I just showed this to my senior legal studies class. They loved every minute of it. We're currently studying Australian constitutional law, and I thought that it would be cool to expose them to a different system. Not going to lie, as a proud Australian I'm extremely envious of the freedoms that Americans are guaranteed. In Australia we don't even have a bill of rights in our constitution, just a smattering of protections with the rest of our rights being "implied" rights. Well done on a great production guys.

Speach is absolute,you have the right to listen to what someone has to say,and you have the right to ignore what someone has to say so yes all speach is protected. The Constitution explicitly says freedom of speech,no where in the first amendment does it say forms of speech are prohibited.

A decent lawyer should be able to comprehend it spells out property rights. You have property rights, the house belongs to you, you can refuse to house soldiers. It's come into focus more as government and business intrudes on to private property, like HOAs and city ordinances. 4th Amendment - prohibits government (federal/state/local) from unreasonable search, and unreasonable seizure. Unreasonable search (invasion of privacy) of property, person and effects (belongs), meaning searches where there is no warrant and no evidence of a crime. Unreasonable seizure (theft by government) is not allowed, obviously because that would be theft (a crime). 5th Amendment - requires process of law (known as due process) in cases of death penalty, imprisonment or seizures. Due process of law is required to avoid government committing homicide (a crime). Government has the power to sentence a person to death (penalty), but must prove beyond a shadow of a doubt to avoid committing homicide (a crime). Being imprisoned without a good and lawful reason (false imprisonment) would be kidnapping (abduction, a crime). Seizure of property without proving a crime was committed would be theft by government, and it must be only in the amount as proscribed (written down) by law (per limitations of punishment 8th Amendment, known as protection from cruel and unusual punishment). A person's life, freedom, could also be considered in someways property of the person.

The word "certain" is used to mean "without doubt", certain. And not the certain (vague selection of). Google "certain people" (vague selection of). The enumerated rights in the Constitution (government powers) of established rights, shall not be interpreted to deny or deprecate rights retained by the people." As I tried to paraphrase, it says "enumerate rights in the Constitution" and not "enumerated rights in the Bill of Rights." Bill of Rights are attached to the Constitution (Constitutional rights), as Amendment laws (SIC). There are enumerated rights pertaining to what government can do. Either way, it works out to, "shall not deny or disparage others (other rights) retained by the people." Government powers shall not override the rights of the people. 10th Amendment - "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." States derive their powers from the 10th Amendment, "... are reserved to the states respectively" 19:20 "furthermore, at first the Bill of Rights only applied to actions by the federal government". The Bill of Rights applies to all levels of government (federal/state/local). "Prohibited by it to the States" maybe overlooked by some people. The Bill of Rights (protection from government powers, federal/state/local) prohibits unreasonable search and seizures, requires due process in cases of capital or infamous crimes, requires a fair trial, a legal representation (an attorney), for example. 19:48 "and with the state government were 'carrying a lot of the load of lawmaking'... ", "with the understanding the Bill of Rights didn't apply to their laws." Which should alert you to the attitude of some people who have very little understanding of the Bill of Rights. Protection from the Bill of Rights is for all levels of the government (federal/state/local), as it was instituted to protect the people from government overreach also known as tyranny or incompetent use of government powers. Madison, maybe overly credited with the Constitution. He only changed his mind (about the Bill of Rights), because he wanted to be part of the fledging government, after being removed (possibly for opposing the Bill of Rights and even stated he could not see a reason for it, initially).

James Madison and other supporters of the Constitution argued that a bill of rights wasn't necessary because - “the government can only exert the powers specified by the Constitution.” (google: James Madison against the bill of rights) (Not in the video) It appears James Madison flip-flopped to being against the Bill of Rights and ran for House of Representatives, under the promise of supporting the Bill of Rights, to win. A true politician. What you might not know, is the Bill of Rights (1689) existed in Britain, about a hundred years before the U.S. Bill of Rights (1791). It's ideas were brought over (Washington and many others poured over documents for ideas for a new government in the 1780s), especially those that involve fighting tyrannical use of government powers. Guess: He was probably pushed out for being against the Bill of Rights, and only supported it to get elected by promising to support it. Possibly, he even saw the need for it as he learned more about it.

One thing people don't fully understand is the original Colonies were more separate countries not states working as one. Europe was and still is set up like the Colonies. 15:20 When dealing with the 2nd Amendment, it's important to remember the context it was created... A newly formed government, in 1791, without a full-fledge military and also still fighting off the British, in skirmishes. "For the security of the state"... is proof it was for purposes of national defense. The Militia Act of 1792 was repealed in 1795 (revised to read repealed at the bottom), which basically removed support for the militia. Probably they felt the military was large enough to do the job of defending the nation ("provide common defense" : see Constitution Preamble). Active full-fledge military being in existence, the 2nd Amendment is basically a relic. You can still support the 2nd Amendment, however, by joining the army or national guard, to fulfill the "for the security of the state (nation)" text. The 2nd Amendment has been obsolete since 1795. It is not for personal gun ownership, but for national defense in 1791. Militia is an improvised army using armed civilians. A well-regulated militia is an organized and practiced militia. Closest thing to a well-regulated militia is the National Guard, a part-time military, where you do drills from time to time.

The Bill of Rights and Constitutional Rights are protections for citizens providing protections from the government. Throughout history when a government has absolute power and the population can't defend itself, tyrants emerge. This current administration is a perfect example. Democrats and the left have infected all corners of our government and media. Also the State National Guards are a state asset with the mission of protecting that state from the federal government, except DC which operates a little different.
