I agree, but California’s eviction moratorium runs until July & it’ll probably be extended beyond that. And even once it’s lifted, the courts will be so backlogged that it’ll take years before the case gets heard. These folks may not get to live in their house for a very long time.

This is real estate fraud. At this point, I would declare the house sale a loss. Instead of trying to move in, I would take him and his real estate agent to court for real estate fraud to get back the amount of the down payment and the mortgage you paid for. As a property manager myself you can force any squatter out in any way in the first week, after a week or two they basically “legally” get ownership rights in a way and it’s a legal nightmare from then on that takes months and makes you want to burn the place down and just collect insurance money

As a real estate agent, this is why we insist on being sure there is a checklist. What about a final walkthrough prior to closing? That would have confirmed and verified the previous owner vacated the premises. As soon as closing papers were signed and the mortgage loan was funded, the new owners could have changed the locks immediately. Never close without a final walkthrough! It should be beyond an eviction at this point. This man should be arrested and physically removed from their home!

I actually feared this. I bought a home in Texas and the pervious owners had not communicated with me at all about their move out or wanting to do a lease back. I arrived at the home Friday night before our closing Monday. They had not packed a single box. My realtor said they legally still owned the home and they technically did have to be out of the home. The home was still packed with their stuff. I grew concerned and told my realtor I would not sign the closing documents without a final walkthrough the day of ensuring they were out. The previous owners were livid at me. They had to pack an entire home by themselves in two days. There realtor would help them pack, and I would later learn they did not have money for movers nor truck. They literally took the light bulbs out of every light. Left me trash, broken furniture and a weight set....Parts of their RV septic system. They did remove the bulk of their stuff. I signed the documents, as it was bad enough to notice but my lease was ending on my home. I fully believe they were not planning on leaving either out of a necessity or simply didn't care about my needs.

In California if someone lives in a residential for more than 14 days instantly becomes a tenant. You need a court order to evict tenant if he refuses to leave. Seeing as he lived there for years before selling he's covered by tenants rights. Courts aren't evicting anyone right now.

Nothing a black eye won’t fix.... I delt with this exact situation a couple years ago when buying my house. I called the police and they said there was nothing they could do at the time, but after they leave if I was to force my way in and just happened to be attacked by the previous home owner I would be able to defend myself without prosecution. Guess what? I had my property within 24 hrs.

Before the video, I thought the squatter was a random homeless person. The squatter being the previous home owner makes this 100X worse.
Two years ago, during the closing of my house, the real estate agent, the owner and myself found squatters in my soon to be house. It was a young man and his girlfriend. They said they rented the house from someone on Craigslist. It took the owner a month of going to court before the marshals finally came to get them out. Even though he was a scammer, squatters seem to have more rights than the home owner.

@@JoshuaBd yes, I agree! The squatters had the nerve to try to blackmail the private detective that the owner hired to look into who these squatters were. One day the detective knocked on the door to talk to them. They told the detective they would leave for $3,000 if no money is given, they're staying. Even though they were squatters, I did feel bad to see all of their furniture eventually put out on the street.

Well technically it’s not the realtors fault. The owners HAVE to be the ones doing the final walk through. If they weren’t the ones that did it, then yes the realtor should be held accountable for not telling them that they (the homebuyers) need to be present at the final walk through.

I hope they've spoken to an attorney about suing the squatters for a whole host of damages. Let's start with all the back mortgage payments, utilities and I'm sure there is damage to the house. They should also sue the "great" state of California for allowing this to happen, no matter the laws. Heartbreaking that the law didn't support them.

@@maribenzo9881 I have actually dealt with these exact circumstances for work and this is what is actually legally recommended in many cases because there is no risk of trespassing involved and much easier to have outside parties such as water and power companies acknowledge you as the rightful owner especially with the proof that family would have. It’s 100% legal and even if they were to have a lawsuit brought against them by what would be the former occupants the case would most likely be dismissed or the squatters would lose.

Car theft, and even less, evidently is more of a crime and treated as such, than stealing a home. Homeowners should never have to endure these long drawn-out stress inducing and expensive sideshows. Situations like this have their complications, but one party can produce legal recorded documents resulting from the transfer of the property, and one party ... cannot. However, as in this case, it's the legal owner that can't step foot on the property. How can we in 2021 not have an expedited, as in days not years, process to resolve this matter. Clearly the previous owner sold the property. People such as the new owners need a working legal system.

Well, that's the problem. They own it...they signed the papers, so they're on the hook for the mortgage and monthly payments. They might be able to sue after the squatters move out, but that would also be drawn-out and painful. The Sheriff's office is not being as creative and helpful as they could be. If these folks were influential politicians, the Sheriff would have figured out a way to get the squatters out by now. And yes, the occupants will probably damage the home out of spite.

He no longer owns the house but it is where he was legally living when the eviction prevention law went into effect, apparently that means he's covered by it.

@Macy Dove: Guess we'd have to see exactly what the California version of the law says and when it went into effect. The new owners hadn't moved in yet so maybe for the law's purpose he can't be thrown out. I also think there may be something here we haven't heard about.

It sounds like they haven't actually tried to legally enforce anything. They just keep going over there and arguing with the guy. So maybe if they actually tried the procedure to have squatters removed, it would work. I don't know.

I've this one video were a couple decided to rent out their EXPENSIVE beach house and some guy decided to go and squat in the house, when the couple asked him to leave. He refused and now the guy is pretty much squatting the house, and there was video of the house pretty much filled with Junk, and trash, the estimated damages were around 5 grand

He should be charged for 14 months of back rent, damage to the property, falsifying documents and anything else they can think of. I personally would of gone thew the window if the front door wasn't an option and force him out.

When selling a home, if all i's were dotted and t's crossed, he's trespassing if the house is sold. I'd have sale of house canceled as he didn't vacate and he can now be responsible for all payments, including the ones he fraudulently had this couple pay. Outrageous.

I agree. Cancel the contract. The eviction law does not apply here; he willing sold his house. He is obligated to deliver. He has broken the contract.

they have to continue to pay..sometimes if you stop paying the "tenant" could start making missed payment for property taxes and utilities and than things become even more messy about who "owns" the house.

@@SR-hl5vz Maybe have the new owners shut the utilities. Tell the company you need to do that In order to switch the accounts into the new owner's name..Tell utilities company you'll contact them to turn on the tivities as soon as they move in.. Maybe that will work ask the lawyer.. good luck folks

@@georgeplagianos6487 Doesn't work, companies who even bother to ask for documentations of "proof" cannot actually prove anything. Most claim they require it, but it's been shown you don't always need it anyway, and even when you do, you can fake it and they can't prove it regardless. It's happened MANY times and complicates things even worse because most of the times they forge the actual owners name anyway and get things turned on and don't pay, so the companies immediately go after the actual owner, not the person in the house.

Good luck with that. California has an eviction moratorium until July & it’ll almost surely get extended. But even once it’s lifted, the courts will be so backlogged that it’ll take years before the case gets heard.

@@D.A.B1994 You can. Just gotta do it at the right time when nobody is looking. Then, if that squatter calls the police, you'll already be in the house WITH the deed and ownership paperwork. The squatter would instantly be looked at as just a random homeless guy/girl. 😂 There's ways around it... These folks just don't understand how.
