Unless they have some kind of contract with the state or city they don’t have a right to the vehicle.

Tow truck drivers are predators, they tried to tow my wife’s car while I was changing a flat tire. They said it’s illegal to change your tire on the side of the rode.

Well I agree the tow truck operator is ripping the customer off. I’m an electrician. How would he like it if I charged him $2000 to change a light switch and keep the power off in his house until he paid. But at this point not sure if the customer can do anything besides sue. Could it be considered car theft? Because each day he has the car at his shop he will charge storage fees. So can you steal someone’s car and trespass them from your property? This proposes an interesting court case.

@@LowSparkofHighHeeledBoys Here in Australia if you take your car to be repaired and can't pay the bill the mechanic can legally hold your car and even charge storage fees. I don't know how this highway law works in the US but if for instance your car breaks down on a motorway here in Oz and you don't organise getting it removed yourself you will become liable to pay whomever was contracted to remove it. And they charge like wounded bulls. So without more information about the circumstances about how the car came into their possession and the laws surrounding such matters it is premature to talk about litigation let alone calling it theft. Besides sparkies are notorious crooks $200 to replace a single power point?

Yeah, but that ruling is narrowly tailored to only protect the plaintiffs in the suit in question. (Members of the ‘small business association of america’) hopefully it is upheld and expanded. I was reading up on it, and they said estimates a cost of $8000 to get into compliance with the law in the first year. So essentially an additional cost of $8000 to start a small business. Huge exemptions for big corporations of course.

@@Vikingwerk How does it cost a company $8000 to file a report? The law is a lot less sensational if you read the actual requirements rather than knee-jerk reaction pieces. It's designed to make it harder for people to launder money through shell companies and it was supported by both parties. You do realize you need to file taxes as well when you own a business right? Filing taxes is a much more time consuming process.

You gotta remember that those tow trucks are not cheap, the shop to store them in is not cheap, the acres of land space to store the towed cars is not cheap..... And who knows how long she left it there, those tow companies charge by the day...

An $1100 tow for a normal car is indeed robbery, no matter the circumstances. I've operated in this very situation several times as a shop owner and though this owner is technically correct, $1100 is insane money... unless this is California where everything is already insane.

I’d like to get more details. Some tow companies operate illegally. They will tow cars parked legally, tow cars that ran out of gas and the owner is right there with a gas can, things like that. I wonder if that’s what happened here. The car broke down on the highway and when the owner showed up to get her car it was already gone. In most states you get a certain time period to remove your car after it breaks down before it can be towed. I don’t trust cops the same way I don’t trust towing companies.

In 1975 when I had just graduated from HS my car became disabled and was towed by order of a cop. I was charged $275, probably equivalent to $2750 in todays dollars. I later found out that the state of Washington had minimum tow fees, wreckers has no choice but to charge it or face fines and possible JAIL TIME if they charged less. Yeah, you don't live in a free country. And you haven't for a long time. You live in the UNITED STATES OF AMERIKA, INC.

@@generalzod7959 Well let's see, gas was 49.9, it's now about 10X that. I could buy a brand new Ford F-150 4X4 for $5000, now they're over 50K. Food has gone up 30 percent in the last 3 years alone. I could buy a loaf of bread for 25 cents then. I don't care what the LIERS in the goobermint say. I was there, and now I'm here. On average I'm paying 10 times what I paid then. I bought 12 acres of forest land 20 miles north of Spokane Washington in 1976 for only $6,500. I could go on.

Abandoned cars on the side of the road are dangerous, especially in high traffic areas. Where I live, you have 3 days to get it off of the side of the road, although you still get fined for every day it is left there. At least I think that’s right. I guess I just feel that the reason most people leave their car is because they can’t afford to tow it in the first place, so charging insane prices to release them is harmful. Ideally, the only time people should really be punished for this is if they abandon a car for non-brake-down reasons, like abandoning a stolen car they used to commit a robbery, for instance.

Re: boats...actually you can. Consult maritime law on salvage rights. The owner can get it back, but must pay you for it or abandon it to you. There's a legal process for salvage title, but isn't there always? That's the law on all US waters and navigable waterways.

While I can agree the pricing is robbery, ultimately it's the state that has enable the service and it's pricing so charging an individual company serves no point, they'll justify the price by labor, equipment used, hazard pays for working on a highway, etc all to the end of paying their taxes, cost of owning business and salaries so it wouldn't stick in court anyway.

If they come to tell your stuff off your property between midnight and 6:00 a.m. you can call the police and have the tow truck driver arrested. I know I've had it done. That wasn’t just for the toll it also looks like a mechanic shop so they might’ve fixed the issue with the vehicle so they have to pay for that too if they refuse to pay the mechanic they can take that part out until it’s paid oh and also label fee depending on what the part was it can be expensive I know people that wore mechanics

If it was towed from the highway it was most likely deemed abandoned. So it sat on the side of the road for 48 hours at a minimum. The owner of the car had 48 hours to get there car moved . After that yes they will just tow and compound .

The licensing fee $200 State and Federal Tax $400 Insurance $150 Tow Truck Driver $250 Because the paperwork is already done he has to fork that money out to all parties involved from the government to the tow truck driver he is now out of pocket this is how the government makes sure that they always win. That is how these things work. It is up to him now to get the money from the owner of an abandoned car which is probably broken being the original reason it was abandoned. Who are the criminals?

I had a tow driver steal my truck from my driveway. I reported it stolen and the police found it at a impound. I had no way to prove they stole it. Then that tow driver tried to steal my truck again while I was home, and I stopped him then. Threaten to call the cops if I ever saw him again.

Well, leaving your car in a highway isn't good either as it could get stolen, damaged, or have some parts stolen by thieves. I understand that some tow companies would charge you thousands, but between that or having your car totaled or stolen and damaged, I prefer having to pay a few to get it in my house or in their parking units. That is my opinion on tow companies.

The best I could find is that it was secretly included in a National Defense Authorization Act. The intention of the bill was to do away with anonymous shell corporations, but it is vaguely worded and could be abused beyond its purpose. What we really need to address is the attachment of unrelated items to any bill. These issues need to be addressed with stand-alone legislation and not attached to must-pass bills.

The tow yard did not PAY $1100 to pick up a car that's in their service area and drag it back to their yard. They're manufacturing bullshit charges in order to extort the victim, because what they really want to do is steal the car and auction it off. They're scammers and you're defending them. The cops NEED TO BE INVESTIGATING. Also, if they have a contract with the city (needed for towing from public streets) then I am CERTAIN that this would come with certain restrictions on them keeping cops off of the property.

At least here in Oklahoma. Now that company paid to recover it and simply wants payment before releasing it. It's not GTA, because they followed the law.

There’s a lot of predatory tow companies because it’s essentially unregulated in some parts of the country. Pay a fee get a license start towing and start extorting people for their property. Unless they tow someone who can afford a lawyer they probably won’t get caught.

It's a racket for sure, but it probably isn't just a straight tow fee. You probably need to add the tow fee, the ticket fee (government charge, but they would need the vehicle to be ticketed for him to tow it), plus any storage fee (how many days was it left in his possession?).

Not if you are a tow company that is licensed with the county/city/whoever to remove abandoned vehicles from the highway. Have you ever seen cars on the side of the road with a big neon sticker on the window? That sticker means that the cops or highway patrol has determined that the car is abandoned and it's fair game to tow.

In fact: their fees are in line with court fees for suing. But it is our fault for not pushing for a better solution. However, some states have laws to help quell predatory towing. California, for example, has a law so that towers have to unhitch the vehicle if the owner arrives, on-scene. Just a little law to help deescalate situations that previously left people dead. Shouldn't be surprised when vehicles are so depended on for making a living.

This is NY! I grew up on Long Island, I’m not surprised at all they are charging $1100.00 for a tow and whatever the other fees are. In NY on certain days of the month they set up road blocks and pull people over for not wearing your seat belt, and for those of you that don’t live in NY did you know it’s 4 points off you’re license if you get a ticket. For those of you that think it’s ok because it’s about safety, I’m going to prove to you it’s all about stealing money from the people. In 2014 I was working in NY near JFK. I was told that on the service road off the Belt Pkwy cops on certain days would set up road blocks. I drove my car with Nebraska plates for years while I was living in NY. This particular day as I got off the parkway I saw the line of cars and saw the cops, I immediately took off my seat belt to see if they would give me a ticket. As I approached a woman cop puts out her hand for me to stop, she looked at me looked at my plate, turns around and I hear her say, to who I believe was her Sargent, “should I” he looks at my plate and shakes his head no, she then waves her hand for me to go. Before I hit the gas I put my seatbelt back on and when I got up to her I said to her what you’re doing is so wrong. You know damn well your ripping the people off and didn’t attempt to give me a ticket because you know I would have ripped it up right in your face. You see in the state of Nebraska it’s illegal for cops to set up road blocks checking to see if you’re wearing your seat belt. Of you’re an adult driver it should be your choice not the governments. It’s all about the revenue for the state. The people of NY are so stupid for allowing their government to do that. They would never get away with doing that in Nebraska.

There's a certain timely manner that you have to remove a car from public road ways or else in the eyes of the law the car is considered forfeit/abandoned and if it is called for tow with a orange marking in the window you have 24-48 hours to get it off or else a company can temporarily obtain the car, you then have until the company files fir lost title of the car to retrieve it.

Have you ever tried to get anywhere on Long Island? A 20 minute drive anywhere else can take 1 - 3 hours on LI. Did you even watch the video? I ask because the owner clearly stated this to the police.

reminds me of a story my mechanic told me of a guy who brought their car in, agreed to the estimate, but when it came time to pay and get his car he started saying "no. no. no. no. no. I'm not paying that, it's too expensive." He argued for over 30 mins before being told no payment, no car. His wife came back the next day and paid in full, saying her husband is a cheapskate who does that often - and she had a bunch of designer clothes and a super expensive purse, so they definitely had the money.

To get towed off the highway here it’s $100 hook up and $5 a mile. Average is like $180-$250 for a tow. $1100 is a scam. You’ll come back to a pile of ashes, not a car.

Corporate Transparency Act is one obnoxious piece of legislation. They claim it's to prevent bad people from laundering money.. yet every major money laundering avenue is specifically exempt from reporting requirements. It's crazy that the Act has 23 entity exemptions...17 are directly tied to financial based business (including insurance companies), number 21 is specifically large operating companies (assuming this is due to Inc and large LLC having their own reporting requirements already) and number 23 is inactive companies... 3 of the remaining are Tax-Exempt or exempt support, with the last being Public Utility... So as you mentioned, this doesn't target most commonly used shell companies for money shuffling/laundering, as they tend to be investment advisory companies, so it's specifically targeting "small" ownership/operating companies.

I understand the guy is trespassing but my issue is that this kind of company should not be allowed. Police should have the vehicles towed to a city lot. Payments should be handled there. The current situation is going to get someone seriously harmed. We had a million dollar settlement in Colorado with a company for charging unlawful fees, and engaging in deceptive and unfair business practices. Predatory.

Some states allow this-they’ll use third party towing and storage. If they didn’t get the car for 3-4 weeks, the storage fees add up!

Predatory lending is legal and common in most States . But the issue here is, trespassing is a criminal offense and the towing dispute is a civil case that should be settled in court and not with any police involvement. It's called subject matter jurisdiction.

$1.100 dollars If you can’t get your car off the road before these people pick it up . That’s ridiculous ! They will be making it a business to take advantage of people who have to make arrangements to get their vehicle off the road while they are there ready to pick it up, and give you a nice big bill , for something that would have cost a lot less.

You got $500 per day for fines? I don’t agree with the law, it’s just a sideways fee to engage in commerce, but most people can’t afford to fight. Hell, with $8000 in costs to get in compliance with the law, lots of people can’t even afford to start a small business. Exemptions in the law for big companies of course.

I’m guessing he has a contract with the city to tow any car illegally parked as we don’t know why that car was towed we can’t do comment just as we don’t know if the cops had a reason to favour the guy wanting his car back with paying ( such as being a cop off duty’s or undercover )

​@@jameshead9119most reasonable take. Simply not enough context to figure out this one. The owner kept saying "I paid $1100" presumably to get the vehicle. Paid who? When? Where? Why? Surely there must be receipts if what he's claiming is accurate. You'd think that the cops who always claim "investigation" as an excuse to do anything would actually do some surface level investigations. I'm a complete idiot and that would be the first thing I would ask for on arrival. No records to prove it was legit? Then the car goes out the lot, free or charge. If the receipts are legit? The car stays. Seems simple enough at least to help determine if this is a criminal case or a civil matter. If there's no records, then for all intents and purposes the car is like stolen property. If the records show he legit had a contract to remove it, then it's a civil matter. I don't know how they made this so unnecessarily complicated. Either he has legit claims backed by paperwork or he doesn't. This seems like it should be a very easy case to investigate.

For all you know, the car has been there who knows how long. Also, a lot of states have tow and storage minimums, so the business owner is obligated to charge these prices or they have to pay or are held accountable. Speculation without knowledge of the situation is asinine.

Unless this tow company has legal permission to tow a particular car, screw these guys. They can't just tow cars that are parked along roads. Tow truck drivers are generally about as low as cops.

Not all tow truck drivers... Certain tow companies perform certain jobs... I drove tow trucks for years, and only worked for companies that were tow as needed type thing. Meaning we only towed cars when a customer would call and needed their car towed.. so to say tow truck drivers are all scumbags is ludicrous. I've had many people thought I was the greatest person in the world when I showed up to tow there car because their car malfunctioned for the at the worst time.... Different companies perform different services.. Plain and simple!!!!!

If the police tow your car you will not get it back without payment. They will auction it off after 90 days in most places.
