The O'Driscolls were unjustly killed. Dutch didn't personally witness them committing any major crimes (murder, torture, etc.) nor was he acting on any bounties. In those situations, the legal thing to do would be to report the O'Driscolls to law enforcement so that they may get a fair trial.

That's debatable. Yes, Dutch may have gone slightly beyond what's considered acceptable for self-defense. However, the old woman brandished a deadly weapon and was intent on killing Dutch at that moment. A decent enough lawyer could convince a jury that Dutch did what was necessary.
