Mentioned SC case made a point on "Competence for a court to take cognizance of offence"... n if we read Sec-190 together with Sec-11... its clear in S-190 that any Magistrate of 1st class can take cognizance of any offence... where local jurisdiction applies to inquire n trial into offence... which is a post cognizance stage.... so my interpretation goes with SC view...just sharing to learn others views

May be good motive behind this judgment. No absolute bar should be imposed on magistrate. This judgment read as exception or proviso of general rule. With great respect my view differ with sir.
