It's not retrospective legislation. It would only affect newborns after the prescribed switchover date. At that point only those with either at least one parent a US citizen or legal permanent resident would acquire citizenship at birth. All others would need to follow the naturalisation pathway to citizenship if it was desired.

The UK, Australia and New Zealand for example all made the changeover decades ago. It doesn't require any hospital enforcement. Citizenship is only bestowed when a birth is actually registered. Generally, proof of parents status is either required at that point or when you apply for your first passport. So there's no great chnage involved. It's what the parents of US citizens born abroad have to do already. It's a worthwhile change as it fixes a few issues such as the lure of potential anchor babies and the burden of temporary residents' children becoming 'accidental Americans' However you are correct most administrations have not considered it enough of a priority to bother with overcoming the very high hurdle of Constitutional change.

No, Trump is a legal US citizen, which makes his kids US citizens. Now, if Trump was illegally in this country and had a kid born on US soil, then yes, we would deport them as they are here illegally. I'm basically a child of the 60s being born in 1956...not the "hippie, drug using 60s" but just "some new and often dramatic, less formal social structures & directions, 60s." I attended elementary school 3-6th grade at William Cullen Bryant Elementary School on the west side of Cleveland, OH. It was during this time, I learned about the very American phenomenon of "the mixing bowl," of ethnicities, (and it was presented as a positive,) it's also where I heard one teacher's opinion that America was more a capitalist country than a democratic country, (pretty accurate point, I'd say, but why I remembered that?) and if I'm not misremembering, it's where (6th grade?) we also learned about the book "1984," by George Orwell. I don't think we had to read it or do a book report on it. I think the teacher just explained to us what it was about during a history or social studies time. Would I have had the very same educational learning experiences if I had been in elementary in the last 10 years? Obviously, public education, and freedom of knowledge in this country is under attack by special interests (primarily religious right) and has been weakened over the last few decades.

Nope it's the about the only piece of legislation he's proposed that's sensible. It should have been done decades ago when the UK, Australia and New Zealand ended the practice. It's a reflection of a bygone era and needs and no longer relative to the requirements of a modern USA. Almost all will never notice any difference. The lure of universal birthright citizenship will end for migrants and associated birth tourism and children of temporary residents will avoid the burden of involuntary US citizenship on their return home. The naturalisation pathway to citizenship will still be available for all those not eligible for birthright citizenship.

The case will go to the Supreme Court. The argument will be about the meaning of the phrase "and subject to the jurisdiction thereof" This has been interpreted as meaning that the children born to diplomats serving in the US are not US citizens. The court may rule that the citizens of another nation, here illegally, are subject to the jurisdiction of their native country, and any child of theirs born here, is a citizen of their native land.

It's about the one piece of sensible legislation that Trump has proposed. If it wasn't for the very high hurdle of potential constitutional change it probably would have been addressed some time ago. The UK, Australia and New Zealand all made the switch some years ago. It saves the children of temporary residents being burdened with US citizenship and those born to illegal residents can still pursue citizenship through the naturalisation process.

It takes common sense to know what this "birthright citizenship" was intended for. Yes, if an American citizen gives birth to a child, no matter where or what country that child was born in, that child automatically becomes an American citizen. But, if someone who visits the United States or enters the United States illegally, and gives birth to a child in one of our hospitals, should that child automatically becomes an American citizen? This child could be a child of a person from Communist China, does that child automatically become an American citizen? It would be absurd to allow that from happening. If President Donald J. Trump does anything to the birthright citizenship clause found in the Fourteenth Amendment of the U.S. Constitution, it would probably be more specific as to whom these "birthright citizenship" belong to.

Yes, that is how to states keep the federal govt checked. Texas did it with the last administration and both sides can help each other (red or blue states) They do this by sueing the federal govt which is based on you cant logically charge a nation of a crime. You cant really do that unless you are a state. What that does is stops the federal govt and its not truly lawfare. The other thing that can be done is the states have the responsibilty to make sure a state is a republic form if govt. Another thing is... Congress funds, creates agencies, eliminates them. This includes the FBI. Although the president plays a role its the duty of Congress according to the US Constitution. Elon Musk can call his think tank whatever he wants. He can lobby congress but any citizen can have influence except you may have to join forces with a great many citizens. Right now, there is no one in the federal govt who has utilized all the powers of the US Constitution. However, we can all seek this by looking at how Americans in the past, some have since died, have done things- so we done have to do the hard work. Look for this report titled, "Presidential Authority to Direct Departments and Agencies to Withhold Expenditures From Appropriations Made" The words "presidential authority" must be asked the question, authority to what? authority is also the same or similar to role, duty, responsibility. So, Elon didnt get elected therefore he doesnt have the role of being the president. This is what is mesnt when a democracy is based on power from a group of civilians, the voters. So the job of elected officials are to exercise those powers. So for example, when Trump takes the oath he is in charge of making sure that the people have power instead of one person. A good president aligns with public opinion. Which will always conflict with an individual. When someone says this is "best fir the people" that is the same as saying "I speak for what is best for me" In other words, no one can truly know public opinion so they do not know what is the desires. So when someone says "best for" he is essentially trying to govern people. When we have been so apathetic to civic duties for so long we face long term work. It is not only political but social When we cannot vote we do not have power.

It how the majority of the world works. To inherit citizenship at birth you need at least one parent to be either a US citizen or a legal permanent resident. All others need to follow the naturalisation pathway to citizenship. It ends the lure of universal birthright citizenship for migrants and associated birth tourism and saves the children of temporary residents the burden of acquiring involuntary US citizenship. Again the naturalisation pathway is always available to such individuals if they remain in the US.

I have no issue with the US changing the means of acquiring citizenship. Jus soli was okay in a world where travel between countries was not as feasible as it is today. However, any change to the existing constitutional arrangement needs to be done in a legal manner and not at the whim of one individual who demonises people from other countries and calls them animals. Any change should also be accompanied by comprehensive immigration reform so that issues relating to existing residents in the USA are resolved in a sympathetic and humane way.

William Tong's story is indeed inspiring, but I take issue with the 'only in America' argument that gave rise to his personal advancement. American exceptionalism is a myth perpetuated by the haves to say that anyone can achieve personal advancement only if they try hard enough to overcome the obstacles. Where I live, Ireland, has seen a revolution over the last 50 years, and I and many more have benefitted from it. First of all there was the introduction of free second level education, and that was followed by heavily subsidised third level education and entry to third level courses being based on educational merit and not family status. Access to education in Ireland has been the driving force to personal development and has led to the economic advancement Ireland enjoys today. Whilst I don't know Mr. Tong's personal life story, it is true that Asian migrants value education as a means to personal development, and I am sure that Mr. Tong's status is entirely based on merit.
