Common sense says that the company or companies that own the Ship are the ones who should pay for the damage. I work in the transporting of goods and when someone is involved in an accident, if deemed to be avoidable, then the person who was driving the company vehicle is terminated and the company is responsible for damages.
@dianaf2077
@dianaf2077 2 ай бұрын
The companies involved are claiming force majeure, ie, the incident was caused by something out of their control and therefore they are not responsible. It’s a clause put in just about every contract to protect a company from a situation like this, although I think this will be in court for a long time. If the primary cause of the accident was failure of the engine or failure of the computer system controlling the engine that isn’t outside the company’s control, it’s their maintenance failure.

This is very complicated - the owner of the ship leased the ship to Maersk. But you can refer to the BP Oil spill to see how this can play out. The U.S. collected about $6B in fines and penalties from BP and the oil rig operator.

The Gordie Howe Bridge isn’t comparable to this at all. The span that collapsed was about a half mile long. The entire bridge didn’t actually collapse. So I’m assuming they won’t be replacing much more than just the main span, especially if republicans are already complaining about taxes… plus the GHB’s main span is enormous with >600 foot towers and needed planning and construction to the nearby highways and other infrastructure and real estate challenges. Not saying it’s a small task, but once the channel is cleared, things will progress significantly and quickly

The mayor needs to stop amplifying the situation and making it a bigger issue than it is. It is nowhere near being a "critical port" for the "the nation". It is most definitely a Maryland problem that was caused by neglect and misappropriation of $$ to ignore having proper dolphin barriers around the footings. They have more protection for the power and communications poles next to the bridge than around the bridge itself. Gov Wes Moore and the state of Maryland are responsible.

When you look at the video of the bridge going down, you can see the work lights on the right side of the main span. In this location, the roadway is hanging under the steel truss, so the roadway and workers is now on the deepest part of river bottom in the mud with tons of mangled steel on top of it. The surveyors determined that it was too dangerous for divers to attempt to recover the bodies without removing the steel truss first. The safety of the divers is higher priority than instantaneous body recovery.

As well as all underwater laid cables and pipe networks, whether water pipes, or sewage pipes, gas pipes, oil and fuel pipes, or underwater telecommunication and fibre-optical data cables, or electric power cables, or underwater utility tunnels too. Or road, rail or foot passenger cycling bridges, including lifting bridges too, or underwater train and road orfoot passenger cyclist tunnels as well. Ports and Harbour breakwaters, piers, public and private slipways, yacht marinas, floating pontoons, ship repair and maintenance dockyards, water taxi and water bus or sightseeing boats, or party dinner cruise boats, loading and unloading terminals too. As well as all the different waterfront residential properties, or commercial waterfront properties, plus public open space waterfront areas too. As well as all kinds of water sports and leisure sailing, boating and canoeing, wind surfing paddle boarding, even public swimming and diving areas too. Then refuelling loading berths, or water loading berths, or sewage unloading berths, floating mooring buoy berths for Houseboats, or commercial barges, or any size of commercial or private vessels too. Then there all port, harbours, channels, navigation buoy’s, aids, lights, cameras, water / currents, tides, temperature, pollution, weather and atmosphere marine monitoring sensor buoy’s floating all over the place too. Even rivers and estuary’s, or inland waterways or Shipping canals, plus ports and harbour, as well as coastal marine wildlife and Waterfowl or Seabird and marine nature reservation areas, including mudflats and sandbars plus shadows that all need protecting to some degree too? This is not just about so called only protecting bridges, from commercial shipping vessels of all sizes, colliding or impacting with bridges only! Far too many narrow mind tunnel vision Politicians, at all Levels of Government now seem to think. Or the equally far too many news media reporter’s, or news presenters and news editors, as well as every social media bloggers, or everyone of social media too, including so called marine experts are talking about while real not knowing what they are talking about. That how this Baltimore Port Bridge Container Ship Marine Accident and Disaster, happen in the first place too, wrong decisions were taken by Port and Harbour, City, County, State and Federal Authorities. Also this was years ago, not months, or weeks ago, or even days ago when this Container Ship left the Container Terminal key-side either. That lead to this Marine Accident and Disaster happening, yes everyone will try to blame the Container Ship’s Captain and Crew, or the Pilots. Equally try and blame, the Ship’s Owners, or the Ship’s Operators, even the Ship’s country of registry officials too, or blame all of the above because they are just foreigners too! Though when the real blame game, actually really gets going in a big way, it has not started yet but it is surely coming sooner or later. That is between the Baltimore Port and Harbour Authorities or their insurance providers and lawyers, City of Baltimore Authorities or their insurance providers and lawyers too. Similarly with the neighbouring Counties to Baltimore Authorities or their insurance providers and lawyers too, or with Maryland State Authorities or their insurance providers and lawyers too, along with the US Government Federal Authorities or their insurance providers and lawyers too! Also with the NTSB maybe US Courts too, let alone with Ship’s Owners, or the Ship’s Operators, even the Ship’s country of registry officials too, plus the ship’s insurance providers and lawyers equally. Or the Ship’s Captain and Crew or their insurance providers and lawyers, or the Port and Harbour Pilots and their insurance providers plus association’s lawyers too. Not forgetting all the American Attorney (ambulance chasing lawyers) and their Law Firms now lining up to represent, the families of these killed road workers on the bridge. Similarly start legal claims in Court for Millions of Dollars in financial compensation, from everyone in sight more than likely too, The Blame Game, Will really Kick Off Big Time, publicly and everywhere too! So should not only the American Government, needs to start straightaway a major Public Review and Enquire. That is in to All Marine (inland waters or coastal, even deep water too) Infrastructure Protection and Defensives Measures straightaway now! Also the Canadian, Australian, British, New Zealand, South Korean, French, Indian, Germany, Japanese, Italian, Brazilian, Mexican, Dutch, Panamá, Danish, Egyptian, Spanish, Saudi Arabian, Norwegian, even the Chinese Governments. All starting their own Public Review and Enquire, that is in to All Marine (inland waters or coastal, even deep water too) Infrastructure Protection and Defensives Measures straightaway too! The issue of the Voyage Data Recorder (VDR) black box, not recording vessels data, was it switched off by someone in the ship’s crew? The reason the Voyage Data Recorder (VDR) black box, did not record anything, if there is a ship wide electrical blackout or outage. There is no data going to this Voyage Data Recorder (VDR) black box, from ship’s onboard navigation, propulsion, communications and steering, sensors and/or damage control systems too, there is simply no electric power. Even though the “VDR” black boxes, have their own independent emergency electric battery energy packs, in case of ship’s electric power fails or is lost! Which is shown by the fact, the Ship’s Bridge Voice Recorder (SBVR), or newer Ship’s Bridge Audio Visual Recorder (SBAVR) black boxes. Actually carried on recording what was going on the Ship’s Bridge, that is between the crew, the ship’s captain, Ship’s Engineer’s. Also with the Port of Baltimore Pilot, who all were on the bridge at the time, or were look outs on the Bridge Port and Starboard Wing Stations too, was still all being recorded and the NTSB has this recording now too!

They need to build peers made of steel reinforced concrete with big rock around it in front ,back and around the sides of the peers on the new bridge so a ship will hit the protective peers and not the bridge peers so this will never happen again.

I wish the federal funds were being spent to build protective devices for the bridge to prevent the catastrophe in the first place. The government is always in reactive mode. Shouldn't spend taxpayers money to fix this? Those Congress members are truly deluded then. This is exactly what tax money should be used for instead of sending them to foreign countries or giving them freely to illegal migrants who enter the country and have a free vacation stay at hotels with a debit card issued. This affects America's economy/money, so yes, American tax money should be spent on this.

What if the crewmen on the ship, thought the concrete bar would help stop the ship? If the ship had mechanical trouble why did they not go back to the port? Why did they check all instrument on the ship ,before sailing off? If the ship is too old, get rid of it. First the airplanes now the ships. The men that work on these ships need to pass inspection first.

What about a liability assessment? The black smoke was due to a crash full astern. The stern was being moved by lateral channel currents caused by tidal flows. Maryland was to cheap to install dolphins around the vertical supports. There were two power trip outs close to each other. Was the engineer not paying attention or was there contaminated fuel? We have heard nothing from the crew including the master and chief engineer. Until then, we need to reserve judgement on who pays for this. Do we stick the US taxpayer with it or do we go after Loudes of London to get them to pay?
