Hello po Atty. My friend was charged with rape for August 2022 and March 2022. The August 2022 rape case was dismissed, and the March 2023 was downgraded to Acts of Lasciviousness of RA 7610 Section 5b. But unfortunately, he was convicted of Rape by the judge. He used the jurispredence from RA 8353 instead of RA 7610. Is it not against double jeopardy?
