Now, these two things in interact and a lot of people have questions about what are some of the concerns and how do they kind of interact with each other. hello, so I recieved approval for my CCPD application. It took approx a year. Now I am trying to figure out how my extended benefits which were for short term disability (19 weeks) how and what would be required in payback, Do I pay it or does CCPD pay directly to the insurance provider? Hi, I have been approved for LTD (insurance company) and now CPPD following your great advice. I had to appeal only once for CPPD. I have one question about receiving two benefits. I used to receive 3000$/month of non-taxable benefits and now will receive the same 3000$/month (insurance company deducting the CPPD with children benefits amount), but will have to pay tax on the CPPD part ending up with less money. Is this normal? Thank you so much.

Zero tax should be deducted from LTD? At 2:20, you mention that LTD is not taxable but CPPD is taxable. They are deducting Federal Tax from my LTD. And despite that, somehow I still owed $2,000 when I filed my income tax return for 2020. Also, since CPPD is taxable, does that mean both Federal and Provincial Tax is deducted (and/or are there any other deductions)? I'm in BC, on LTD since mid-2020, have been approved for both definitions of disability, and I have not applied for CPPD.

Does being approved for the CPP disability tax benefit have any sway on being approved for CPP disability?

Being approved for the disability tax credit (Revenue Canada) won't directly help your application for CPP disability (ESDC Canada). These programs are run by different government departments and the criteria for approval are different. However, often the level of disability needed for the disability tax credit will also be enough to qualify a person for CPP disability. It is helpful to include the medical report your doctor filled out for the DTC with the documents you use to support your CPP Disability claim.

I have a question with having CPP disability and my private disability being cut off at age 63, the company I worked for was owned by an American company. If you are not sure what I mean this may explain what happened to my 1450.00 a month private disability I was getting plus my CPP of 1350.00 a month now after turning 63 I,m living on 1350. I told when Obama was president in America a policy was signed stating companies over their only have to pay disability till age 63

This sounds very unusual. Normally what happens with group disability plans (US or Canada) is that they can offset any payment receive from a social security program (eg. CPP disability). So, in your example your LTD insurer could offset the $1350 from CPP disability, and therefore only owe you $100 per month. You may also owe the entire CPP retroactive payment over to the insurance company as well, so if you didn't pay that over to them, it is possible they just cancelled your benefits for that reason as well. You could reach out to us for a consultation. We would need to review the letters and documents. you got from the insurance company about this situation.

Money for disability from Long term Health Plan is a non-taxable benefit - not an actual income so no income tax owed; but CPP Disability is taxable income; but with Disabled designation confirmed; a disabled person pays little to no income tax. Thanks for posting eh!

I’m already approved for LTD through an insurance plan. I just applied for CPPD and waiting for a response. If my CPPD application is denied, can my insurance LTD decision be revoked or influenced in any way (i’m currently approved at 3 months intervals with my insurance company)? Thank you!

No, the decision to approve or deny LTD benefits is not tied to a CPP disability decision. The only exception here is that they require you to keep appealing the CPP claim until you get a final decision at the Tribunal. If you drop the CPPD appeals before then, some insures will estimate and deduct CPP disability payments that you aren't getting.

The LTD policy may state that an insurer can deduct other income, but when there is no "other income" can they legally reduce LTD benefits at all? Isn't the insurer obligated to continue to pay? When you take on a case, how often do you win PUNITIVE DAMAGES for the claimant when the insurer stops paying? Where is the law (the actual Canadian Law) that states the insurance company is legally allowed to "require" an LTD claimant to apply for CPP disability anyways? I'm not referring to Case Law for one precedent relating to one trial, I'm looking for the actual Law that states what insurance companies are allowed to include in their policies.

They are legally allowed to do which part? At 4:00, you are talking about *if* you get approved for CPP disability, CPPD lump sum, refund to LTD or LTD benefits suspended, and then at 4:43 you mention, “they are legally allowed to do it.” I haven’t applied for CPPD and they have already suspended my LTD benefits, forcing me to apply. My LTD policy says I am required to apply for CPPD but my question is ... where in the Canadian LAW does it state the insurer is allowed to require this of me? Where can I find this law?

I would like to know this as well. I am on LTD from military and will be 60 this year. I am told I have to apply to CPP this year because the insurer requires it. Why can't I wait for 65?

@@gordtulloch9623 I suggest you get written confirmation from CPP to confirm whether taking CPP at age 60 (disability) will reduce your CPP at age 65 (retirement).

@@gordtulloch9623 I also suggest that you be very careful when completing page 18 of the CPP disability application form which states that submitting the CPP disability application is VOLUNTARY. No it's not voluntary when the LTD policy says it mandatory. When I completed my CPP application form, I crossed out "voluntary" and replaced it with "required."
