good day sir, according to your presentation on impossible crime there is no attempted or frustrated impossible crime. can you explain the consumated impossible crime, if there is. thank you sir.

It only means to say that impossible crime is either committed or not. It does not have stages. As the name implies, it can only be charged when there is impossibility of accomplishment of the crime either due to legal, inherent impossibility or inefficient and ineffectual means. If the crime falls on attempted or frustrated felony that should be the offense charged. Impossible crime can only be charged if there are no other crimes committed.

Goodday sir, My ask po ako tsaka tanong if it is attempted or impossible crime sa RPC book 1. Ex. A with intent to kill aimed his gun at B. A did not know that the gun was empty. As a result when he pressed the trigger it did not fire. What crime was committed by A ? Thanks a lot sir. Godbless ☺️

That is impossible crime for it is ineffectual means to fire a gun without an ammunition.
