Question. Nike trademarked “just do it” can inuse the phrase “do it” which its not entirely the trademark?
@trademarkfactory11 ай бұрын
I'm assuming you are referring to a trademark in the same classes that are taken by Nike. No, you can't because "DO IT" would be fully contained in Nike's registered (and well-known) trademark.

A quick sum up: it's too hard to file yourself, let us do it for you. That's all you need to know. I checked the website. This is only for those expecting to make 6 figures within 2-3 years.
@trademarkfactory3 ай бұрын
This is an accurate summary. Also, you probably don't need a trademark if you don't expect your business to generate at least 100k 2-3 years after it gets started.

Hello Andrei, thank you so much for this video, I am building out an entire fantasy/sci-fi franchise from the ground up with characters, locations, maps, storylines, backstories, etc. Do I need to trademark every single detail of the franchise, hence paying a fee for every single thing I trademark? Or do you know of any way to encompass all matters of this franchise I am building under one trademark umbrella? Cheers!

Short answer: you can't Longer answer: you should prioritize Almost full answer: you should prioritize based on which of the brand elements you would hate to lose the most, and start there. Best answer: jump on a free call with one of our strategy advisors. If needed, they'll share the convo with me and I may step in and help from there.

I’m creating a startup marketing/advertising agency LLC.... can I trademark my name and logo, then register my business under that trademarked name and logo or vice versa?
@trademarkfactory4 жыл бұрын
Hi Gabriel, Yes, you can start with getting a trademark to protect the brand and then build whatever legal structure best fits your business needs. If you are planning to get your brand trademarked, I suggest you jump on a quick call with one of our strategy advisors to see how we can help.
@gbaby6194 жыл бұрын
@@trademarkfactory thanks! One more question if I may. Can I trademark the brand name and logo under my name before my LLC is formed, then use it for my business after it is registered? Or would I have to transfer it over to the LLC’s name before using it?
@trademarkfactory4 жыл бұрын
@@gbaby619 You can file it in your personal name, then form the LLC, then license the mark to your LLC for your LLC to use. You can transfer it to your LLC at any point in the future, but it's not mandatory. It can continue using the trademark under a license from you personally.

Good Andrei. Do u know about the McDonald’s story in Australia. Burger King operates under the name “Hungry Jacks” in Australia. They successfully registered the trademark BIG JACK in Australia for hamburgers. McDonald’s had their guard down and didn’t even oppose it. Now McDonald’s is trying to get it removed in federal court.

Just came across your videos, so apologies if answered- what is your opinion on all these trademarks that are common words or phrases? That don't actually represent a brand. Seems like theres a frivilous trademark problem..
@trademarkfactory7 ай бұрын
It's hard to imagine a more common word than "APPLE". Yet, it's one of the world's most valuable brands. And totally not a frivolous trademark.
