I’m a Kenyan Investment manager in Newyork.Cytonn’s biggest mistake was lack of a proper Risk Management unit to handle Asset Liability mismatch that would lead to liquidity risk.Unable keep their promise,their Reputation took a hit.Are they a scam?No. Poorly managed? It was a scam from the very beginning because. It takes 2-3 years to complete a real estate development but he was paying interest to investors every 6 months. Where was he getting the money to pay his investors, most likely from new investors and not from profits he got from selling houses which were unfinished. He also lied to investors who wanted their money back in 2019, he delayed in returning their money. When COVID happened in 2020 he told those investors that he can't repay because of COVID. He channeled the money he received to SPV's he owned and controlled without obtaining security from them.

Such a sad story. Due diligence and the reputation of the leader is important. Dande worked in Lehman brothers that caused the 2008 financial crisis. What made people think he is any different from the track record he set.

There is one thing that you didn't capture.... If the case goes the liquidation way, the secured investors will be paid first ..... which is very unfair. And that is the biggest trap about liquidation that, some of the investors are not seeing..

Update as of 22. Nov. 2024 A summary of court rulings of today 1. Cytonn applied for removal of OR saying its illegal and wanted the OR to be replaced- this application was denied by the Judge. 2. Cytonn wanted the court orders on selling assets removed-this application was denied by the Judge. 3. Cytonn wanted the Debt Restructuring Proposal to be presented to creditors -this application was denied by the Judge 4. Cytonn wanted Edwin Dande to be enjoined in the cases- the Judge ruled its like he is already enjoined since he is a central party to the cases as Director and shareholder. Further orders by the Judge 1. All assets of Cytonn to be sold. 2. Cytonn has been ordered to surrender all title deeds within 7 days and if they do not, the OR has been allowed to get provisional titles. 3. The OCS or police officers of where all the properties of Cytonn are located to assist in taking the assets from Cytonn so they can be given to the OR to be sold. 4. Cytonn has been allowed 30 days to allow people in houses that have been occupied to vacate the properties. 5. All parties have been ordered to support and cooperate with the liquidation process being led by the OR. 6. A date of 3rd February 2025 has been given where the court will be informed on the progress of the court orders issued. *the only matter that was not clear today was regarding the houses at Alma, where it is yet not known how many are legally purchased and how many are still available to be sold to pay the bank loan and creditors. The court has also given the 3rd of February 2025 as the date when it will hear applications and updates regarding this matter.

The advise in the end is just uum...not good. In Kenya, when you give someone your money, whether as a friend, or in an investment scheme, two things click in their head. First, you have sufficient money to live on so yiu do not need what you gave them. Second, they actually start wishing thet they asked for more. So, invest yourself. Go buy land and plant trees. In 15 years, the value of the land will have increased significantly and you can harvest the trees for more cash. Alternatively, buy land and grow grass, which does not need any management. You can sell that for millions in the future. Either way, keep your money close to yourself.
