Wow this is so educational po atty. Thank you so much for your generous and unselfish share of these knowledge via YT platform. I am going through a court order of demolition case as of now with the decision that’s been made back year 2020 po. Is it too late already or still contestable for post judgment ? About overlapse po ng bahay na tinayo ng biyenan ko po na claim ng kapitbahay namin as complainant. To make the long story short po, wala naman po sya land title kasi I believe na ung land property po namin is public property or in other words ancestral po sya. Merun na po Kami waiver rights. Kaso po sabi Nya nauna daw sya mag apply ng application sa DENR CENRO Kaya feeling po sya May authority with her attorney sa Amin at pinag babayad Kami 300K or else demolition will happen sa bahay ng mga anak ko sa Baguio.

Thank you Prof. I found this refining my knowledge on post judgement remedies. Now, I made my own lecture notes, as if I going to take the bar. Prof, can I ask a question in civil pro, but not necessarily an after remedies judgement? Please help me. I am a victim of scam on credit card. I am going to file a case against the bank to enjoin the bank from forcing me to pay a billing in the credit card which I did not transact with. It is insider-facilitated transaction done by employees of the credit card company. I already reported this so many times, but the bank continues billing me with such big amount. I want it enjoined to prevent the bank from further collecting now the agent is harassing me with threats. I want to sue the bank with damages. Now, I am confused if I can join Injuction with damages, and if so, is it a complaint or a petition? Thank you prof.

Hello. Since nakapag file siya ng annulment case, that means may lawyer ang defendant. Therefore I cannot give any advice kasi bawal sa amin yun na mag advice kung may lawyer na. That is under our Code of Professional Responsibility and Accountability. Dapat magtanong siya sa lawyer nya.

Good day po. Mam, kung ma deny po ang annulment of judgment at gusto mo I elevate to higher court ang order/resolution, what is the mode of elevating, it is petition for review still or notice of appeal? Thank you for the clarification. God bless.

Hi. Remember, the case is filed with the CA as an original action if the decision being questioned is that of the RTC. The only way to elevate this to the SC is through a petition for review on certiorari or an appeal by certiorari on pure questions of law. If the Rule 47 action to annul refers to the decision of the MTC, the action to annul is filed with the RTC, and since it is the RTC resolution(denying the action to annul) that is to be questioned, you can elevate it to the CA through a notice of appeal (since the action to annul is an original action).

Prof Chato, in your note, it says reglementary period for Certiorari under Rule 65 is within 30 days. Is it not 60?

Hello. It is 60 days under Rule 65. However if the petition for certiorari is filed as a post judgement remedy for decisions or final orders of the COMELEC or COA under Rule 64 in relation to Rule 65, it is 30 days. Tapos po nag file p din ng petion for review s CA.. Ako nmn po nag file s rtc ng motion for execution pending appeal kc po hindi nmn po cya nag lagak ng supersedeas bond at montly rentals.. S ngaun di ko po n din alam kng ano n po mngyyari.. S CA nmn po mrmi ng hiningi dun s nag p petition kmi nmn po pinasagot lng kng bkit hindi dpt bigyan ng tro ung nag p petition..
