To clarify, the 11th Amendment is a jurisdictional bar that prohibits both: (1) the citizens of one state or foreign country from suing another state in FEDERAL court for money damages or equitable relief; AND (2) suits in FEDERAL court against state officials for violations of state law. Additionally, the Supreme Court has expanded the reach of the 11th Amendment to also prohibit citizens from suing their OWN state in federal court. We will cover the main exceptions to the application of the 11th Amendment in our next video. Stay tuned!

Your lectures are terrific. The main skills for studying and testing in law school are issue spotting and an organized pre-thought-out process for responding to the question. Your lectures do that thoroughly and efficiently. One should have a plan how to respond to all the likely essays before the exam. For example, if one spots a negligence issue in a question, one should already have a plan about how to write an appropriate negligence essay. Then all one need to do is insert and analyze the facts according to that plan. I am a paying Studicata customer. I would really appreciate more Civil Procedure videos. Outlines are good but are also available in many places and don't have the teaching success of a well done lecture.

I looked up state law in Blacks law dictionary I believe it was 4th edition it said see statute, or statutory law. I assumed that ment that there's no such thing as a state law, the state's always enforcing statutes. As s result of administrating statutes they act in their personal capacity, not their public capacity, how then is anyone in jail/ prison, have arrest warrants, search warrant, court order, or. Judgments, etc? That would be like if I issued an order or judgment against my friend when that gets out I will have a problem, big time. Because I acting in a private capacity have no authority to do so. I would be slapped with a felony charge. Why aren't these clerks masquerading as a judge ever get charged with anything?

Great question! The direct conflict between state and federal marijuana law is currently an unresolved issue. We have to wait to hear from Congress and the Supreme Court to see how it will play out. Procedurally, the Supremacy Clause does not allow the federal government to review or veto state laws BEFORE they take effect. The state laws can only be challenged and preempted under the Supremacy Clause AFTER they take effect. This is how we can end up in the current limbo we're in with direct conflicts between state and federal marijuana law.
