I have no legal background, but if you're restricting access to the public's resource, it sounds an awful lot like a "taking" situation from a legal standpoint.

Looks like trespassing a little bit. Technically they could put up a 15’ high fence that touches their neighbors 15’ high fence and nobody would be able to touch the fence or destroy it? I wonder if anybody else is expected to just give away a piece of their land. I mean nobody would appreciate people walking through or over their backyard. Just depends what side of the fence u r on
