@@Sarahhlynn1995 top 20 law school graduates come out with 190k salaries with high bonuses at BigLaw firms. Pretty sure now it’s been raised to 200k but fact check that on me bc it might be higher 😂😂. Point being a law degree from a good school (ITP, Personal injury, Medical malpractice) 💰

Read the federalist papers which states the clear and applicable intent if the law,all public trustees shall be bound to the Constitution and anything that shows to be in conflict is null and void, or without standing in a court of law

Really loved this. We went over these cases and body of law in law school but I hadn't appreciated their nuances and broader implications at that time (I was too worried about getting cold-called lol). This was very informative, thank you

DeShaney v. Winnebago is the case. The reasoning is similar when a person generally cannot sue the state when police fail to protect them. The general rule and exceptions will probably be tested in court by Uvalde.

What about when a state violates someone's parental rights. And there due process rights. My ex was able to go all the way through the court system but never served me with any paperwork. On top of that there were only two hearings one got vacated and both of Them I received my notices after the hearings were held

In principle, everyone must be served in every case where their rights are implicated. There may be exceptions for emergencies, but those involve things like temporary restraining orders (such as no contact orders) until a hearing can be held.

Because the Constitution supersedes statutory law, so it’s “sub” rather than “extra.” Sub-constitutional captures the fact that no congressional statute can violate a constitutional provision.

Oregon has mandatory arrest statutes for domestic violence and public intoxication. These have been construed to impose liability under state law for failure to arrest if harm subsequently results. Scovill v. City of Astoria, 921 P.2d 1312 (Or. 1996). There may, therefore, be remedies under state law that apply under those circumstances.

There, the state created the cause of action. I don't think the federal constitution requires any state to do so, but obviously the state can choose to.

@Lucy Benson DONALD R CATHERMAN JR V CITY OF POPLARVILLE MS..case was dismissed,,I am filing appeal this week,,,notice of appeal,,,, appeal will follow in the near future.... federal court southern division,,,you can find it on pace monitor...look at all documents filed,,the legal authorities prove my case ,,, yet a void,, illegal conviction bars my suit,. HECK V Humphrey....the munisapale court committed federal crimes during my trial...but the fed court ,new judge to the case after 6 months fails to see the facts of 1983 claim .the city, the defense openly admitted being in the wrong,,,yet there defence is,,, Heck,,bars suit,, a void conviction can not bar suit .. another legal tort. Even when your right you not going to hold public officials accountable....in any court...it's a corrupt system..all the way around,,601-522-6352.. if your interested in hearing the true story...ty be well be safe,,,be informed.....

Yes when the states took temporary custody the federal government, then had stupulations that the states seek out family first! Blood relatives.. and that's where things go haywire!

The last case of the pitcher, Grimsley I believe, should have been easy, open and shut case. The event happened in a place where the public was allowed (though, they had to pay to get in). The 1st amendment allows for the freedom of speech. The pitcher went beyond his scope of employment to overtly cause an intentional harm to a spectator, Manning i assume). He, alone, should have been charged with wreckless endangerment and the sole source of prosecutions, regardless of what he was wearing.

I'm not qualified to dispute the constitutional law aspect, but (1) his information on the "welfare state" seems to antedate Clinton's first term, and (2) both he and Scalia are dead wrong on LEO "discretion" when it comes to protective orders. It's not like doing 40 in a 35 mph zone. Restraining orders are called orders because that's what they are: A judge's specific orders regarding what a specific person may not do. The police have discretion in enforcing the orders; IE if the former spouse is outside the residence in a car with a gun, drunkenly threatening suicide, it's probably better to get the family out of the home through the back door and wait until the ex-spouse passes out. NAL but refusing to enforce a judge's orders is generally contempt of court. And discretion can easily morph into selective (un)enforcement. I don't find repeatedly invoking the Bible ("thou shalt not") the most convincing argument; it's not a relevant comparison. Particularly when so many of the "thou shalt nots" are followed by, "and if anyone does this thing, take them outside your camp and stone them to death". And the other thing he keeps circling back to -- 'if the law was interpreted this way, it would open the floodgates of fiscal liability' - isn't even an argument against that interpretation of the law. It's an argument against the (presumably unintended) consequences. I don't think "thou shalt not incur infinite expenses" is in the Constitution either -- that's why "balanced budget" ammendments have been passed (state) / pushed (Constitution).

Probably the least important part of what you said, but I don’t get the impression he’s comparing to the Bible so much to strengthen that position rather than to imply or remind the connection to the philosophical and sociological origins of that sort of idea in our law. Our (common law) societies are distinguished easily from other legal philosophies where “hands off” is far less than a core tenet.

2:01 this is why attorneys steal 😅 I'm in Missouri now and also involved in high profile litigation involving David Boies (a lawyer touted as America's top litigator) and other conniving attorneys. This includes members of the Judiciary and the disciplinary councils who assure people like Boies and the con-artists in Missouri retain law licenses and judgeships despite being clear criminals. I'm watching this as part of my independent study in pursuit of licensing and pro se practice. And.... 2:01 ....the mumbo jumbo this video has begun with explained to me clearly why all of these attorneys are thieves, liars, con-artists and that's it. They don't even want to deal with this nonsense but ...this is the type of stuff they bribed their way through law school in order to get licenses (they absolutely don't need!). I'm a really good student and etc etc efc....and this vexed me to the point of understanding that this mess 2:01 is exactly why I am involved in dozens of legal actions with absolute criminals masquerading as attorneys. 😊 I'm now going to try to finish slogging my way through this fifty minutes of nonsense. I may post a end of video comment to review 😒😖😖😖😌 6:31 😅 i may not torture myself with this foolishness even though it sounds like it could have been interesting. I need advice. I lost my license to DUI. Around 3 years later I still didn't have my license back. I was caught driving on a suspended license 2 times in a month and done 10 days in jail. My license was suspended again(meaning I couldn't have it reinstated) for 90 days in mid October. In July I called the courthouse and got the amount owed to pay off my fines and get my license reinstated. I went to the courthouse to the clerk and gave her my ID & told her I was gonna pay off all fines and get my license back. She disappeared for 30 minutes then tells me "You can't get your license back" I said I just need to pay off my fines first. How much are my fines? SHE WOULDN'T TELL ME. SHE SAID ASK YOUR ATTORNEY. I told her to please recheck I know what the judge said. She said "The judge is wrong. He knows better". Anyway I got caught driving again and got 3 years in prison not jail prison. This is BS. I WAS DENIED DUE PROCESS! HELP!

My freedom of speech is being violated, my right to live where I want to live it’s being violated, my right to seek work or running my small business are being violated. My right to seek technical professionals to remote cameras from my home are being violated. My right to privacy is being violated.

I disagree with the characterization of Life, Liberty, Property, and pursuit of Happiness, my first, issue is, liberty is a right of the American Citizens as the due process to be heard. Secondly, too not include "pursuit of happiness" as abrogated right no longer validated to be omitted by present most precedents of original Chief Justice's opinions. Thirdly, the Constitution: for the people and by the people is the foundation of principles. To omitted the people too submissions to the new practices of white supremacy and narratives .

Can anyone help mi: what's unnerving is that both sides red maga & blue maga asking that ? yet I'm experiencing gross infringement of my constitutional rights tantamount to constitutional crisis. where are the advocates for capitalism, liberty, freedom, constitutional rights, actual social justice.
