Once again more useful than law school - my university has decided not to cover Joint Tenancy and Tenancy-in-Common in Land Law, and leave just two paragraphs on one page in Equity...

What happens when the trustee Act 1925 limits the division of legal entitlement of the property to up to 4 members and there are 5 members who have purchased the property? For example, A, X, Y, Z, and B purchased land and the B becomes the beneficial owner of the property with everyone whereas A, X, Y, and Z becomes legal owner of the property. When A dies, would the legal ownership be divided amongst X, Y, and Z or the B would also become a legal owner, or would the legal heir of A would be entitled to the share of A?

Does joint tenancy with rights to survivorship eliminate or extinguish debts of the deceased person. This to include judgements and liens on a property, real property was held between husband and wife. What happens to these debts is surviving spouse responsible for these debts accrued how does one go about paying off liens and judgements also if a home has a mortgage but the mortage is not from a bank but a private seller and the mortage holder died who do you pay the balance of the mortage when mortgage lender does not have any wife or kids or estate maybe just a sibling.

Since my mum died my siblings want me to deduct some of my inheritance from my mum as myself and my husband have brought half of my mum's 2rd home and it is a a joint tenancy which means the other half of the house automatically goes to us both now my mum has passed away. How much deduction of inheritance should I take off because of having joint tenancy property ownership?

What is Co-ownership? What does its topic cover?
@digestiblelaw46474 жыл бұрын
Co-ownership is about the ownership of land. If one person owns land they are the sole owner, but if more than one person owns a plot of land then they are co-owners. There are two types of co-ownership in law: joint tenancy and tenancy in common. In this area of law, you want to learn about these topics, joint equitable ownership, a basic knowledge of trusts of land, and severance. Thanks!
