The law prohibits our exercise of that right as much as it prohibits the officers actions. What you actually mean to say and should say is that the officer had no lawful authority. People enjoy rights. Titles and offices enjoy privilege and authority under color of law. The officer required a warrant to seize the phone or a lawful authority. He had neither. Please don't conflate rights with authority. Government has no rights, people have rights. People have no authority over others, titles have authority. I had the same exact thing happen in Greenup KY when I was 18. I (and am still embarrassed about it) got an underage DUI went to court plead guilty my sentence was time served 2 days, loss of my DL for 1 year and had to complete so many classes. I did all that and even contacted the courthouse /county clerk bc my mom was super adamant it was on me I was finally an adult have to figure it out myself and make payments if necessary. They said there was just the initial fine I had already paid and I’d called multiple times think they got irritated so they said “trust me” if there are any further fines you will receive something in the mail and confirmed my address was still the same. Over a year later already had my license back completed the classes etc. went through a road block and wish now I knew I never would’ve handed over my license. They had me pull ahead to the side and said I had a bench warrant for unpaid fines. Keep in mind I’d never been pulled over or arrested prior or after that initial charge (and never have been since). Come to find out it was a dumb 88$ fine to reinstate my license, which you’d think would’ve been paid at the DMV so idk. Made no sense. But they treated me similar to this. Was just trying to get home from school made one dumb mistake day after I turned 18 and it seemed like I was punished for it 10x over. I completely agree if it’s just unpaid fines they should just suspend your license not take your freedom and cause more fines. It’s gotten so out of hand
