OUTCOME: After the state spent more than 450 hours (and our tax dollars) defending the juvenile court judge's decision, the appeals court ruled in favor of the family reaffirming a parent's right to have an attorney and be heard at these hearings.

Nothing is wrong with that. If you are accused of a crime, you need a lawyer to fight for your rights. So, are you going to refuse one just because he/she represented someone who killed their child. If you do that, have fun in prison even if you're innocent.

@D Smith Your rights are given up the moment you hire an attorney. A Fourteenth Amendment citizen (aka U.S. citizen) doesn't have rights, only "privileges" granted by Congress. Codes are for those who don't know who they are and the law. Its no different with police, they enforce codes, not law.

We elect our officials we give up our sovereignty to them. Since we do this through A swindle at the hospital that contracts us to the citizenship, at root we're dealing with fraudulent contracts and where the scapegoat to these administrators. it sets a very dangerous precedent moving forward and in no time should this ever be allowed or accepted by the people under any circumstance.

So being that a misrepresentation of the man and woman is being propagated in court and bad faith through a swindle they're all dealing in human trafficking and we the people are the scapegoats and victims as well because we don't understand the contracts that we've been swindled into since this is done at birth through bastardizing the child and using the mother's maiden name. They declare the child abandoned and the state takes custody and we're only given legal guardianship. That's why when there's a custody case both parents have to actually file for custody to prove that they're fit to be guardians and to have the child released back to the parent. I was the mom who endured this horrific abuse of child protective services and a terrible Juvenile judge in Coweta County. I will never forget sitting in that court room that day and it was like a million tons had been lifted because of these amazing judges and amazing attorneys who actually stood up for us and knew our children were stolen from us by these heartless social workers and judge! I can’t thank them enough, and I will tell everyone it’s been almost 8 years and my family is still happy and together thanks to them! It’s gut wrenching knowing that so many people are dealing with the same issues we had, and aren’t able to get the help they deserve. Thank everyone for your support and amazing comments! For anyone who is enduring Gov. entities intruding into their lives and telling you how to live and controlling every aspect of your life while using your children as bait please do whatever it takes to hire your own lawyer and not one of the good ol’ boys that currently work for the county or city that you’re currently dealing with cps or Juvenile Court at. There is a light at the end of the tunnel, you have to learn how the law works and do whatever it takes to save your family from destruction, because that’s what almost all case workers and juvenile courts will do! The problem is they have sovereign immunity and can’t be sued or arrested while they’re under uniform rules. Just please learn how and why the law works and you will win!

Unfortunately, I have to disagree. All parents in Georgia signed their children over to the State whenever you go to a State ran hospital, register your child with the state, and get a “Birth Certificate.” People need to read. What is is a “Registrar?” It all has to do with Deeds and Titles. Parent gave the State the legal title to their children and in exchange to equitable title. When you go up against any of the “agencies” they are using Administrative Procedures under Color of Law; basically contract law disguised as Equitable Law.

@@bobsaturday4273 The Judge left the children with the parents 6 months. This mother did not look or act like an addict as she sat in front of 3 Georgia Supreme Court Appellate Justices. Obviously, at the onset of this case by every other standard of CPS, these parents provided food, safe housing, clothing, education, healthcare, emotional support, did not put their children in imminent danger or did not neglect their children or the CPS would have removed them the day they came out to investigate and the Judge would not have ordered the children to be able to stay in the home 6 months with their parents. This mother should not have been denied her voice in representing herself or the choice to be represented by legal counsel before these legal proceedings took place -another court date should have been set, since the parents obtained legal council and these children were not in immediate danger. As the attorney for the mother pointed out and I can only image, being a mother myself, the children were traumatized, and in my opinion, kidnapped under the guise of law-the reason for the righteous indignation of these Justices. So Glad to see at the end of it, that this family is still together and that we have God given rights and Constitutionally minded Justices on our Georgia Supreme Court, instead of opinionated ones who make up their own code of conduct standards for the rest of us.

@@karltrombley5572 No, it isn't. As is often the case with SovCits, you've never actually READ your own citations. What that code is stating is that the term "united states" could refer to, among other things, a federal corporation. It doesn't mean that the united states isn't a country; especially since the EXACT SAME citation also lists other definitions and entities that the term could apply to. You read a few words from a cherry picked section of law, then try and apply it without context or education to everything, without any understanding or care when or how it applies. This is why you shouldn't get your legal education from youtube videos. It's especially laughable that you'd try and use the US code to justify your nonsense when the very same US code indicates that "person" and "human being" mean the exact same thing, even though part of your argument is that the word "person" refers to some kind of fictional strawman. You don't know anything. About anything. And that's why you get everything wrong.

Children are being traumatized by Children's services across the country because they are being unnecessarily removed from loving families over unfounded allegations and trumped up charges as well as omitting pertinent information. And as in my case and thousands of others who do not have the ability to afford a paid attorney or anyone to attempt to fight cps. It is a damn tragedy that this is allowed to happen.

This is what 'civil discourse' is supposed to be. Clearly the state's attorney knew she had a weak position going in, but it's her job to argue the case. She didn't resort to lying or name-calling, or whataboutism. The judges, while clearly unimpressed with the arguments presented, still congratulated her for her conduct, her professionalism, and her presentation. The court's ability to separate the facts of the case from the presenters is sorely lacking in political and social discourse. We need more of this.

Once you learn the procedures and how the system works, then you only need to look up relevant laws and cases and see how it applies to you. The thing is, you better be sure that you are 100% innocent or the system is going to fuck you. There's a video online uploaded by Michael A. who explained how he learned the system and used it to keep his kids in California decades ago. Lookup "I arrested the Distrixt Attorney".

There needs to be more, much more separation of the judicial branch and the prosecutors. Just like he said at the end, the state’s attorney was in the same building. That alone makes it seem they are on the same team and it’s the people against not only the prosecutors but also the judges. State attorneys should not have their offices in the courthouse and prosecutors should NEVER have private meetings to discuss a case with any judge. Yet it happens ALL THE TIME.

That's why it's my opinion that a fair and impartial trial is impossible in the US anymore. The judge, prosecutor, cops etc. are all on the same team while the individual is alone without friends. It's worst at the lowest levels on the system. The cop, prosecutor and judge see each other on a regular basis and we all know familiarity creates biases. Family courts are the same. DFCS is too familiar with the judges they argue before which leads to a lot of rubber stamping and running rough shod over the people.

Judges are lawyers but are JUDGES FIRST and can NOT switch roles to playing Attorney against a defendant on a whim because their temper or frustration interferes. This is absolute LEGAL proof (since it is now a transcript in a legal proceeding) that Judges DO make EMOTIONAL commands and orders outside the jurisdiction of the law and people and CHILDREN get hurt. The state's counsel sure is trying hard to portray the judge's statement "its me against you" as somehow being acceptable. When the middle judge asks her how she would feel if he said that to her, he should have added that how about if he said that to her while also having her children as ransom. Quite a big difference.

The states attorney is full of shlt when she said the court can do whatever it wants after a finding of dependency exists. The law requires the court to hold review hearings to familiarize itself with the progress of the children concerned and to ensure the parents full rights are respected and enacted. In fact, when I was erased from my child's life, there was not even an allegation that I had harmed or endangered my child in any way. Absolutely! This is our case and it took almost 2 years for the process to be complete and to have Judge wyantt overruled by this court. I remember sitting in that courtroom and hearing these amazing men speak on behalf of us and I literally cried the whole time! The best part of this is now in the state of Georgia we can sue all Gov entities who have sovereign immunity from prosecution, whenever they overstep their oath of office. This also changed the juvenile code as well. It was the biggest nightmare of my family’s lives! In the end we’re still together and a lot stronger and smarter and the laws are for the people not the government in juvenile courts. This should be the way all state courts handle juvenile cases.

@patrickhenderson6932 I also went through HELL with Coweta County DFCS! I was falsely arrested! After sitting in jail, and bonding out, all charges were soon dropped. I had parenting classes, drug tests, and metal health evaluations (where I was treated terribly), and finally went in front of the judge, he reprimanded the case worker and gave my daughter back immediately with the order to close the case and I did not need any further contact with DFCS. The case worker stomped out of the courtroom so angry that my attorney was blown away. I thought it was over...it wasn't. One afternoon a month later I received a phone call from DFCS telling me I must be at their office by 5:00 that day. Like a naive idiot I went with my daughter. I was so angry, I don't even remember why I was asked to be there. I only remember that I gave the case worker a piece of my mind, telling her it is traumatic for my daughter and I to have to continue being threatened to be at their office and reminded her the judges order. The next week that case worker went to the judge, got an order, showed up at my nice home where I was packing to take my child to the beach for vacation and took her away. I had to pack her clothes, and in doing what was best for my child, I did not yell or protest. I had tears rolling down my face, but didn't let her see me upset (they used that against me). I packed her nice clothes, but she was at an age where she had these ugly outfits that she loved and so I packed them for her comfort (they used that against me, leaving out the nice Polo and GAP outfits out of the documents. They notated that I packed the ugly outfits, like those were her only clothes). The police were there and a few days later I came home to one of the officers outside my apartment where he apologized for what he had to do, and agreed with tears in his eyes, that it was wrong. I was promised if I did A, B, and C I would get weekend visits. I did the things and never got a thing. They took my daughter to SEVERAL doctors trying to have them say she was s€xually assaulted and that a mosquito bite my daughter kept picking at, was a cigarette burn. NO DOCTOR AGREED BECAUSE IT DIDN'T HAPPEN. Every visitation I had a new caseworker because they couldn't keep workers. Because I passed every urinalysis drug test that was monitored while in the restroom, they started taking hair tests instead. So many, Inhad a bald spot in the back of my head. They denied my parents custody (my mother is a registered nurse in mental health). I spent so much in attorney fees as a single mother. But, they stopped allowing me inside the court hearings. I never got my daughter back. She was adopted by a family who also adopted another foster child at the same time (both blonde head, blue eyed girls one year apart in age). They used DFCS as an adoption agency and when the girls turned 18 and weren't perfect little angels, they cut them from their lives. This family also continued fostering after adopting my child, but after ABUSE allegations towards them, they had their fostering rights taken away. They lied to my daughter and told her she had been molested, SHE HAD NOT, and it was proven. I had been in Playboy and did a reality show filmed at The Playboy Mansion that aired on Fox, and that is what started this and fueled it. When my daughter cried after one of our 1 hour, monitored visit, the case worker had the audacity to tell me that my shirt being low cut was why she sas upset! Also, the juvenile judge who had reprimanded DFCS just looked at my case, not remembering that in the 3 min hearings before I was not allowed to attend them, and just saw a parent who had now been in front of him twice and thought it must be me. DFCS knew that! That was purposeful. Just because I was in Playboy, I NEVER subjected my daughter to any of that. I also modeled and did tv shows on Travel channel and ESPN. Playboy was a SMALL blip in my career. Whenever I traveled for work, my daughter stayed with my parents. She was 3 and in pre-k. I had STACKS of character statements. Also, HOw can a case worker do their job when there is a new one every few weeks so they know nothing about my case. I recently spoke on this during an A&E docuseries. My daughter is angry with me to this day and has no relationship with me. I moved out of state and never went back. I HATE THAT AGENCY WITH EVERY FIBER OF MY BEING! My case was so dirty, my mom always says that people don't believe it, because they believe the state would never do something so crooked, so "there must be more to it". I am so happy for you and proud of you for fighting this the way you did! I was a 22 year old single mom and didn't know what to do. My attorney finally began tiring of it all, I could tell, and he stopped fighting for us the way he had at first . He did come to my apartment under the guise of checking my home before DFCS did a home visit, and attempted to have me give him oral s€x. I was SO beat down, and there is more that they did..but the ending was my child was legally kidnapped by the Coweta DFCS..💔.

One thing I would like to point out that strikes me as odd in this hearing is this. It's widely viewed, defended, and accepted in all 50 states that drug addiction is medical problem. NOT a criminal problem. I'm not condoning drug use in my statement. What I'm pointing out is, What other medical conditions warrant state intervention on behalf of the children of the inflicted? Do we take children from Cancer patients? What about a patient that has a broken leg and is on drugs due to that? Does their "being on" drugs warrant state intervention on behalf of the children? It seems like this needs to be brought to the U.S Supreme Court to be begin the process of having these codes amended in all 50 states.

@@edwardmiessner6502 ENFORCE THE LAW! You know if we enforced just one simple law, everyone who is holding any government office at this time would go to jail. They have all violated their oath of office at some time. By refusing to stay within the limitations of the constitution they break the contract. They cease to represent the government. They no longer qualify to hold any office. They become impostors impersonating government officials. They have committed treason and fraud and usually a lot of other crimes. The truth is the United States Government is the worlds #1 arms and drug dealers and they are running close if not #1 in human trafficking and the slave trade. Tied in with the worlds number one counterfeiters, the list goes on and on. It don't matter if your the Bloods or the Crypts or the Government they are all gangs victimizing not only each other but honest folks as well. They are all criminals. According to the law no one is lawfully representing the government because they have ALL violated their oath of office and thus have cease to represent the government nor can they hold any government office. The constitution is a contract and this is just what happens when you breach this contract. This also means when they were creating their acts and rules and regulations and signing stuff none of it was any more lawful than a conman trying to sign someone's house out from under them. It is null and void because they were not who they were representing themselves to be. They were and are impersonating government officials on top of all the other crime they are doing. I think every government official state local and federal should be investigated. All their voting records examined and everything they have said in public and if they have not upheld, defended, and supported the constitution in every case they should be charged with every crime they have done that comes up in the investigation to the fullest extent of the laws and they should be made examples out of. These are people under contract and in offices of trust. If they can not be trusted then they should not hold or ever be able to hold any office of trust. That is what the law says and it should be enforced. “The United States is entirely a creature of the Constitution. Its power and authority have no other source. It can only act in accordance with all the limitations imposed by the Constitution.” Reid v Covert 354 US l, 1957. “No agreement with a foreign nation and no treaty is free from the restraints of the Constitution. “ Reid v. Our constitutional ideal of equal justice under law is thus made a living truth. Violating their oath is not just cause for immediate dismissal and removal from office, it is a federal crime. Federal law regulating oath of office by government officials is divided into four parts along with an executive order which further defines the law for purposes of enforcement. 5 U.S.C. 3331, provides the text of the actual oath of office members of Congress are required to take before assuming office. 5 U.S.C. 3333 requires members of Congress sign an affidavit that they have taken the oath of office required by 5 U.S.C. 3331 and have not or will not violate that oath of office during their tenure of office as defined by the third part of the law, 5 U.S.C. 7311 which explicitly makes it a federal criminal offense (and a violation of oath of office) for anyone employed in the United States Government (including members of Congress) to “advocate the overthrow of our constitutional form of government” "When once a republic is corrupted, there is no possibility of remedying any of the growing evils but by removing the corruption and restoring its lost principles; every other correction is either useless or a new evil." - Thomas Jefferson Article IV, Section 4. The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened), against domestic Violence. Corpocracy While by law the U.S. is a republic, the government is actually a Corpocracy - democracy by the corporations. Corporations vote by paying politicians and political parties to put forward their agenda. U.S. Constitution - Article 2 Section 3 "He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States."
