You see how that's a major and fundamental problem? That the people who most want to be cops should never be allowed to? I am a RN. I have been a nurse for 32 years. On a daily basis, we constantly talked about patient safety first! Even when I was being attacked by a patient, all I could think about was my patients safety first! As a black belt I could have easily taken them down but I used words to calm them down. Not force! From a combat veteran. ( 91 B, 91 C, BSN, RN)

Pennsylvania v. Mimms: So basically, they still need RS in order to claim that it was for officer safety which there isn't any law regarding of such to my personal knowledge, and by you stepping out of your vehicle, it isn't warranted a search of your property which is a further VIOLATION of your fourth amendments rights. So, basically, it's a TERRY STOP when they order you to step out of your car which is why they cant enter your pockets or search your property after you've stepped out of your car. This is why most citizens tend to wait be threaten with unlawful arrest prior to accepting said unlawful order which is ultimately meaningless due to the fifth amendment once ordered to simply be padded down on the outer layers for weapons without violating the fourth amendment. If there is no immediate threat, the officer has no legal claim to officer safety, especially since body-camera evidence and personal recording devices are readily made available as accepted LEGAL evidence against the officer and their unlawful claim to officer safety which is still nullified by the first, fourth and fifth amendment because being DETAINED and simply padded down on the outer layers isn't a violation of the fourth. It's just a detainment, NOT an ARREST and it's a means to check for weapons without violating the fourth but it LEGALLY doesn't lead to obtaining any evidence of a crime outside of said traffic encounter without RS and the burden of proof is entirely voluntary base which is why you never consent to a search after you've agreed without FIRST receiving a threat of UNLAWFUL arrest prior to stepping out of your property. This is why RS will always come into question against the officer thanks to body-camera and personal recording device evidence. The ABUSE of office safety by police will get them terminated from their position due to no apparent threat for their safety and just by the sheer meaningless of it all due to the nature of it ONLY being a TERRY STOP because you complied with or without the threat of arrest while still protected by 1-4-5.

Its time to call the AG of that state and file a complaint against that prosecutor. He literally told her no law was broken and she had no case but was still willi g to prosecute KNOWING AND ACKNOWLEDGING it was an illegal stop.
