As a cop, even if you know full well that the person standing right in front of you in the street is a gang member, you can't do anything. Cops can't just arrest people as they like. So simply being part of a gang is not reason enough to make an arrest. The gang member has to have actually committed a crime for him or her to be arrested. In this specific situation it might seem like these laws for cops are stupid, but they are also very helpful in protecting you from cops wanting to take the law into their own hands just because they "think" you are part of a gang.
