I will never understand how cops don't get charged for deleting video footage of these auditors. That alone should be automatic jail time.

Damn straight man. Corruption should be met with serious time, as it undermines the rule of law, justice and democracy. It's tantamount to treason and is worse than say, counterfeiting or identity theft.

@@Stinngerr Then it needs thorough investigation. A cop tampering with and/or destroying evidence is VERY serious, any allegation of such corruption needs to be taken seriously. The camera being out of his possession and the deleted video needing to be recovered, plus that video containing evidence of the initial incident and the following police interactions (including an illegal arrest), is means, motive, and opportunity. Thorough investigation is the only appropriate response.

In my opinion, if a police officer is caught attempting to delete, conceal, or tamper with evidence in order to cover up their own unlawful actions, then they should face the same legal repercussions as a citizen who's committed that same action.

Yes most definitely they should be held to the same law plus a stiffer sentence because he is law enforcement period and should never act or do this. What a total power tripping officer. Misleading title. He was not fired. He was allowed to resign, meaning he's already on a different force 40 miles up the highway

You’re so right but at least it caused him a brief problem. Hopefully, he’s going to learn but my bet is ‘not a chance’! He’ll be the same obnoxious guy there too. They shouldn’t rehire these guys. In Corporate America we used to call this ‘Pass the Trash’! Send them to be another’s problem. Sad, this affects Law Enforcement, not a bad Clerk or Assistant in an Office. This is why you go at least 3 deep when you check references.

There's been convictions with the only charge being resisting arrest. I am *not* justifying this, just pointing out cases I've read about. We have way way too many bullshit laws and have become the exact type of government the constitution ans founding fathers warned about so desperately.

I was on a jury recently and argued exactly as you say, that as no evidence of suspect being informed of arrest was presented, he could not be convicted of resisting arrest.

@@sherryleigh1966 it was an obvious case of police retaliatory overcharging. They charged him with 7 or 8 counts. We found him not guilty on all but two and he was convicted essentially on disturbing the peace. No felony convictions.

One things fir certain, he’ll show up at another department soon. Unless these guys are truly tagged as ‘huge trouble’ they seem to find another Badge. I don’t understand why anyone would sign off on them but someone just seems to continue hiring these guys. I just watched a case that the guy had been through 4 departments & caused trouble everywhere he went & fast, too. Sad. I typically support the Police but these corrupt ones have to go. Until, the good Police Officers & Departments stop covering for them, this will continue. They make all look bad. Unfortunately, one bad act is known everywhere where the good Cops are rarely mentioned which is a lot like everything. Wouldn’t it be great to turn on the News and just one day - have nothing but good reported? That would be such a great surprise & uplighting! Just one day. Is there any News Team willing to do that for just one day? They’d have me a viewer for life.

It also means he can apply at another department and his previous employer can only say "Yes, he worked here." ... Meaning he can get hired somewhere else.

Totally agree. He should have been up on criminal charges for evidence tampering and assault! No matter how rude and belligerent the auditor was it is no excuse for the officer attacking him and illegally arresting him etc... Plus he obviously knew he was in the wrong otherwise why attempt to delete the video footage.

Careful, that actually might be a benefit to the officer. If you quit, you are generally ineligible for unemployment; however, you may have a case for unemployment if terminated. It’d be a long shot since they would terminate with cause, but I could see any little mistake being used to allow for unemployment benefits. Additionally, being fired with cause is simply not a barrier of entry for another police job, as evidenced by the fact that “problem” cops often end up passed around multiple departments, changing hands once they also have an issue caused by that LEO.

Surveillance videos are a bit different than people filming for monatized KZbin videos. People can actually do privacy claims on KZbin videos and they will be forced to blurr their face or take down the video.

I think its important to recall that at 03:15 the employees said "Call your husband", which ends up being the cop that took him down and arrested him. I bet that cop is on a new department now. Maybe even a lateral move as Sgt.

The Sgt is a real piece of work. He’s done this to other people before. He was comfortable in constructing the circumstances so he could apply charges and get some of that street justice so many bad officers like to hand out. Firing alone is too good for him.

The only non-bullshit part of that video title is "cop", although we could make sarcastic remarks about that bit. And this is not the first tabloid-style clickbait title on AtA. I hope this trend won't escalate further. Dunno, maybe he needs another channel for the energy he formely poured into adding annoying video blur filler. I often observe that people seem to have a kind of fixed insanity pool that they feel compelled to live out one way or another. I am not sure about the deep psychology behind it yet, but it's contributing to my worries about current social psychology.

As a security contractor it’s astounding how many of my clients need to be reminded the legalities of filming in public. It’s always awkward when a client orders you to “stop someone’s filming” and you have to instead sit them down and professionally explain why what they’re doing is completely legal.

@@11274reece Honestly, it’s mostly just ignorance from my experience. They simply just don’t understand that public eye=the right to film. Once I explain establishing “a reasonable expectation of privacy” such as installing blinds or even solid perimeter fences that can’t be filmed through they usually understand a little better. But I’ve definitely had clients fly off the hinge at people recording before.

Legality of the action of filming has nothing to do with this bullshit. Instead of finding a productive place in life, these people point there cameras in hopes of a negative reaction. So one must ask themselves, why purposely set out to do things that they know will incite panic, annoy people and waste the time of law enforcement. Looking for trouble and finding it doesn’t make you a hero, it just makes you a dick.

Former security here. And yes, that was most definitely annoying. The main property I handled was split by a highway. So, yes, we owned both sides for about 1000-1500 feet from the highway, the highway itself are well as 10 feet to the sides are public/public use easement. And I had some... unique situations. From a guy stopped within the easement passed out drunk (parked vehicle, thankfully), to people lighting off fireworks in the easement, but less than 50 feet from some gas pumps. Luckily, the property manager had full authority from the owners, and she ALWAYS sided with me. As such, any time I made a call, I never had to worry about being overruled by the property manager. So when she asked my thoughts on a guy filming from the easement, I explained the law. And after that, she welcomed him onto the property and said he was allowed "anywhere a paying guest would be allowed, except within their room without their personal consent". She was easily the best manager I've ever had, even if she wasn't my direct manager.

Believe it or not, that’s actually the point. As a security officer of my own, these auditors act like that on purpose in the name of catching an officer slipping up. The only reason they shouldn’t be allowed to video record anything is if they are ON the private property. Otherwise it’s entirely legal and protected by the 1st amendment right

Dude was 100% told to resign and was referred to another department. Nothing comes from these incidents besides the officer having to pack up and move on to the next community to terrorize. The united states courts need to take these incidents much more seriously and treat police officers like this one with the same swift justice they enforce on every other tax paying citizen. That is the ONLY way we get the bad eggs out for good.

But as shown in the video the guy was within his rights but his disgusting mouth and not letting the deputies do their job, is probably the reason they called for the Sargent. After that guy left and the others took over, whom were much more calm and attempted to deescalate, the guy continued to escalate and be an asshole. There's something called the Peter Principle, which is an observation that the tendency in most organizational hierarchies is for every employee to rise in the hierarchy through promotion until they reach a level of respective incompetence. Once hired, each officer rises through the ranks over their career until they reach this point.

Mr. Roberts gets an F for intentionally instigating a first amendment audit without understanding property law and ownership of easements. It is completely expected that a chance encounter with the police may result in some factual misunderstandings surrounding the law by the auditor in question. However, Mr. Roberts was clearly seeking a police encounter and was fundamentally wrong in the law and the rights it would provide in the specific circumstances in which he was seeking the encounter. While the money Mr. Roberts gets from his KZbin may be a secondary benefit, it still makes him a paid professional auditor and he must therefore meet a higher expectation of conduct just as we expect from the police.

Sheriff departments are highly political organizations owing to the fact that the Sheriff is an elected official. Given this fact they are packed with political hires by the party the Sheriff ran under. The only real 'qualification' for employment is that you vote for that party! I got pulled over for running a stop sign by a rookie cop on her first day, and as soon as I pointed to the display in my Tesla and offered to look at the video, that ticket turned into a "warning". 🙂 I knew I had stopped at the stop sign - it was maybe a 2 second stop, but then there's nothing in the law which specifies how long a car has to be motionless.

To be fair, many laws and policing policies are out of date around the ability for nearly everything to record video now days (cameras, cellphones, dashcams, even cars themselves like Tesla). There should be mandatory training on video laws and best practices - to your point of actually viewing the video and lawfully obtaining a copy of it- for all law enforcement and best practice for security guard companies. After viewing the video in this case, the officers should have arrested the assaulting man in this and the scenario would have never been enough of an issue for this video. Simple assault of a citizen.

Great breakdown on the auditor's behavior. The Sherif definitely deserves a gold star for conducting the investigation and the first two deputies get silver for patience. Firing a member of a public employee union is extremely difficult. In many cases a resignation is best to avoid reinstatement and backpay after an arbitrator decides in the employee's favor.

Look I spent 40 years in law enforcement and private corrections. I took my oath seriously, and never allowed my ego to get involved in situations. I absolutely support first amendment auditors, and it’s frankly embarrassing that cops don’t know basic law and civil rights. I don’t however see the point it literally trying to create confrontation as he did initially by attacking the cop who up to that point had done nothing to insult or threaten the guy. I won’t even try to defend the dumb ass cop who arrested him. It’s just my opinion it wouldn’t have ever got to that point had the auditor not escalated the situation in the first place.

Exactly what I'm thinking. This guy is actively looking for and creating trouble, which he gets. The result? Better policing? No. Dollars out of our pockets and into his. I wouldn't think this way if he wasn't actively trying to escalate with all 5 people he associated with from the very first moment. I have respect for auditors, but not whatever this is. It's within his rights, and legal, but stupid and extremely wasteful of public funds.

Yeah i agree, its also really not good form that the Auditor started mouthing off to the first cop who was trying to de-escalate the situation. He didnt say anything about the charges or anything, was just trying to ask the auditor to chill a bit.

@@nev6502 your correct in your observation about this guy. I frankly don’t know what he was trying to prove. Like anyone else I’m a regular citizen now with a bit more experience and knowledge about how police operate. I like every one sometimes have interactions with police, but i know their tactics and I simply politely refuse unlawful requests unless they escalate the situation. Even then i maintain a professional attitude, which actually has a more effective impact because I’m not reacting the way they expect which throws them off and rattles them. I do inform them of my background and will calmly explain case law about their actions. On the other hand I’ve met fine young officers who really want to be good police officers and want respect for how well they interact. People are quick to file a complaint for bad policing but I’ll tell you that taking the time to make a phone call, or even visit the station to commend a officer can be a great tool in changing the us against them dynamic. Positive feedback often leads to positive results. Having an officer return to the station to hear his supervisor tell him someone called, or came by and talked about how professional he, or she was during an interaction has much more impact than people think. I can remember back when I would park my cruiser and walk through a neighborhood to interact with people, especially kids so they felt a personal connection to me, and established trust that I was there to serve them, and if necessary, defend them from other officers. The number of times my superiors called me in to tell about a positive feedback experience was almost a sign I was doing my job, and I made detective over more senior officers as a result. Even if you merely witness an officer engaging someone in a positive way, and just say hey officer I saw how you handled that unruly person and maintained your professionalism. I’d like to tell you what a great asset to the community you are. You’d be surprised how that can influence that officer going forward. We all are human and want recognition for our efforts. When we get it it’s human nature to want more and it can have lasting positive consequences.

I believe there should be a database both on the state and national level for any officer who has been fired or resigned in an attempt to avoid being fired. Further, along that same vein, I believe there should be a national database for anyone convicted of child or elder abuse.

Exactly....likewise I don't agree with ATA giving the other 2 cops a C grade....it would have been a C if nothing else happened....cops that stand by and do NOTHING while one of their blue line gang buddies acts the way he did....in my opinion....are just as guilty.....and showing how they all stick together....allowing the cop to "resign"...is BS... he'll just show up in another department some time down the road....if they took this stuff seriously, that cop would be fired and never be able to be law enforcement again.

It's to expose the reaction. The way to not deal with the situations, also shows how cops deal with things and that is them dealing with it in violence. They don't care about people's life and future. But they think the people they deal with deserve it, it's just a circle of never ending violence, we humans can move past that instead of reply with "just whip his butt" you need to talk to people and change them, not physically assault them. The fired cop probably went down the road to the next town/county and got on with the PD or Sheriff's office. These guys are rarely held accountable and their criminality is usually swept under the rug.

They let him resign. That is tantamount to approval of his actions. They acknowledge that his behavior makes them look bad, but they proactively chose to do as much as they possibly could to help an officer who assaulted and illegally arrested someone and then deleted evidence to cover up his crime. Allowing a man like that to resign means the people who run that department are themselves like that.

Actually, I took a vid class (only it was film then) as part of my Master's degree (1980s) and we were told FIRMLY by the instructor that we needed people's signed permission to have their faces on camera unless they were just "background". I've often wondered when that changed. Does anyone know?

The reason it is, is because police can detain you for suspicion of a crime, and you have to comply with that. If you resist a lawful detention, even if the investigation clears you of other charges, you still committed a crime by resisting.

The first two cops that showed up where not horrible. Skinny guy was kind of looking for some excuse but the heavy guy seemed like he was just trying to do the paperwork and move on and didn't really give a crap what was going on and wasn't getting butt hurt. Hoping that k9 guy - Morrison was the husband. Can imagine the talk in bed later after he got fired lol... Ass Wife: "Why did you make up excuse to arrest him and mess with his camera getting yourself fired!" Ass Husband: "Well what did you want me to do, if you just wanted people to do it by the book why not let the other cops do it - why call me specifically if you didn't want me to do something to him?" Ass Wife; "uh.. uahh i dono"

Police have to do their job, I agree, and that's what the first two police officers did. When you keep insulting people then things can go south, if he speaks to everyone like this on a daily basis I think he'll live a short life. Freedom of speech doesn't mean you should insult everyone.

I gotta be honest, as a non-American, the way the camera guy talked to the cops and was behaving in general after the police got to the scene was really insufferable 😅 I can't imagine talking to a policeman like that in my country, not because of fear but due to basic respect. I know the police in the US is a different reality, but the dude was escalating the situation by continuing yelling across the field. Nevetheless, the third cop who arrested him was pushing him to do something to arrest him, which is just wrong.

He was insufferable the entire time. While these auditors catch some moments they also work over time to instigate these encounters. He was immediately aggressive and combative and and I bet if we looked at his channel it would be full of videos of him working over time to be overtly aggressive with people to get this kind of footage.

I agree. But it's designed to be a stress test. Put them through the worst so you feel confident they act reasonably all other times. We should be giving them kudos if they handle the situations well. Sadly we don't often get to see those cases

I think it’s one of those things where you live and you learn. The guy who got arrested is young and hasn’t learned how to behave in situations like this. You gotta grease those wheels, not act like a cocky shit. Though he should not have been arrested, he also should not have expected the officers to be very sympathetic to his situation considering his attitude and behavior.

I wonder if Sgt. Morrison was the husband of the Dove Technologies employee mentioned early in the video ( 3:13 )and that he came out to deal with this "personally". As others have said, he should have been charged with assault/wrongful arrest and his alleged evidence tampering investigated with a view to pressing criminal charges if substantiated. Merely allowing him to resign is a complete failure on the part of FCSO to hold themselves and Stg. Morrison culpable.

If they thought he was casing the joint on private property, they shouldn't have confronted him themselves, they should have called the cops. Filming in public is just so creepy. No one likes some random camera pointed in their direction and he was doing it to prove a point that he CAN do it. The problem is, not one wants to watch a video of someone taking a video of a building. They WILL watch a video that ends up like this for enjoyment purposes only. You can tell he HOPES that something like this will happen so he can sue and get some money to pay for a better camera.

@RobJo He has the same mindframe like some of the people abusing the welfare system popping out more kids they can't support so they can get $500+ a kid from the hardworking tax payers each month. He's just out looking for lawsuits instead of women to knock up. I've seen these types of videos before but a lot of the time the cameraman is respectful and more doing it for a learning experience for police that don't know the entirety of the laws they are required to abide by and enforce. This cameraman, however was just a douche trying to break some eggs to find some broken eggs. He isn't for bettering society. He isn't for educating the public or LEO's. He's looking for a nice check from the taxpayers. I don't know how anyone can respect that, but you already know who he is calling if he is ever in an emergency.

@RobJo I agree with you, but there are always going to be bad apples. Whether it's race, religion, or profession, there are always going to be bad ones that give the good ones a bad name. I'm a firm believer in more screening for the police, body cameras, as well as periodic mental fitness evaluations. They deal with a lot of things the majority of society won't ever see. What I think should change though is that instead of the city forking over money for lawsuits on the police that can't maintain their composure like the last cop in the video, the money should come out of their pension or at the bare minimum have a waiver/morality clause in their employment contract that relieves the department from responsibility of the police officers actions if they go off the book or abuse their power, and places the financial burden on the police officer him/herself.

I was against the camera man until the second cop showed up. Wtf was that escalation. The first cop handled his shit and had so much patience. The second guy didn’t even give him a chance to be a piece of shit he just went straight to assaulting him lmao Edit: everyone in the comment section justifying assaulting the kid because he’s a loser and shouldn’t have been there? It’s a police officers job to deescalate, the last cop was very defensive from the get. He didn’t even try. I haven’t finished the video yet and I’m sure there is a bad cop who does a bad thing but right now the guy doing the initial filming is a huge problem. He’s being combative and it’s like he’s doing this specifically to get a rise out of someone hoping they’ll put hands on so he can call foul. No one should touch another person like that but he was only escalating the situation.

just shows how limited your mind is. there is a difference, he asking "can i help you" implements you answering this question: "are you in need of help?" but the other guy answering "no, can you help us?" is more a rethorical question, like "how comes you think you can help us?" that it doesnt sound like that is because the kid suceeded in provoking the big guy, seems like an achivement.

And in retort to the rest of your message, he started by repeating the question "Can we help you?." This is because reversing the question asserts authority, however upon realizing that his desire to reverse the question was just repeating the same words, he rejected the phrasing and tried switching it. However this fumble resulted in asking a question that had the same meaning. Ultimately he should have just said 'yes'. Trying to claim he was turning it into a rhetorical question would make him sound even more dumb than having just fumbled the power grab attempt.
