Creek Fishing New Waters Leads to SHOTS FIRED!!

This was the first time and hopefully the last time this has ever happened to me while out fishing!! Great adventure but scary encounter with Land owner.

Well that was a pretty special trip for John and Josh. I've been berated by landowners around the Chicago suburbs for years even on larger navigatable waters. Most of the time I am several feet inside the streams, quiet, clean and respectful. No shots fired but with my luck in IL they would find me guilty of mangling a perfectly good bullet. Looks like you had a blast on a pretty creek. Blessings brother and keep your heads down

Creeks that small do have a lot of little smallies. There is a creek about 17 miles below my hone that I go up often. Haven't been up thru there fishing since the fracking crap started 10 years ago. We ae being heavily fracked now. I drove up there a couple years ago and they have heavy equipment everywhere but it's a heavily monitors creek and a treasure. One of the few clean streams in this area.

Dude! I had that happen to for the first time ever just about a month ago. A guy was shooting at the creek bed/side. He didn’t care I was there. I back tracked and found a road back to my truck. It’s scary.

I have had shots fired over my head before creek fishing. The law in Ohio used to be you fish 3 feet off the bank if the creek runs through private property on both sides. You can't bank fish but you can can walk through like an easement. It has been changed to once you get to the first break in a public water that runs through private property and your boat doesn't float and you have to get out and walk you are no longer legal. EDIT : one creek I was walking actually had a cattle fence across the creek and it's a real creek and public water. He also ran us off the creek. Same creek and it's extremely protected and a very beautiful creek but is so small in areas you can't float through so now that is illegal. You should be able to walk down the creek.

ANY body of water, creek, brook, stream, river, etc. that can be floated by any device such as canoe, kayak, boat, or even an inner tube, is considered navigable. Also, unless the property surrounding the body of water is posted, said property can be presumed to be publicly accessible also.

Recently went to my creek and 2 state troopers were there. I said hey officers, whats up? They were looking for a guy "not in his right mind." I thanked them for the heads up and off to fishing I went. Caught a nice smallie that day.😊

It gets scary when someone shoots at you or just around you when you are in the middle of no where just fishing and bothering no one. Some fifteen years ago a buddy and I were wading and fishing for smallies in a creek that we had fished many times before. When a guy shows up with a shot gun and fires in the creek. He said this is your only warning, get off of my land. The land was not posted and there were no houses within miles. Well we decided to cut our fishing trip short and go somewhere else. We found out later that the land was actually owned by someone that lived in Florida and he had just bought it for an investment. He said he did not have anyone taking care of his property and anyone could use it within reason. We talked to a Game Warden and he told us that it didn't matter if they owned the land or not if they had a gun it is best to leave. I said I'm way ahead of you brother. He just laughed and said I would have cut a new trail too.

If there is public access to the creek. The land owner has no right regarding trespassing laws especially when you can't own a body of water unless it's surrounded by his land. You can't dock on his land but you can paddle through the body of water (creek,river,lake or pond)if there is Public access.

Not true, and the laws are usually in regards to navigable water and are different state to state. Though shooting a passive trespasser is not legal.

Here in most area of these states land owners and people respect the law for most part as long as you don’t mess around on their bank leaving trash and what not they don’t even care if you stop .

Took a trip to Michigan to see the in-laws and fish with the father in-law. In Michigan, there are parts on the lakes where the land is barely under water and it looks beachy. Some of that property is indeed marked as private property. Just an interesting side note I thought I throw in. That land out where these two were is most likely not private property. Some people think the water just beyond their back yard is theirs but I wanna say no, it's not.

From the corps of engineers website…. Navigable waters of the United States are those waters that are subject to the ebb and flow of the tide and/or are presently used, or have been used in the past, or may be susceptible for use to transport interstate or foreign commerce. As a land owner with a creek running through my property it pisses the hell out of me when someone comes up the creek and assumes they can fish the water because they can get their kayak up it, thus making the argument that it’s not private water. You are old enough to know better and old enough to get a landowner’s permission before fishing private water, armed or not.

Too many comments that are not applicable in other states. In my state, there are only three rivers allowed for floating. Every other stream is only by landowner permission. You need permission from every landowner to be lawful even if you never leave the kayak

I have studied firearms law for almost ten years: Her shot was totally illegal and this video would easily be evidence to have her charged with 1) Recklessly endangering another person; 2) Making terroristic threats; 3) Disorderly conduct; 4) Harrasment; 5) Assault...Like most gun owners, she doesn't know the law. Navigable Waters means that you can navigate it by a barge or large vessel! People ignorantly believe navigable Waters means you can navigate it by any means kayak canoe Jon boat walking etc. That is not true! Sometimes People's property line ends at the shoreline of state or city on water. Butt. It should be common sense to most people that people do on creeks and streams! Sadly common sense isn't that common.

Negative. The three terms are public navigable, public non navigable, private non navigable. Public navigable means that the waterway can be/is used for commerce (shipping). Here in Missouri think Mississippi/Missouri Rivers. Public-non navigable means that the waterway maybe able to float a canoe/kayak/small boat with no commercial use. Like the Current or the Piney. Most stream/rivers in Missouri at public-non navigable. Private-non navigable are waterways completely enclosed by land owners that have no public access, not managed by the state in anyway. Very few of them in this state. On public-non navigable waterways, in this state, property lines do extend to the center of the waterway, however the public is allowed to use any portion of the stream bed to include the water, sand and gravel bars etc. The area where permanent vegetation starts is where trespass can occur. Now, this does vary to some or a large extent in other states. For example, I believe that Georgia has some really crazy laws.
