Copyright vs trademark is one of the common questions I get as a lawyer. Most people ask what is a copyright/what is a trademark -- when the REAL question is "which one is BEST for me?" So in this video I break down copyright and trademark so that any entrepreneur who wants to protect his/her intellectual property will understand how the differences between copyrights and trademarks can work in their favor.

I believe that, in all honesty, I may need both. As an artist I'm going to need to trademark my logo/image (I've been ripped off a lot as an artist, folks like us creative types tend to lack the where-with-all to protect ourselves legally!) and then copyright my art and cartoon characters so's that I'm covered when it comes to the use of my art and concepts. Great video, I loved the lighting, background, your makeup/styling, the editing and sound quality! Very well done IMHO!

Hi Taren. Thank you for your insight on trademark and copyrighting. I know that I can't have the right to words. but I would like to have rights behind the narratives that I make behind a word. Sometimes I will create a whole culture behind a word with a color, animal symbol, and its own core values. How should I go about owning the rights to the creativity behind the word, so that when I present them to certain places, they won't adjust my creation? I hope all of that makes sense.

Thanks for the video. You confused me a little bit. You said that logos and slogans can be a copyright and a trademark. Is that so? And if branding is a trademark, why are all companies writing at their website bottom "copyright all right reserved"?

Branding is a trademark? I'm not sure that I'm following the question. Branding is the act of creating assets that can be used in a business to help market that business and create an identity in the marketplace. Branding is an action. Trademark is a legal device/tool that business owners use to protect their brand. Is this helpful?

Hey Taren, great information. So (for example) I researched the database and found a trade mark for a logo design with the words "dragon energy" ( think this is an energy drink in the US). Does that mean that mean if I printed a T-Shirt with the same phrase "Dragon Energy" on it with different artwork and font, that I'd be infringing upon the drink company's trade mark, or would it be ok as it's un unrelated industry?

What if someone tried to trademark "Star Wars Automotive Repairs and Services"? Would Disneyfilm summon their lawyer army? Also, if copyrights are automatically protected upon creation, what's to prevent Disneyfilm's Lawyer Army from trying to stomp a rights holder in bankrupt submission? Disneyfilm wouldn't win (allegedly), but they can use their bottomless coffers to eventually ruin another's livelyhood.

Depends on the type of protection you are seeking. Copyright is a very different legal device than trademark and both have their unique purpose. Did you download the PDF in the link?? That will help.
