I'm confused about condition precedent. Joan receives an insurance payout when she turns 21, but she's dead from an accident at 18 now. I get it that the insurance will prob pay out to her dad when she woulda turned 21 (because they have the right to use the money till then). One of the quiz answers we reviewed said Joan's reaching the age of 21 is a condition precedent to the insurance company's duty to pay anyone. That's given as the incorrect answer and it is said that it is not a condition precedent or a constructive condition. But it sure likes a condition precedent to me. FYLS. Also, I don't get why Restatement 224 (2nd 1981) states that a condition is something that is not certain to occur because this seems this 21 condition seems like a condition to me and it seems like it's certain to occur, whether she's alive or dead. I'm not sure how to legally view that as consistent with each other. Thanks for your thoughts.

+Cadee Blacc Sorry you didn't like. Many of my publicly available videos are older and were recorded under unfavorable conditions. They were also intended for international speakers with limited English and I found that a softer but often flat intonation seemed to work given the poor recording environment. Didn't work for you but thanks for stopping by.
