, but did manage to fracture one by merely breaking my fall. Never heard of anyone else doing that, but that doesn't mean it's implausible. Clavicles are small and kids can run fast.

Funnily enough, when I was younger, I saw a fellow elementary school student run into A PARKED CAR and he broke his elbow and wrist. He wasn't looking and ran straight into the car when crossing the busy school parking lot. I remember the child's parents paying to have the dent in the car door pulled out,because the car belonged to a neighbor. Kids get hurt when they run out without looking, it happens. I'm sure, yes, the little girl did run into the car but the point Judge Judy was trying to make was that even if the girl did run into the car, you should be going slow enough that she wouldn't be severely hurt! You're in a school zone! Her own body running into a car would NOT cause any broken bones unless you were driving too quickly and made the injury worse. What a cruel woman

​... So you think the mother of the two boys should of reversed without looking to avoid the girl running? You know how fast kids are? Also, how long will it take to reverse into someone else's car or kid? Either way the girl would have hit the car. All the mother of two could do is see it happen. Unless you want two colliding forces, the car door opening to stop the girl and the girl running. The girl ran fast enough to break her clavicle. Also, more than one kid. There are other children to watch out for. People are focused on everything. A child running fast at the side of the car is too fast for anyone to react to.

I was stopped at a stop light and somebody jogging ran smack into my side mirror, broke it, got hurt…. I was not charged and a court ordered jogger to pay for my side mirror. I was not ordered to pay for his injuries.

Exactly!! That's why all the speed limits in neighbourhoods in Ont Canada have been dropped 10 kms per hr (about 6 mph) More kids have fewer injuries....ppl have time to stop. All the best to you and yours!!

Idc what everyone else says. There have been many cases where ppl lose control of their dog or don’t have it on a leash and a car hits it and in turn the car is damaged. Dogs have died etc but the person has a right to SUE the owner for their dog dancing their car. She has every right to sue for damages to her car when someone’s child runs at it, just like if she had been riding a bike and she scraped the woman’s car. Idc why everyone feels she shouldn’t be suing 🤨🤷🏽‍♀️ this woman actually brought a WHOLE witness a whole crossing guard, when JJ always asks “where’s your witness” and yet she is finding it as if it is the Plaintiffs fault.

I don't think JJ genuinely believes it's the plaintiff fault. I think that she is just outraged that she sued. Had it been a dog off its leash, even a dead dog, her gavel would have gone down. You break your clavicle from skiing at 30 mph or falling down the stairs. A little girl isn't going to break her own clavicle with just her body mass by running. This was the plaintiff hitting the girl with her car and then blaming the little gir. She should get her license revoked and go to jail.

This is one of those rare times that judge Judy is wrong. Breaking a clavicle only requires 10lbs of pressure. It’s one of the easiest bones to break. The kid ran into the side of the vehicle. What was the driver supposed to do? See the future? Just because the victim is a kid doesn’t mean the driver is unreasonable. Think if it was a 50 year old dude jumping out into the road and hitting into the side of your car. You would be pissed.

Without the crossing guard testimony, I was heavily leaning towards the Defendant. But with what he said - it seems clear that this little girl was not paying attention, crossed in an area she was not supposed to, and basically ran full speed into this womans car. Based on how this case is going, im assuming JJ will find the Plaintiff at fault, but this seems very debatable. I think ruling in the Defendants favor also sets a bad president that kids are fine to run across busy streets whenever they want. By age 9, this girl should know how to cross a street safely.

I've never known for judge Judy to be so wrong about a case. She literally subverted every fact, including an eye witness that substantiated that the child literally ran into the side of her car, which would have caused the injury even if the car was parked.

I was thinking the exact same thing. I mean, I even almost feel heartless after reading all the comments siding with the kid. Don't take me wrong. That she got injured is really bad and I am truthfully glad she recovered from it. But with all due respect, the fact is and remains that she broke someone else's property and I also think the defendant should have taken responsibility and paid for the costs. I mean, if the kid didn't got injured I am certain everyone would agree that the plaintiff is in her right. But now a cute kid got hurt and everyone is all like "HoW DaRe YoU SuE HeR!!".

the eye witness was double the distance of the car from the child, and could see what was about to happen when the girl stepped off the curb. If the woman in the car really was going 2 MPH she had plenty of time to stop before hitting the kid. You don't run down a little girl just because you have the right of way! Also, i think they tape the segments and then shorten them to fit the time. Parents are only financially responsible for a child's malicious acts.....not carelessness or negligence....everywhere in the US and canada. If the girl had picked up a rock and smashed the mirror off the car, mom would have been liable. As it was, it was a child being careless.....the Plaintiff would have lost the case anyways. Cheers!

Even if the driver was fully stopped, the kid still ran into the side of her car (which she would have), whose fault would it be? If you were in a parking lot going straight, and car who wasn't looking ran into the side of your car, who's fault would it be??? You're telling me you would get out and say, "Sorry, this my fault you that weren't looking and ran into me" ???

The Car wasn’t stationary. The plaintiff said she was driving very slowly. I would argue that the girl didn’t run into the car, she ran out into the street. Thankfully the cross guard was paying attention and when he yelled STOP! (Like the plaintiff had testified) the girl hesitated giving her enough time to avoid being hit by the plaintiffs front bumper but not enough time to avoid being hit by the side view mirror. The plaintiff hit the girl with her side view mirror breaking her clavicle.

What if she is a single mother, taking care of twins, living paycheck to paycheck, can only afford liability insurance. Do you not have empathy for her two boys? What so they just shouldn’t eat for a few weeks so the mom can fork over $600 for a mirror someone elses child broke? A deer hit my coworkers car. It smacked right into the side of her door. And yes, there were deer crossing signs everywhere. Her insurance paid for it, because she didn't hit the deer, it hit her. The childs mother is liable for her childs misguided judgment. Nobody cares that she hurt herself doing something tht she shouldn't have been doing. What you're saying to that child is your actions have no consequences.

Do you think this woman's insurance refused to cover it or was the woman not willing to pay her deductible? A deer crossing is quite different than a school parking lot. The purpose of the deer crossing is not to protect the deer, it's to keep the driver aware because at 60 mph it could result in the death of the driver. In a school parking lot, it's to prevent a child from dying. When I'm at the grocery store, I go crazy slowly because I know that there are potential children that may pop out of nowhere. Schools are the same way. Children don't always have the ability to understand why a situation is dangerous, so it's up to the adults to protect them.

I think a lot of people are missing the point here. The kid was not at a crosswalk she was essentially J-Walking… if the accident was her fault and the plaintiff wants her mom to pay for the broken mirror that’s her right! All of this could’ve been avoided had the child cross when it was her turn… thankfully, she didn’t lose her life

I agree in spirit, and the girl, I am sure, was the primary cause of this entire incident. However, here is the BIG one: Even if a pedestrian were jaywalking, that does not indemnify the driver for personal injury because the “due care and attention” clause applies even OUTSIDE of the crosswalk! So, even if the girl were the precipitator of the entire incident, the driver is likely to be held liable for injuries at least to a degree and, given that backdrop, suing the injured party for a broke mirror on a beat up minivan would not make the plaintiff look very good.

Falling and sticking your arm out to stop yourself falling is enough to break your clavicle and is usually the way kids break them. It wouldn't have mattered if the car had been stopped and she ran into it, then bounced back and put her arm out as she fell, she still would have broken it, and likely the car mirror.

Most times, I agree with JJ. However, this time I don't. I broke my clavicle as a child. I was running and not paying attention and ran into a fence. I fell backwards on the ground, not realizing that my clavicle was broken. My grandmother noticed that I was not moving, picked me up and my shoulders shifted. It is possible that the child ran into a car that was not moving, or moving very slow and broke her clavicle.

I really don't believe she was going slow. No way she caused all that damage going just 2mph i doubt it unless that little girl is capable of running at 10mph or something..

Those schools are bumper to bumper when picking up a child. I'm pretty the kid ran out into the vehicle.

@@monicavillarreal3902 - I think what happened was Emy ran into the front quarter panel where the front tire is and because the defendant was going much faster than 2mph the mirror wacked her in the face hence the stitches breaking the mirror and then knocking her to the ground but that would still mean she should have seen her..

nah, i'm with Janice, the next comment. Kids just get so excited when they're let out of school that they don't think....they just run into the road. That's why all the speed limits in neighbourhoods in ONtario have been dropped 10 kms (about 6 mph) More kids live longer.

Lol wow shit happens. Like they teach you in drivers ed… if you see a ball come onto the road, always expect a child behind it. Kids don’t have the forethought like adults do.

@@kittyfan So what? she was being a brat and her mom was being a cheap ass trying to sue for the injuries that were dismissed because she did the wrong thing. The girl is 100% at fault for her own injuries and Plaintiff should've been compensated.

Just because the person that got the worst of the impact was the little girl doesn't mean the other party isn't entitled to have their damages paid for. By the way, children break their clavicles all the time, especially in contact sports like tackle football and soccer. A child running full speed into the side of a car can definitely cause that injury, even if the car was not moving.
