Not saying it was a justified detainment but to assume that it isn't because the guy told you it isn't shows that your not using all of your brain. Just the part that wants reality to comport to it's pre existing beliefs.

Most states in the US have that very same law. HOWEVER, in the US, they have to have a reasonable suspicion that a person has been drinking. At least in the clip shown, the officer said he pulled driver over just because he can. He did not say, I smell alcohol, so blow. Here if you refuse to blow, you can do blood draw. If you refuse both you are taken in. Its not like I can refuse and then drive off.

Interesting, that’s what I hate about Australia, they’re far too authoritarian. you should ask a black Australian how they feel about getting pulled over at twice the rate of white people, without a reason. Did you also love their Covid policies?

@@ronbertka7023 exactly, people are acting like drunk drivers get to drive away from a traffic stop when there’s suspicion of the driver being intoxicated. That doesn’t happen in the US, you go directly to jail if you refuse to blow. I will never understand people begging for more government overreach. Especially after what Australians went through during Covid, it’s mind blowing.

There was a time, before the Federal Government created the "Department of (non)Education" when Civics was a mandatory class for Jr and High schools. Of course they also taught about things like having bank accounts and balancing the accounts, how local government worked, etc. But like everything touched by Federal Government, well, I'll just leave it there. Except that I would love to see Department of Education closed down. Return control to the States.

There is also a fine line between being emotionally upset at the moment AND being vicious or vindictive. I am confident that has the Defendant gone on and on berating the Judge, it would not have been the same outcome. It's like stubbing your toe. First reaction is one thing, going on and on about it another. EVERYONE has a emotional outburst at one time or another.

One time when I was in A2 I saw a homeless guy sitting on a stoop. A guy was walking his dog and the dog walked up near the guy on the stoop and then backed up fast. My guess was the dog didn't even like the smell.

She’s in jail and no address. My guess they co-parented at his aunts house (or whatever that address was but she can’t go back there. The children are with dad who isn’t in jail. She’s assuming she’s going to go grab the kids and live at a mysterious address that no one knows.

@@Kthb80 Random breath testing. They can pull you over at any time to check your license and to give you a random breath test. Follow a basic set of rules and you will be fine. Don’t like it then don’t drive but don’t sit there and bring up sovcit bs and the American constitution like a total wombat thinking it is going to work. Nothing about a license check or an RBT is infringing on anyones ‘rights’. I will admit we do have issues but these are not one.

Sure if they’re swerving, speeding or driving erratically, but just because he “feels like it” is absolutely infringing on his rights, but apparently in Australia you don’t have those. If nothing else, it’s a major inconvenience for someone who didn’t do anything wrong, according to the cop. Sorry, I’m not OK with being inconvenienced because some cop on a power trip “feels like it”. Don’t like it don’t drive, how about don’t like it, don’t go to Australia. I’ve been driving for 25 years without ever getting harassed based on a cop’s feelings.

That is a US idea, in most other countries the police can pull your over without any suspection and then check you. The US laws sort of protect people that drive illegally.

@@henrikjensen3278 as they should. Getting pulled over and breathalyzed for “driving on the highway “is insane, too authoritarian for my liking. But then again, look at how Australia handled Covid lockdowns.

@@henrikjensen3278 well the “US idea” is that you have the right to be secure in your person and property until the government has an actual reasonable belief that you’re doing something wrong. By the logic that this “protects people that drive illegally,” the same could be said for any similar protection. Should the police be able to search your house without a warrant? What do you have to hide? Such a restriction only protects people that are doing illegal things in their homes, right?

@@Kthb80 I know, but outside US police can usually stop anybody they like and check them or even stop everybody on the road and check them. In my country they regularly do it at dates where people drink alot, i.e. stop everybody, ask for driver license (Insurance will be valid or you are not driving) and if they smell alcohol asks for a blow into the breath analyzer. I have never felt that the police is too authoritarian.

@@Grey_Duck It is not like the police can search you, your car or your house without reason, but they can check your driving is legal without a lot of fuzz. Yes I know many US people believe that it is an intrusion into their privacy that police can check that they follow the laws, but in most other countries it is perfectly normal that the police can do a superficial check.

He wasn’t always so bad…but it seems like the last year or so he’s just become a butt! His facial expressions & his almost under the breath comments are very condescending & as you stated he’s rude. He has a sloppy demeanor.
