A tenancy in common of the beneficial interest, out of co-owned legal joint tenancy, may be created by express declaration and may also arise under certain equitable presumptions. We will also look at Stack v Dowden and Jones v Kernott.

Hi Gareth Great video thanks. In my situation I am unsure of the outcome please could you give me some tips where I stand Three brothers are left a property, each have equal shares as tenants in common two of them remain living in the property but the third one hasn’t lived at the property since he left home for many years . All brothers don’t get along . What happens when the third one wants he’s share and the other refuse to sell or buy him out? Can he force the sale of the property by TOLTA and what’s he’s chances at the courts being in he’s favour? Thanks

Hi, I am in a tenants in common with no beneficiary survivors. I pd for the lot (land) in 2005- & made pmts till 2013. I bought the ground on an equity line on another house I owned. Well when I kept trying to tell the bank Wells Fargo that they passed fraudulent paperwork. You were supposed to add the lot into the building loan & that is the # for your mortgage. I kept calling & calling the title on my property is presently held by PNC Bank. Can I sell my 50% interest in my property to another person.?

Hello! So what other terms can be expressed in the Trust deed when the parties are unmarried but have joint dependents?

When you say joint dependents in this context, do you mean when an unmarried cohabit with children?

There must be a way Tenants in common(where the man contributes 100% of the deposit into purchasing the property of the family home) and as a result of children of the relationship can be protected, for instance in the event of depreciation of the value of the property? I’m concerned!
