@Damian my son was beaten to the point of having four fractures in his left orbital a broken nose also a seizure. Which has since resulted in a traumatic brain injury with seizures. Guess what not a darn thing happen to the office even though my son had done absolutely nothing wrong he was still charged with disturbing the peace an assaulting a police officer. This was after the officer had turned off his body cam and we were told that it had malfunctioned. BS. This officer was also charged with another use of excessive force as well as illegal detainment. The injured party took him to court where he was tried convicted and made to pay $500,000. You guessed it the officer immediately filed for bankruptcy and is still on the force. But this goes even further as my son was bringing me home from the hospital with a broken ankle in three places and surgery. He got me in the house and settled while he went out to get my medication. While he was out he was mugged in the parking lot and was yet again arrested and charged with

Contributing to the delinquency of a minor since the mothers or juveniles. They took off and he was still there when the police came so he was charged and taken to jail. The police officer took him to the sheriff's office and set him in front of the counter and took off her body cam to have it pointing directly at him. Then she took his property that he had just purchased at a vape shop and went around the corner with it and guess what she did not have it when she came back around. She then went to the Magistrate and it was noted and that he was not going to be held on these charges but only had to appear in court. He was then taken into a changing room where he was made to strip turn around three times hold his genitals and squat. The deputy thought that it was funny so made him do it again. That is when my son finally said enough. Next thing you know my son is naked face down on the floor with his arms cuffed behind him and his ankles shackled. From there he and another deputy picked him up one on either side of him, naked, and threw him into a cell with a cement floor. The deputy then charged him with attempted strangulation - felony and also assaulting an officer - felony. He, my son, stayed in that sell for 3 days before he was transferred to a another jail where they x-rayed the right hand side of his head, his right shoulder, his right hip as well as his right knee. He was in the medical department for three weeks and before he was put into general population. I have not seen my son except in court appearances since January the 4th 2022 and in September of 2022 he was convicted of those charges, sent back to jail, where she is awaiting his sentencing on November the 22nd. Talking about corruption? I don't trust police nor doctors any longer and I have found no reason to change my feelings

I did forget to say that because the sheriff's department did have video of this officer and they did issue a check in the amount of 228 to me for the amount of the items in the bag of that she stole, misplaced or sold. Since they could not find it the reimbursement was made by the county to me.

I often wonder why their cameras have power switches in the first place. They are there to provide evidence that may potentially exonerate the officer as much as a citizen. I have heard the excuse that a battery that could power the camera, and the storage capacity would be too big and cumbersome to be reasonably carried by the officers but, I can charge my phone for an hour and it will run for two days and data chips aren't much larger than a human thumbnail.

Except the courtroom is literally the place to determine the legality of the situation. The real issue is that the courts take months to have your day in court and YEARS to get justice. The other serious issues are that the courts give more weight to the word of an officer over another citizen and that the police often investigate themselves when complaints are filed.

I would agree it's suspicious if someone at night is recording (a jail I believe it was) and I too would ask the "auditor" what is he/she doing, just reasonable imo. However asking "what's going on" vs "detainment" is entirely different. Imagine making a typical traffic stop for a tail light being out and getting shot/killed when approaching the driver. And now many use that as an excuse for everything. It's okay when they shine a light in somebody's eyes deliberately blocking their view and deliberately blocking people's ability to film them from a distance but scream "OFFICER SAFETY" whenever you do it to them. Many of them also like to rush up to somebody and get in their personal space but if you do it they again scream "officer safety" 99% of them don't even bother trying to investigate any claims & instead take the caller's word for it, & the only type of investigation they know how to do is demand ID. And instead of enforcing laws they want to enforce people's FEELINGS/COMFORT. And most want to create laws that surround people's feelings and comfort without bothering to actually find out what the real law might be. Because that's going to somehow magically tell them everything they need to know for an "investigation" And when people stick up for their individual rights the officers love to use the threats of "disorderly conduct/obstruction"

It's more of a matter of officers becoming uninsurable over time when the premiums are raised to the point that the officer can no longer pay or the companies have decided they are too high a risk. At that point, no insurance? Too bad, find another job. They will be insurable... but only at first. The key is here that with enough violations, you won't be allowed to be an officer anymore - and that's where true accountability comes into play. Your own actions make it a direct consequence.

Only state I know of that that applies is Texas. Most states require if the officer has reasonable articulable suspicion of a crime being committed, having been committed or about to be committed is sufficient for a detainment and identification. That all said I agree with Tall Diana. Learn the applicable law for your state.

They always forget the “Articulable” part of Reasonable Articulabe Suspicion.” They must articulate the specific facts that lead them to believe you are committing a specific crime.

They don't necessarily have to articulate it in the moment - it just as to be able to be articulated in the police report and to the courts - mind you, I'm not a fan of this, but it is what it is.

The reasonable suspicion must be articulable. It does not need to be articulated to the suspect. There are some practical reasons for this when conducting an investigation but police abuse this distinction by telling you they have reasonable articulable suspicion when they don't and are on a fishing expedition. They know they can make up RAS after the fact, and even if they don't they're covered by qualified immunity. In every interaction, the deck is stacked in favor of the police.

He was trying to speak with enough Authority that he could get this man to cave and wave his fourth amendment rights and then when they sued later said no we just asked he gave it to us. He didn't arrest him he didn't even try to detain him in any truth fashion he even walked away from the man to go talk to his partner after he said he'd been detained. This officer was trying to play him and it didn't work
