Wait a minute. If he passed the field sobriety tests, why does he still have to blow? Its not against the law to smell like alcohol. He wasn't swerving, slurring his speech etc... The test is there to obtain probable cause for the state correct? You pass, no probable cause. Don't believe they legally had the right to obtain a breathalyzer sample in this case. Hard to find the code online for this.
