In today's video, we have an evidentiary hearing for a couple where the dad has petitioned the court for custody due to neglect on the mom's part.
Let's listen to the witnesses and see who is more credible...

I'm gonna take the word of the daycare teachers who see and care for the children every day over a pair of neglectful CPS workers and the mother's personal social worker who has never even attempted to speak to the father. How does a social worker not know her own client's criminal history?! All these public servants involved in this case need to be fired. Also, the opinion of her enabling mother who never sees her grandkids is so irrelevant.

Since when does CPS investigate a mother for one child not look at 2 other children in the same house at the same time? Dereliction of her basic duty. She was probably just satisfied that there were no drugs. This CPS office needs investigating itself.

Newaygo county cps is awful. I’ve felt with them where they have lied in court, and the judge ruled against them. I’ve also seen them leave plenty of kids in white cloud in disgusting homes.

@@yourmotherisanastronaut I am a preschool teacher and have a BS in Early Childhood Education (a four year college degree) and I can assure you it is far more than a months worth of education. A director of a school will have a BS as a minimum as well as 5+years experience but typically far more. Additionally, each state has requirements for ECE Teachers. Entry level workers are assistants to the teachers who have undergone a formal education. I worked full time as an assistant teacher straight out of high school as I attended college full time at night. As an assistant teacher you are not the one who would do progress reports or Parent Teacher meetings. They also do not create the curriculum rather they help the teacher implement it.

If this mom is abusing her kids by using fear to manipulate behaviors, how is she treating the nursing home residents where she works? 👀 Somebody better investigate that situation too!

She sounds like she's only janitorial staff. I doubt she actually does anything with the patients in regards to meds or helping directly.

I love this Jen lady, she is prepared and her statements show that she cares a lot for the children under her care; these are the types of people we need in our schools and daycares.

35 mins in...dad is doing very well for himself considering he has no lawyer. And the daycare workers letter was so sad, as far as how the children arrived when in her care. Once even in the same diaper from the daycare, from the afternoon before. Thats abuse...not neglect. Leaving a baby in a diaper from 245pm until the follow day when she brought that baby back to daycare is abuse.

I'm usually really suspicious when a parent rambles non stop, but to me dad sounds so excited about home life with his 2 kids and what they do for activities.

He’s a manipulator! Your observation is correct! It was all about what he’s doing! Selling a dream home to the judge🙄when the judge asked him about his background all of sudden he can’t remember anything 🤦🏾‍♀️🤦🏾‍♀️

@@Yah-Yah733I think you’re talking sbout a different hearing. All he talks about is the kids and the things he does with them are descriptive and genuine. Mom is not well and needs a lot of help. Another boyfriend that left because of all of it…. Let’s think - she’s at work all night. Asleep all day. The boyfriend becomes a nanny essentially. Or he also works nights but that can’t be, because she needs him to take care of kids during the day.

@@Yah-Yah733what “dream home”? His description shows none of the hallmarks of manipulation. Dream home salesmen talk about all the incredible toys their kids have. This guy’s like: we have a chalk-board and a tractor he likes to ride. I want to get them outside more when the weather is better and I still need to find them some friends their own age, but they’re wearing socks and we’ve finally got that rash under control. He drips authenticity.

Daycare: We’ve been caring for these children for 2 years and we have outrageous concerns. CPS: We met this lady a couple times and she seems legit. 😐

I kept yelling at her to calm down because she was getting unprofessional. 😆 That woman saw too much and was livid for the way those kids were being treated by the mother. She gave no f’s and burned it down. I’m glad too because that’s what a protector of children looks like. Not those CPS workers who sat there twisting up words and even lying so their little pet project would make them look like heroes. CPS is worthless. I wonder how much additional funding they get when they present these “success stories” that ignore a child having a strep infection so bad it caused a rash. They are lucky that child didn’t 💀, but even if she had, they never would’ve been held accountable.

I'm a preschool teacher along with daycare... this is heartbreaking and absolutely ridiculous!!! The daycare woman was amazing.

I'll tell you, as a former foster parent, exactly why those CPS workers seem to have moms back (however pathetically executed). They DO NOT want to be held to account if it is proven that there was neglect or abuse and they failed to protect. They did not do it because they like mom better, as I've read in some comments. Pure and simple case of covering their asses!

In our town, we had a 5 year old who was killed by his parents, and the DCFS agent who directly was involved just got convicted because he clearly failed his job.

My grandma had to quit school after completing second grade (back in 1903) because her family needed her to be at home to help with the farm and the house. She could write in cursive and print, read, pay her bills and balance the checkbook, run her and my grandparent’s home, raised her family. Lack of education doesn’t equal lack of common sense and practical knowledge. While Mom may be lacking in formal education, she seems to have deeper issues impacting her decision-making abilities.

❤amen my grandfather didn't graduate the 3rd grade. I helped him learn to read old westerns with the hooked on phonics program we got from a garage sale. Hes been gone for many years but anytime I feel challenged or overwhelmed or even embarrassed, I think of my poppy and him holding that feather to his lips to see the effects of the phonetic sound of the letter F as we said it together. I still keep a paperback of lonesome dove just in case. ❤ lack of formal education definitely doesn't equal a lack of intelligence.

The issues this lady has go far beyond her limited education. My Grandpa had to quit school after the 3rd grade for the same reasons lots of kids did in the early 1900’s. He grew up in a German-speaking home & attended German Lutheran school-for the short time he was in school, where they spoke only German.He had to learn to speak, read, & write English-on his own. After running a dairy in Mt. Clemons w/his brothers, like millions of others, he had to re-invent himself during the Depression. So, in 1932 he & my Gr. Grandfather joined their resources. They purchased 1 farm w/2 orchards out on the peninsula in Traverse City, where my Mom & her 3 siblings grew up. Their cash crop was apples 1st, & cherries 2nd. He & my Grandma raised 4 kids & gave all of them a college education. Twenty years or so later they sold that farm, purchased a smaller farm, & eventually my Grandparents retired - comfortably, & debt free. My Grandma & Grandpa were not wealthy, far from it, but considering his education, or lack thereof, his “success” is pretty remarkable to me. My Mom said her Grandma always said, “Being poor is no excuse for being dirty.” It’s so sad when I hear children are not being taken care of properly. A diaper still being worn by a child the day after the daycare put it on her is a huge red flag. Clearly Mom didn’t have a childhood where her needs were met. My concern for these kids is that their Mom just doesn’t seem to understand what they need & these kids will end up just as neglected as she was. I will be very surprised & extremely disappointed if this guy doesn’t give physical custody to Dad.

I missed that after being floored hearing she has them watching "scary clown" movies and that she puts a chucky doll outside the room of a 3 yr old in order to scare him into staying in his room. Poor little babies.

The fact that this mom has had CPS called on her numerous times is telling, I believe CPS failed these kids. And if CPS wasn't involved, mom's home would still have roaches, and her house would be a mess. She wouldn't have food for the kids. The list can go on. She said the state paid for the exterminator service to get rid of the roaches, the state pays for her food and they are holding her hand to work her services but It's seems that every time CPS closes it's case mom goes back to what she usually does, and then the cycle starts all over again. I hope the judge gives dad primary custody

I don't really, but I think maybe the dad isn't as peachy as he comes across here and might even be mentally abusive as a person and just knows how to behave himself very well for the goal in mind. That being said, I would like to see the kids shared between the parents with dad having all nights. Seems the right thing to do especially with mom having multiple mail partners with that little baby girl that really upsets me that she would be leaving her baby girl alone overnight with a non relative male. That's the number one way a little girl becomes SA VICTIM. And mom surely knows this.

@@dazzlingextremes389 why should she have custody at all when she not only Does what you mentioned, she leaves her kids sitting in feces for days at a time!!! That alone should send her to prison and bar her from having custody of a dog, let alone a child. She is unable to pick them up or drop them off consistently, constantly wastes everyone’s time and disrupts daycare/school, she can’t even give a ballpark estimate of how many hours she works. It’s sad that we KNOW that this woman is a VILE person, yet people want to give her a pass while making baseless claims about the father 🤦‍♂️

I have gone through 5 CPS investigations due to reports being used as retaliation. While I think mom is problematic, some investigations are no always valid.

The male CPS is not just negligent, he's dangerous and combative against the father in the mother's favour. That teacher's supervisor has forgotten that the teacher is a legally mandated reporter, not just compelled to testify in a case involving child safety, abuse or neglect. The other cps workers are weeping disgraces to themselves and their department saying outright that one case doesn't affect another and that one saying that (she) wasn't a mental health expert so she didn't have to answer the question of whether a small child's mental health would be affected by stressors. Unprofessional, lazy cowardice doesnt begin to cover it. Joe senior makes two excellent points- towards the end with the worker who praises Stephanie's improvement and progress , he points out that this is Stephanie's improvement, not necessarily the children's. Stephanie clearly has emotional developmental issues which she addresses well, but part of those issues I think is a personally (self) centred point of view of her world. She can't help questioning how everything will affect her first of all, then maybe how the kids might fit into the picture. Numerous boyfriends, hygiene and cleanliness, and not really caring about people's perception of her until it's too late, then using victimhood and shouting down manipulation tactics show this. But meanwhile, where are the kids in all of that? And if the worker had issues with Joe's co-parenting, why didn't she start a conversation between the two of them, at least to verify the claims of intimidation and ptsd triggers by mum? I don't know, this case riles me a wee bit hey. Great work, Legal Stuff. Thankyou.

So many issues here, but I think the dad is better for the children. Mom is throwing up lots more red flags than dad, & her flags are bigger. I know she's not intelligent, and I feel for her, but she's all about what is best for her, not what's best for the kiddos.The fact that mom thinks the taxpayers should pay for daycare that could be free with dad really infuriates me!!

The weird thing is that the kids are already in daycare during the day, so then you need EXTRA daycare for a night job? When are you parenting your kids exactly?

The Father needs custody. The taxpayers have to pay for the mother to have kids. She changes her story and has an answer for what she thinks they want to hear. Its all about her and doesn't trust the police. Its always someone else fault. She is Not A great Mom.

She’s a great mom but she has all these boyfriends in and out of her house BABYSITTING her kids! 😩 I don’t think either one of them are Parent of the Year but she’s off her rocker. The way she kept interrupting and sighing so loud and talking over the judge - she has no self control. Those poor kids.

I taught preschool and worked in the daycare, ages 2 through 12. I understand how the director's testimony seemed spirited and biased but I understand it. When you have children in your care, sometimes for 12 hours a day. You often spend more time interacting with their child than the parents'. Day after day, it becomes very clear what is or is not going on in the home and it can be very difficult to hide your disdain or frustration towards the offensive parent. Putting new, random men as an emergency contact! 😡🤦 That's scary. Not to mention changing a diaper that has your initials on it from the previous day! I'm still shocked when I see CPS being completely blinded by bias. The amount of things they'll justify for their preferred parent is baffling. 😔 I believe the mom's social worker mentioned that the daycare had been in contact with cps but nothing comes of it. Shocker!

I thought it was crazy that the bulk of their investigation seems to be talking with the kids, these kids are way too young to be reliable sources of information.

ask yourself this, if a father brought his kids to daycare on the days where he had custody & the school reported the kids were disheveled & dirty as well as malnourished, and he had bugs in his home, would a judge hesitate in yanking his custody?

U can just lose your kids in some cases over NOTHING. However, Im also a planner & after 11 years still REFUSE to get married to make sure thats MY son! Bc he is lol I do it ALL!

@@andreastiemeyer2183 Did you watch the first part .... the testimony came from the head of the day care centre who offered because she was so concern about the child's welfare while in the hands of the mother. Her testimony was not only compelling it was damning not just against the mother but the CPS workers who produced any evidence to the contrary. They did report that they had opened many investigations into the mother they did report they had not so much as spoken to the father. From her testimony it is clear the mother has either a substance abuse problems and or is ESN her tails were the type I would expect from a six year I fully expected her to claim the father raided the home armed with a grenade launcher.

Way to go CPS!!! Wow, "The kids were playing" kid screaming and crying locked in a room. And cps sees nothing wrong with this? All 3 of those cps staff need sacking for gross incompetence and a case of child endangerment pressed against them for there piss poor job performance.

I hope the Director of the child care did her mandatory duty and reported the mother to CPS. What she described is severe neglect not changing her daughter's nappy overnight.

She likely did, but CPS has a bad habit of a lack of follow through. In some cases, they'll even let the people know what's going on. Sounds like this is what happened.

Amazing and terrifying what the CPS and Social Workers missed - Day Care director is much, much more credible. Mom isn't a great Mom, but she's trying... but she has a way to go.

I'm concerned about the Dads DV history, Mom's low IQ and her inability to appropriate advocate for herself. If they were represented by lawyers I think we would have seen a very different hearing.

CPS is not a good judge of the well-being of children. They have check lists of services that parents are to complete and that is all they care about. If the parent is taking classes and have a job they are good to go. It's disgusting. I have watched so many of these cases and the whole system should be re-done. Thank God for the childcare worker that had the guts to give an honest, INFORMED opinion.

I had an abusive mother and a saint of a father. My mom used what my therapist labeled as "manipulative torture tactics" to discipline. My stepmonster she decided to marry did the same. Although I don't believe that this mother is as good a manipulator as my mother, her sighing throughout the proceedings was giving me flashbacks. She's obviously the type to act one way in front of people or "guests" and another behind closed doors. When they get mad, they seethe and use small queues to get you to stop whatever behavior you're doing that's embarrassing them or annoying them. I don't believe for a minute that she's doing anything the CPS workers are asking because she wants her children back. It's just to upset her ex and fix her reputation. What I find even more ironic is the fact that my mother also works with the elderly in homecare service. Is she a nurse? No, but she tries to act like one. I wouldn't trust my houseplant to either of these women. Some people should not be allowed to procreate. I firmly believe that people should have to be evaluated before they are allowed to have children. That way crap like this doesn't happen. Of course the older boy has behavioral problems. So did my older brother until he went to live with our dad. My dad NEVER hit us. He never had to. My mom took every opportunity to do that and more. I only ever remember my dad yelling once and that was because I dropped a pot of hot water and he only yelled because he was scared for me. I talk to my dad every week. Guess who I've blocked on all platforms? My mother. I can see clearly how this is going to turn out if the kids stay with the mom.

Not to be mean and I understand that people can be loving, caring parents with a low IQ, but, the testimony of Mrs. Cantrell, the way the mother speaks with hesitancy and lacking logical critical thinking, and the dad pulling off changes in only a month says exactly what I would do in this case.

Maybe the laws in this state are different but nobody including an employer can tell their employees to withhold information and/or evidence in a legal proceeding. I'm very surprised that this behavior was tolerated.

I feel like there was a back story there, the court definitely could have pushed the issue, especially if one of the parties insisted on it. It seems like neither party wanted to make a big issue of it. But legally the employer would have had to hire an attorney and file a formal motion to quash the subpoena or limit the scope of her testimony. Short of doing that, they have no legal right to limit her testimony. Not only that, but pressuring someone to testify or not testify a certain way could be construed as witness intimidation.

My heart just breaks for the kids, the true victims in all of this. So young, trying to work out the world around them, and they have no solid foundation underneath them for those crucial years of development. Parents like this don’t understand that this blasé “whatever I’m still a good mom, just because I don’t practice good hygiene with my kids or feed them right doesn’t meant I don’t love them!” types of attitudes as being _just_ enough. It’s not. They need so much more than that. Saying you love them doesn’t amount to much if everything else is ignored. I get it. Parenting is rough. Been there, still there. Things happen and you make wrong turns in life, resulting in more poor choices. Happens to the best, but it’s never an excuse. Doesn’t matter if you’re dirt poor and can’t afford anything for your kids or you have it all and can provide all the material things without issue, doesn’t matter if you’re with the parent of your kid or separated … it’s physically and emotionally being there and giving them stability that counts, especially during those young years. Cases like this just depresses me because they’re so damn common in the courts. To sit and hear the mom “I’ve been downgraded as a mom by him” (it’s degraded, ma’am) just screams “I’m the victim in this situation, isn’t what he says about me just so awful?” along with the trail of excuses … it’s always someone else’s problem, someone else’s fault. Just incredibly sad.

I think it is very significant that the daycare teacher took the time to write the statement and also shows a lot of care and attention they seem to pay the children in their care. Fact; children learn one word in every thousand, Dad like me talks a lot, he lives with and for his children. He believes in structure a must for raising kids. Mom is the opposite, maybe too much, diapers baths and food, it’s not much but it depends on your comfort level. That’s why the parents aren’t together now, I’m sure they have many reasons the biggest being the children. The daycare lady didn’t make things look good for mom, I’d like to see the judge order a lawyer for the children, this mess is just going to get worse. Advocate is a neutral party and is a separate entity from mom and dad.

Yes, the kids have problems due to the father, as he is all to blame for all of this. I take no responsibility for any of this type of behavior. Sounds about right from a BMT or Baby Momma Terrorist. Always an excuse by the BMT. Why are the appointments not with the dad being involved. Sounds like mom needs to get a job. The mom does not like the fact that dad has all of this evidence against her. She is losing the ability to play the victim. Mom, you need to clean up and work on being a better mom. You put locks on the outside of the door, is due to the mom not wanting to watch the kids. So Joe the father, is going to be your childcare then. So why are these people quitting. The mom does not like the fact she is going to be losing the $$.

If the things said about the mom are true, then that's awful. Idk if they did, but it sounds like they didn't, but if daycare truly saw all that, they're by law required to report it to cps. Again if its true then the mother is absolutely awful, but the father is talking about the moms educational level and the filth of the house, but he has TWO kids by her. Not one but TWO!!! There's no way he didn't know what kind of person she was.

Anyone know why the teacher wasn’t able to go into any details when she testified? As a preschool teacher for many years I’m curious. Also it was so awful to hear that the little girl was still in a diaper that she had been placed in by the school THE PREVIOUS DAY

I don't think it was a diaper from the previous day, how would they know that? Unless the daycare has their own branded diapers. I think it was the same clothes as the previous day and a soiled diaper.

​@@Cameron_F Many daycares will put the time on the diaper and sometimes the workers initials. This allows for staff to know what happened during the previous shift or to ensure that kids are being taken care of properly. So if they do this they would know it was a previous day's diaper.

As a former CPS worker, the daycare's statements and records (they do DAILY sheets!) Would be invaluable to substantiating or ruling out advise/neglect. The statement that the child returned to daycare the next day with the same marked diaper was enough for me.

In my opinion, issues exist on both sides. Mom’s delusional while dad’s a bully & possible control freak. Dad’s testimony was just as self-serving as mom’s. The claim that he completely changed the children’s lives in a month is questionable.Testimony was so contradictory that I question both sides credibility. I really hope these parents can learn how to be the kind of parents their children truly deserve. Change won’t be possible without any self-awareness on either side.

Mom is no June Cleaver. But dad puts my hackles up. He is VERY controlling. When he made the statement about Mom thanking him for his intervention, my hackles and eyebrows both shot up. His DV conviction and apparent victim complex are concerning but not surprising. He seems to care that he has an audience for rubbing mom's nose in her mistakes more than giving his kids the best path to success. Ladies, if this guy takes an interest in you, RUN.

Dad also has a responsibility to contact CPS whether he wanted to or not. Weak case. I think they're exaggerating. Where are the pictures, CPS report, Emergency Removal petition before a judge. OH, nowhere, nowhere at all. If I found out my child was in such a condition, I'd have been granted Emergency custody faster than anyone's could spin, neglecting to do so makes the Daycare and the Father criminally involved as well. So I'm guessing it wasn't the whole truth.

1:10:08 I'm so glad the judge called out cps on the fact the kids weren't playing and did appear distressed. Cps doesn't like the dad bc of past DV but frankly sometimes people can be pushed to a breaking point by someone crazy (mom) or acting crazy and may have to push her to ground to stop her from DV him. I mean we all know this happens by women as much as men. Men just don't often report as women do.

CPS called on a parent multiple times vs CPS never called on the kids with a parent. CPS doesn't go farther than coming in the house, interviewing tiny children, and then giving mom all the stuff needed to close a case until the next one comes along, vs NEVER HAD IT HAPPEN AT ALL. Dad deserves full custody. Hands freaking down. I rarely, if ever, think one parent over another deserves full custody, but.... Jesus.

Judge: "Do you have any criminal record?" Father: "No, just a couple of minor things I got in trouble for, the domestic violence that I went to jail for, a couple of priors when I was younger ...". The judge didn't call him out on it, but I am sure that he noticed. To me that is a huge red flag. I would have expected "Yes, I went to jail for DV, but I deeply regret it and I am a different person now". Instead he passed it off as not a big deal.

I’ve seen so many cases where CSD is called for things that are ridiculous and then turn a blind eye to horrible things. I enter those reports daily! Look up or Google : Victoria Martin in Albuquerque, NM. That’s just one case where there were so many reports but the kid was given back to the Mom.

I'm getting the feeling that dad knows the people at daycare and the teacher personally maybe and he probably gossips with them. Cps is not supposed to do that he doesn't get that!
