Criticising arrest bid for Netanyahu a 'huge mistake', former ICC prosecutor says • FRANCE 24

In an interview with FRANCE 24, former ICC prosecutor Luis Moreno Ocampo reacted to the court's request for arrest warrants over the war in Gaza. The ICC has faced heavy criticism from Israel, the US, Germany and Canada since it announced it was seeking warrants for Israeli Prime Minister Binyamin Netanyahu and his Defence Minister Yoav Gallant for war crimes and crimes against humanity. Moreno Ocampo called this reaction "disappointing". For him, attacking the ICC prosecutor's decision instead of focusing on the crimes is a "huge mistake".

Discussion of facts and their relation to law is what counts. I believe this is what is contained in the ICC accusation. It is the Court, and not the prosecutor, which may then convict or absolve. That is how it should be. Let Israel show up and put forth a factual and legally based argument, and attend to consequence, including full exoneration/condemnation as warranted.

I think the ICC could have first issued arrest request against HAMAS leaders just when the October 7 incident happened with proof. Secondly the issue of Bibi and Defense minister request to arrest them now could have been justified properly. But matter is.... ICC issuing the arrest request at the SAME TIME for both parties. So if Netanyahu goes to a prosecutor and says investigate me.. that would have stopped ICJ! Would the appointed Prosecutor look at the evidence first? I'm sure anyone, even those with no legal background would say yes! But isn't that exactly what ICJ did not do? Did not go to thoroughly verify the facts on the ground? He did not show up ! Imagine a prosecutor making a judgement without visiting a crime scene! In the case of Gaza, start with the opinion that both sides could be lying. Then thoroughly investigate and then only make a judgement.

You seem not to understand what's going on here. A warrant of arrest is not judgment!! It is issued to ensure that the accused is brought to trial. The evidence is produced during the trial where the accused gets the opportunity to defend himself and produce counter-evidence As of now, the warrant has not yet been issued. The court has simply requested it. It's up to the judges to decide whether the warrant should be issued or not, based on the arguments presented by the prosecutor.
