I was contacted by client made an agreement via cell of duties to be preformed and my quote for the rate per hour. Once at the jobsite the customer few days later changed my trim carpenter duties to handyman i informed him on monday of the handyman rate, again on tuesday (35 hour verses 60 hr) The new duties included ripping up carpeting, relocate certain abandon furniture to be saved the rest hauled off to adump plus storm clean up damage. The client and his attorney feel the agreement was for various projects at one rate, handymen I only perform skills from experience and at industry standards, Mowing 25 plus 5 for trimming, then to restore headlights 50 set, personal shopper 20, misc let customer decide. I was paid by check wrote on the back "cashed under protest", his attorney stated i was paid in full, wrong under "accord and satisfaction" only partial payment has been made, i know other contractors it is becoming standard to rip off the contractor under or no payment made. The client when i first informed him of rate increase state OKAY. I fulfilled my duties assigned upon original agreement he and his wife were impressed at my skill level, i get referrals and references upon each project i complete, some tip me more then I ask, even get numerous repeat business have waiting list at times or hold out until I am available And contractors are rip off or scam artist, not always true, I know many that are in the same boat as me, cheated or not paid at all.

Yes, in the negotiation phase, a couteroffer acts as a rejection. If A offers to paints B's fence for $100 and B says he is willing to pay $50, that is a rejection of the original offer and a counteroffer. At this point there is no contract.

I hired a roofer, who accepted $12,000 to pull old plywood off and put new plywood on, and 50 years shingles. He pull off ONLY OLD SHINGLES, but not the old plywood, then demanded more money. I told him to quote me the extra costs, he didn’t. He pulled no permit, but try to get me to sign for the permit after the horrible work, I told him to send it to me in the mail, he refused to send it to me. He put new plywood over old plywood. Next month we go to mediation. Despicable. He did not have an endorsement to be a roofer, he was only a licensed general contractor. Going the the government offices was a joke, they covered up his frauds. We cannot even get a jury because of expenses, the lawyers are not willing to litigate because of money. This shit show needs to change in this country.
