If anyone is interested to know the fate of the case: The Hon'ble single judge allowed the writ petition in the video partly that is the petitioner was reinstated to her previous posting as Civil Judge but did not allow any back wages to be paid. Against the judgement of the Hon'ble Judge in the video, both the petitioner and the state of Chattisgarh filed appeals (WA/362/24 and WA/363/24) before Hon'ble division bench and by order dated 20/9/24, Hon'ble division bench upheld the judgement passed by Hon'ble single judge and dismissed the appeal of the state in it entirety and the also dismissed the appeal of petitioner in respect of back wages.

Law is well settled long back in the case of Parushottam Lal Dhingra vs UOI decided in 1957-1958, by the Constitution Bench of Supreme Court, holding that if the termination is stigmatic or penal, then protection under Article 311(2) is available even if the employee is probationar or temporary because Article 311(2) doesn't differentiate between the regular and probationar employees.

The language of argument in High Courts is English. Only Bihar, UP and MP courts are exempt. In the TN High Court, you can argue in Tamil. Rest of the High Courts, you need to argue in English or with a Translator.

@@rupammedhi9943 it's for the parliament to decide. the high courts I mentioned were given special privileges because majority of the population living in those states speak the same language. same exemption was not given to states like Jharkhand or Chattisgarh where even though the majority speaks Hindi, they still have a lot of different languages. arguments in the courts in so many languages will make things even slower than it currently is. but in the end, it's the parliament's discretion.

Sir 'Yeah' is not a formal English word. 'Yes' is a formal word. An advocate is supposed to speak in formal language in the Court and should avoid informal language and slangs such as yeah, gotcha, gonna, etc. As far as speaking in English, he is a judge of a High Court, and the official language of High Courts and Supreme Court is English, not Hindi or any other regional language.

Globally, in courts where English is used, Yes should be used. Yeah is not an official English word - it got propagated by movies/serials and cheap novels
