Again, another great video, Col! As a designer myself, I've always handed over work in good faith, and never had any issues with copyright. However, since I am now a registered business, I will be adding a transfer of ownership certificate to complete (and fully paid) design work in the future. Thank you very much!

If you were to use someone else’s character without their written permission you will be breaking copyright law. You should always use original artwork where possible. If you want to use someone else’s artwork/design/character you must get their permission.

You can do a reverse image search using Google (www.google.com/imghp?hl=EN) click on the camera icon and upload the image that you want to check. Or you can use the website TinEye - tineye.com/ Or you can also use the WIPO website (www3.wipo.int/branddb/en/#) which will let you check if a logo design already exists as a registered trademark. You need to click on the image tab, drag in the image you want to search and then choose Concept or Shape as filter options. I do a separate search for each usually. Hey Faylax, The process can be different in each country due to differences in laws and the systems used. I'll create a video on how it works in the UK if you want to register the logo yourself. I don't imagine the process differs too wildy around the world. It is always a good idea though to consult with an intellectual property lawyer/expert as well to make sure you don't miss anything out or make a mistake. I'll cover that in the video too.

The designer can release copyright to you verbally, but for absolute peace of mind, I would definitely want something in writing from them, even if it is just an email from them confirming that they have assigned all copyright ownership over to you.

In a lot of countries, as soon as you create a piece of work, you own the copyright. However, in other countries you will need to complete some forms. The sad truth is that even with copyright, some people will steal, but if you can prove you are the original creator, that will help you if you needed to take legal action.

great info! i am using fiverr to get a logo designed and the designer is charging for transfer agreement copywright. Is that something designers typically charge for? Also, is this the same as IP assignment agreement?

Just something in writing from the designer/artists that states that they are assigning the copyright over to you with their signature and the date of transfer. Hey Anastasia, the laws from country to country are different, but from what I know, when you create an original piece of work, you are the copyright holder. In some countries, you need to complete some forms to legitimise this though. I am hoping to do an interview with a copyright expert in the near future to put onto the channel :)

The longer you leave registering a name or logo, there is more of a chance that someone else will register the name or logo design before you. This would mean that you would have to then change your name, logo or both.

Hi Sandeep, I'm not sure how Copyright works where you are, but here in the UK, as the creator of any piece of work, I automatically am the copyright holder. i don't need to complete any paperwork. If a client is paying you to create a piece of work then generally you will pass the copyright over the to the client.

Great question! Ideally there would be documentation in place with instructions in what to do in that event. If there were no direct instructions, i would imagine the copyright would then belong to the designer's estate.

Estate is the term used for everything that the designer owned. Property, money, intellectual property etc. This would all usually be passed onto a family member following someone’s death.

It really depends on where you live. For example, here in the UK and in the USA, creative copyright is automatically assigned to the creator of a piece of work. So you don't need to fill in any forms. The only time you would need to fill in forms and pay a fee is if you want to register your logo as a trademark.
