The building permits are not given by the Govt. The building permits are given by the respective city corporations, municipalities, or panchayats. The Maradu region comes under the Maradu Grama Panchayat. It's also a coastal area with lots of inland water ways. The panchayat gave permission to build the flat but they have to get permission from the Kerala Coastal Zone Management Regulatory Authority (KCZMRA) too as the region comes under Coastal Zone. They denied the permission but they were already built as they got stay order against the panchayat from the high court and sold it to the customers. One builder decided not to build. They were denied building numbers by the panchayat as per instruction from the KCZMRA. As per the instruction from the KCZMRA, the panchayat had filed a petition against the builders in the Supreme Court which were already built stating the CZR III regulations. And the rest is news.

I think first they construct anyhow later with rule and regulation supreme court ordered for demolishing after appeal made by Kerala coastal management authority. Rate of appeal and final judgement is slower than building construction ... simple..

In my opinion, this was a disastrous decision by supreme court. 1) biggest victim in this judgement are common people who bought this flat from the builders. We know how much effort it takes to collect enough money for a common man to buy a flat. Oy compensation of 25 lakh will be given to the flat owner which is first of all extremely low compared to the amount they spend from their hard earned money. 2) the builders should have first arrested and then forced to compensate the flat owners significantly. The corrupt govt officials should have first arrested. 3) demolition of these flats should have been the last step to be implemented not the first.

Hadd h yar..some GYANI ppl are suggesting that govt should have used the flats instead of wasting money on demolitions rather than seeing it as one of landmark verdict of apex court as far as environmental conservation is concerned. We continue to face extreme effects of climate change & environmental destruction & ppl r suggesting to save few millions of dollars. By destroying the buildings we have saved ourself from a future catastrophic events which may cause irreparable damage & millions of dollars in future. Even some studies linked the catastrophic flood of Kerala in 2018 to illegal constructions in backwaters Come on India, accept environmental conservation as a way of life & not as academic exercise :)

It had to be demolished because Kerala government allowed them to build illegal building there because they accepted black money from them and people and some honest or may be people who didn't get their share of black money started to complaints and then apex court of India had to come in between to resolve the issue .note the most important thing here that Kerala government didn't demolished it by itself ,it the apex court on who's order demolishes has been done .

Back in 2013 or 15 there was a resutarunt in 1 acr near mangrooves or protected area in kochi itself the govt demolished it and they planted many saplings there... now its a small forest.. they recontructed the same eco system with help of some activists...
