Yes, typically an estate has to pay off all debt at the time of transfer to her daughter (Probate, I'm sure they had a will) and they certainly would not have waited so long to collect MILLIONS. This is the exact situation when a Deed theft could occur since it's the law to notify the public as you said, and weirdos come out of the woodwork making all sorts of claims (long lost "relatives" etc) to collect money. For company did not admit fraud but said they are choosing to end the matter because it will have to go to court in several states including Florida where the supposed loan was made. The property is being taxed at a value of $54 million which is outrageous. All of Whitehaven isn't worth that. That area is a no-go zone especially at night. Steve Lehto KZbin channel has better information. Apparently the lenders produces a notary certified document for the loan. The Notary attributed to the document says they didn’t do this transaction. They certainly would have remembered LM Presley involved in a signing. Also, proper identification is required and noted by the Notary. Apparently there is no corroborating evidence to the alleged loan agreement

The local governments can't be bothered to verify changes in deeds. A lot of this has happened in Las Vegas especially during the great recession. Not only that, we have a largely uneducated population here that sadly are all too frequently scammed in many different ways including theft of property through fraudulent means as this example demonstrates.

Congress needs to step in and change the way documents are recorded on the county level for all states -thereby making recording any claim or deed against a property much harder without verifiable proof for the reason to file any document against a property - County recorder offices do not police when recording documents therefore can't stop a fraudulent document from being recorded. Another BIG issue is that Tennessee is a non judicial foreclosure state which makes filling a false foreclosure MUCH easier. IF you own property - you need to set up a county level alert on their website notifying you of any document recorded against your property at anytime.

I know of an incident like this. I learned from my lawyer friend that deeds and title are public record and anyone can make copies and get new home loans without the owners knowledge, foreclose and the owner loses their home. All home owners should be notified when someone other than them wants to look at and make copies of their deeds and titles. Period. Meaning IDs need to be shown, etc.
