It’s absolutely criminal that Dave should have to explain his Sex life publicly like this. If Dave pursues a lawsuit (and his case sounds fairly strong), this is his argument for pain and suffering. A blatant lie, perpetrated by a crook media company. I can’t believe a reasonable Court would support a policy that forces a citizen to publicly expose himself or his Personal/Sexual life to plead his innocence.

He has no case for a lawsuit. Basically he cannot sue business insider because they quoted the two females and unless they knew it was lie they are covered by the 1st amendment. Dave Portnoy can sue the two girls but if it is a he said she said... Dave pays all the defendents lawyer fees which could be tens of millions. If he wins in court by proving it was false he gets nothing since girls under 25 rarely have any assets and all future income (above living expenses) they would likely hide.

It was grossly negligent of business insider to publish that article. They don’t just have to prove they didn’t know, they have to prove there was a good reason why they shouldn’t have known. A bit slander price like this is exactly the kind of material business insider must investigate before posting.there is no way a court would support a policy that allows a company like business insider to close its eyes and publish whatever defamatory material they want.
