He has no case for a lawsuit. Basically he cannot sue business insider because they quoted the two females and unless they knew it was lie they are covered by the 1st amendment. Dave Portnoy can sue the two girls but if it is a he said she said... Dave pays all the defendents lawyer fees which could be tens of millions. If he wins in court by proving it was false he gets nothing since girls under 25 rarely have any assets and all future income (above living expenses) they would likely hide.

It was grossly negligent of business insider to publish that article. They don’t just have to prove they didn’t know, they have to prove there was a good reason why they shouldn’t have known. Business Insider was apparently part of my newsfeed set up over a year ago. Prior to this whole Portnoy affair, I was increasingly annoyed by how ridiculous their articles seemed. A week ago, I’d canceled it as a source for selected articles even though I’d never paid for it. I’d never canceled any source before, of the many I’d originally selected. I think it was the 4th or 5th article I’d noticed over the last year that was warning of the complete collapse of the markets. Of all the myriad of articles that come across my feed, this source alone stood out as being completely fully of shit and obviously only concerned with sensationalizing anything for clicks. Happy to hear I’m not the only one seeing this outlet for what it is!
