Copyright was never intended to "protect" creators. When our founding fathers wrote it into the Constitution (along with patents) they clearly stated it was for the progress society as a whole. Over the years it's been contorted and extended by none other than companies wanting to hold a monopoly over an idea for years past an authors death and lobby congress nonstop to get their way. I have no respect whatsoever for our copyright system.

Yes...but if you have material, a video, movie, written work, or a song of some kind, you want to make money off of, you'll want copyright to keep people from stealing your work and making the money you ain't.

Movies recorded from the movie screens at the theatres, or movies downloaded and illegally sold out of the trunk of someone's car for $5 a piece. Happens all the time. You may not agree with it or think it's no big deal, but it does happen and is very illegal.

Question about copyright registration. If I write the first draft of a book, am I still allowed to register it even though it's only the first draft and likely to change. And let's say I do copyright the first draft and then go in and revise the original story. Does this mean my copyright is null because it's not the exact same story that it was when I initially got the copyright? Do I need to apply for a different copyright if I want to protect my second or third draft? Will I run into legal issues with myself?

Copyright is automatically obtained by simply fixing your book (or draft) in a "tangible medium of expression" like a printed page or digital file. You don't NEED to register it to own a valid copyright. But the United States and some other countries still permit registration. If you're really worried about possible scenarios like someone hacking into your computer, stealing your draft and publishing it as their own work, or someone coming up with a very similar book idea between the time your draft is ready and your book is published, then registration is a good way to prove your ownership of the copyright, or the fact you came up with the idea first. This is probably not something that most authors need to be concerned about, though I suppose if you're one of the top authors in a particular genre, then that would make you more of a target and taking additional steps to protect yourself and your draft may be a smart move. Anyways, I think the basic copyright registration fee in the United States is $45, so I suppose you need to ask yourself if it's worth it to you.

I'm no expert, but I think you can register updates of the same work as many times as you want, as long as you pay the required fee each time. The government is happy to take your money. :) I know that some authors and publishers register every new edition that comes out of a popular textbook, for example, so I'm reasonably certain (but don't take this as legal advice!) that it is possible to register an early draft and later register the published final copy. This will not negate your copyright in your earlier drafts or editions. Technically a new edition or final copy is a "derivative work" based upon earlier versions of the same work, and I know that you as the author retain copyright in all versions of your book.

Here is a solution to the copyright problem. Instead of selling games, music, or movies the conventional way, treat them like publicly funded projects. Set a goal of how much money you want to collect before you release it, then when you have reached the amount of money, give the people who funded your game, music, movie etc a free copy of the product, and from that moment on, allow anyone to copy it. I don't guarantee that such a system would work, but if it did, people would love the person who employed such a system.

Afegoiuh Oiuahsfe My one problem with this is that it would cause a lot of problems making and consumer wise. 1. People don't know what they want until they have it. It is a strange idea but to be honest it's true. There are a lot of things that people like that most wouldn't think they would. (Bronys are my biggest example) 2. Consumer fraud and unhappiness is very likely to go up as we have seen from kick starter. If you give money to a project before it's made you're not entirely sure what you are getting. It might not end up being a great as you would think. Also what if you give your money away and the project doesn't happen for any number of reasons? That would be consumer fraud under the system you are purposing. 3. New works would be shunned. New works would have a harder time getting green lit with your idea because if something is a squeal or based off of something already made then you are far more likely to get money for your project than an original idea. 4. This doesn't fix the fan artist effect that is often a problem. Sure the work is public domain but so is any work based off that work. No one is going to give money over to a fan artist or fan fic writer through your system. We would end up working for free anyways. 5. This only works for media and not any type of physical product. There would have to be different rules for products that would involve copyright. 6. No stability for artists. Under your system once a product is released there is no longer any money coming in. So meaning that the artist immediately has to start again which can be exhausting. Where an artist could make money while trying to come up with a new idea or taking some time off to think of other things while their project generates money the artist would have to always be working which can be emotionally and physically exhausting. 7. Why pay? Sure you could pay for this thing but I mean I don't really know what it's going to be and if I just wait surely someone will fund it and I could have it for free then. This system fixes none of the problems that we have in current copyright. It would kill artists and the art industry.

I realize this is an old comment, but in case my reply is still helpful to you or anyone with a similar question, I'd like to respond anyways. Copyright protects the specific expressions of ideas and facts, not the ideas and facts themselves. Simply paraphrasing or rewording content from a psychology website is NOT a good idea because it leaves intact much of how that description is structured and arranged. This is part of the copyrighted "specific expression" of the concepts explained on that website.

What you should do is try to explain those facts, ideas and concepts in a completely different way. If you're not sure how to go about this, my suggestion would be to write down a short point form list of facts and concepts from that website that you want to cover and then ask a friend who hasn't read that website to help you arrange them into a coherent and logical description. What matters is that someone who is familiar with both your book and the website wouldn't think you plagiarized the latter. Plagiarism is one of the worst things any author can be accused of doing. Authors who have been caught plagiarizing have seen their careers ruined, so it's important to avoid it.

A very basic and simplistic rundown of how the system was to ideally work, but has no grounding in the real world where copyright is often abused for the excessive profit of the holder in both/either money and/or power. Nor does it touch on how outdated and difficult the system can be for content creators. Finally it ignores how the cr system has enabled holders to sue for grossly inflated damages and disproportionate penalties for even the most minor and generally harmless violations, often made all the worse by an automated system that makes little to no distinction between fair users, violators, and on occasion the owners themselves.This problem can be theoretically illustrated with Lets Players and the Soundtrack holders. The LPer is producing work based off the Game owned by A-Corp, A-Corp made their game with the song from B-Corp, B-Corp then strikes out against the LPer for uploading a video of a media that they do not hold in which their work was legally procured to be included as a transformative work. B-Corp is trying to claim that their ownership of the song is greater than the LPers commentary and presentation on top of A-Corps ownership of the transformative work that is the game. That is wrong. B-Corp is suing under the claim that their material was used by at least two degrees of separation by transformative work, the first of which they sold licence for A-Corp to use and redistribute the work in its transformed state as they see fit. It would be different if it was just the song cleaned from the game without commentary or any other significant alteration that removes it from being the very centerpiece of the video, but in this hypothetical it is not. It is just a sound data recognition program designed to dredge KZbin for matches, clear those that are held by green listed accounts, and flag all other matches regardless as to the viability of the claim.

+BrinosaurasGaming Thanks for checking out our video. There's actually no “rule” that says you have to post permissions that you receive. However, if someone tries to claim that your video is infringing his or her work, then having the permission posted may help you fend off that claim. If that person goes ahead anyway and demands that KZbin take down your video, then KZbin will need to see the permission as part of your request to put the material back up. As to one more detail, we’re not sure what you would link to - a copy of your written permission from the proper copyright holder? If the grant of permission is clear, then that link would probably be a good step to showing your good faith. As to what happens after the notice and take-down process (which the law requires), that really depends on the nature of the claim from the alleged rightsholder, the nature of your alleged infringement, and the validity of the permission that you have received. We'd suggest starting with KZbin's help pages to learn about what KZbin might do if the whole process starts.

Tom Bruce Perhaps both. There are degrees to which "rights" exist and people can respect some of what has been established by law to be a "right" but not others. This video muddies the water because there are some "rights" granted by law that they don't care if theirs is respected and don't respect that particular right for others, but the video acts as if it is all or nothing. It also does not cover or even reflect the history of copyright.

+Constantine, If the producer in fact is the copyright holder, then it sounds like you have written permission from the copyright holder to do that which you asked to do with the producer’s music. So as long as you act within the scope of the authorization granted (which it sounds like you’re planning to do), then indeed you’ve done what you needed to do - respected copyright and obtained a license, with little fuss.

LOL. Actually some teachers make it a class requirement to watch videos like this. The thumbs down are simply reflective of certain students expressing feedback about the fact they were forced to watch a video about a "boring" topic when they could have been playing video games instead. 12 year old pirates don't care about copyright law and certainly wouldn't choose to watch a video about it.

Nobody's going to argue that the creators of works shouldn't have the right to make money, but the problem is that company's are the people who let copyright get out of hand. For example, Bugs Bunny has cartoons in the public domain - public domain means that its free to reproduce for any person in the PUBLIC - yet you are not allowed to use those Bugs Bunny Cartoons. Thats right, Warner will claim that Bugs Bunny the name, the image and the voice are trademarked. We Need To Limit Copyright Now!

If the songs have unexpired copyright, then they're still protected. The making of derivative arts requires permission from the copyright holders.

No. You NEED to get permission to make use of an image you come across on Google unless: (1) the image is in the public domain or, (2) has been released under a Creative Commons license that is compatible with your intended use, or (3) what you intend to do with the image falls under "fair use" (but be careful here because some people mistakenly believe certain uses fall under the fair use copyright exemption when they really don't).

Hi guys! I have a question. Is there a method of how to get back a suspended KZbin account? If yes, HOW? :) One of my accounts was suspended by no reason! I didn't have 3 copy rights there, but I had 3 on another account, and because of that they blocked both my accounts. Is this fair???
