They are not "Paul Blart". There is a difference between security and police. Security has their purpose in their buildings and posts. Police officers have theirs. Dummy, if there was evidence of.a murder, ON SCENE, they would take the information needed and follow up. Unless the person was still standing there with with the murder weapon, and confessed to the crime, they can only detain them as a suspect. Again, the person recording decided to drop the charges, so there was nothing to investigate further. Then continued to harass the guy at work after, threaten him, verbally assault him and then loiter.

The agency writes the contract and the security companies bid for it and I suppose it's the agency who stipulates they be armed in case some nutter with a gun decides to do a cull in their premises and if they don't have an old man and the obligatory half wit side kick to protect them with their penis extensions the agency could be liable for compensation claims. But ho hum, where I live only the police may carry guns and that is only for self protection and not to be used for apprehending criminals, so if someone is shot in the back while resisting arrest for spitting on the pavement, the cop is well and truly, well you know what I mean. It's a different world this side of the pond, heck in London they like to cull each others tribes with machetes or take their face off with acid. Much more civilized.

It was not just a battery, but a temporary depredation of one's Constitutional Rights and done BECAUSE one was using one's Constitutional Rights (ie, also can be labeled as Relatiation). Those are Felony/Federal Offenses of Law. Add in an Assault for the other filmer as he attempted to Batter him (which is Assault) and an attempt at Retaliation based upon a Constitutional Right.

That security guard had no right to go at him like that and he only did because he didn't understand the law for his own work place. Sad. Knowledge would have avoided all of this.

After 30 years and numerous legal cases including litigation against multi million dollar entities and have held the enforcement rank of lieutenant with 35 officers under my command and worked with all types of legal matters, set several case law precedent, you are free to claim that i do not know anything about the law even though I read the law and legal cased everyday and the only court level I haven't argued before is the US Supreme Court yet I cite stare decisis from it almost daily in briefs. Thank for the advice; if one follows it it could land a person on the wrong side of the law. Feel free to unlawfully place your hands on another person and let us know how that turns out for you.

Sadly in Massachusetts an assault occurs if you commit an act which reasonably places another person in imminent apprehension or fear of either harmful or offensive contact. You don't have to make physical contact.
